BMW India — Bmw x5 service in bangalore - navnit motors

1) we bought a new x5 in the first week of july 2015.
2) first service is generally due at around 10, 000 kms or so. We sent our car for service and tyre change, since we were facing tyre issues in december 2015 to navnith motors. They changed the tyre but did not service the vehicle as they were busy (As mentioned by their service head to us orally) and suggested that we bring it in for service when it’s 10, 000 kms as there were still about 300 to 400 kms short of service due. Despite our telling them that we were planning on a longish tour and would be best if it was serviced then, they refused and returned the car
3) the car was serviced subsequently, upon our return from the tour. That time they did not mention anything to us about the fact that it had run over 1500 kms over service due kms - as it was done at their behest
4) when the car was due for it’s 2nd service in june - we called them for an appointment on the 8th of june 2016. They did not have any dates immediately and gave us a date of 21st june. As we had foreign dignitaries visiting our facility, it was not convenient for us. So despite our request for another date, we were given a date on 1st july 2016.
5) on 7th july, 2016 i was traveling internationally and hence sent the car the day after i left india for service. This time they sent us an email saying that it’s done over 600 kms after due kms and hence the warranty is not valid anymore

Here's the message that we got from navnit:

"greetings from bmw navnit motors,

Your vehicle has been reported to dealership reg bearing kaxxxxxx, for the engine oil service. We have inspected the vehicle and noticed that the vehicle has been driven – 600 km which is not recommended by the bmw which may lead in mechanical failures (Wear and tear) of your vehicle.


Note : engine & subsequent damage will not be covered by bmw due to overdue of the service."

The points to note here are:

A) when they have no time to service our cars and send them back or don’t give us dates when we call and ask, obviously they have a problem. We invest and buy expensive cars like the x5 to use it and not to park it in our garage - just because it’s due for service and they are unable to find time to service it. So we are caught in a quandary when they don’t give us service dates on time
B) navnith motors have been promising to improve their service levels for over an year now. When we were to buy the x5, i did object to our previous experience and service levels of the earlier owned 320 d - which they promised that would improve due to the fact that they were opening a new service station in the northern part of bangalore very soon (As promised in july 2015). Based on this, we decided to go ahead with the acquisition of the x5
C) it was only last couple of weeks back that they inaugurated their new facility and hence have not been able to maintain the promised service levels
D) it’s been 22 days or more since the car has been dropped off for service and it’s yet to be returned. They have refused to resolve the issue and extend the normal warranty terms - despite the fact that we have brought all the above facts to their attention and also to bmw india. We continue to pay emi on this vehicle and do not have the services of the same. It’s a bad situation for us now as we are losing huge amounts of money
E) i was on a holiday in uk, when bmw - india called and spoke to me about the car. They were rude and appeared to have a pre-conceived notion about the whole issue and did not give me a fair listen in. It resulted in ruining my holiday and created unnecessary tensions for us.
F) despite several attempts to make navnit motors / bmw realize their mistakes and hence the need to withdraw their warranty cut, they have not returned the vehicle to us after servicing nor have they taken steps to resolve the issue on hand.
