Dear Sir/Madam,

Shraddha Mevada (Member ID - M4389),
a resident of Ahmedabad, am filing this urgent complaint against Blue Mountain Resorts and Hospitality for misleading sales practices, misrepresentation, defective service and refusal to refund the amount paid, causing financial loss and mental distress.

Facts of the case:

On 14/04/2025, I attended an event at Vivanta Hotel, where representatives Mr. Abhinav Dixit and Mr. Ashish Sharma explained the membership schemes, displayed brochures of 4-star and 5-star resorts and promoted expensive packages.

Initially, at their Surat office, we were told that ₹25, 000 was insufficient, forcing us to pay ₹75, 000 for a 3-year plan. Later, the sales staff misled us into buying a 1-year membership for ₹25, 000.

During the event, we were immediately taken for dinner, while the staff filled in personal details in documents and did not allow us to read them. The sales representative assured us that there would be no additional charges at the time of booking, obtained our signature and swiped our card for payment.

Later, while trying to book, the company demanded additional charges. We refused, and the company sent a reconciliation email, confirming that ₹25, 000 had been deducted for 3 nights/4 days. We followed the reconciliation.

After the settlement, the company has now given false excuses, claiming that the selected resorts are unavailable or unrelated, and bookings can only be made after May 10, which is beyond the validity of the membership (April 2026).

Despite repeated requests, the company refuses to provide 1 year membership benefits, cancel the remaining membership or refund ₹25, 000.

Legal basis:

The conduct of Blue Mountain Resorts and Hospitality is as follows:
Misleading representation
Defective service
Unfair trade practice

These actions violate the Consumer Protection Act, 2019, particularly Sections 2(1)(r), 2(1)(c), and Section 12, and cause pecuniary loss and mental anguish.

Relief sought:
Immediate refund of ₹25, 000 paid by me.
Appropriate action against Blue Mountain Resorts and Hospitality for misleading and unfair trade practices.
Compensation for mental distress and inconvenience.
Any other relief deemed appropriate by the consumer forum.

I recently faced a very similar situation with Blue Mountain Resorts and Hospitality, and it has been extremely frustrating.

I was also approached with attractive offers, promised premium stays with no hidden charges, and was pressured into making a quick payment without being given enough time to properly review the terms. However, when I tried to book later, additional charges were demanded and the commitments made during the sales pitch were not honored.

This clearly feels like a case of misleading sales practices and unfair trade behavior. I completely understand the stress and inconvenience this causes.

I am currently trying to figure out the best way to get a refund. If anyone here has successfully resolved a similar issue or knows the proper process (legal or otherwise) to recover the amount, please guide me.
