I have purchased a floor in Bptp park 81 project faridabad of 275 sq yards
If have already paid 80 % of payment and had not paid last 10% demand now m ready to pay it with intrest but they r not taking the Amt and saying that my allotment is cancelled. How can they cancelled after paying 80 % of payment.
Pls suggest what should I do.

    sir,

    i am dinesh khatri. i booked a 180sq.ft. unit in bclock (P7-14) in BPTP project BPTP PARK ELITE FLOOR. they give me allotment letter and we signature all documents like buyer seller agreement ect. My unit is p7, 1st floor. they demand me instalment for start of construction in feb.2010 and i paid it timely. after this no more demand from bptp. time to time i mail to bptp about the status of construction then they give me reply we are doing construction in many phases so when we will start the construction in ur unit then we will raised demand.
    sir more then one year coplite and after it they are not starting construction on my units so please tell me what can i do? bcz all time company giving me same reply very soon we will start construction but we cannt give me confirm date

    Same status here.. I also have been alloted a unit in Sector-80, Z block in their project Park elite floors. No construction has started since last 2.5 years. In fact their marketing office tells me that they do not have approvals for Sector-80 and it is not there on the map either. Customer care sends the same reply that they are incompetent to execute the project of 4000 flats. If they are incompetent, why did they accept the bookings in the first place...? Worst builder on Indian soil is BPTP.

    I have booked flat in BPTP spacio park serene .Due to some issue from BPTP regarding the building plans, the bank did not pay their timely demand.But now as the building plan is passed, so the bank has made the disbursement.Now the bad part about BPTP is that they are not availing me the timely payment discount of 10% as the payments were delayed due to their end.

      SAME HERE. THIS IS DINESH KUMAR. I HAVE APPLIED FOR GROUND FLOOR BUT ALLOTED 7TH FLOOR AND TILL DATE NO CLUIE OF THE LOAN SANCTION. THERE IS HUGE PENDING AMOUNT TO BE PAID, OTHERWISE THEY WILL CANCLE THE ALLOTMENT. WE CAN NOT LEAVE THEM WITHOUT ANY ACTION AGAINST THEM. WE NEED TO UNITE AND IF SOMETHING IS NOT DONE SOON, WE MUST FILE CASE IN CONSUMER COURT. THIS WHO HAVE NOT SENT THE AGREEMENT IT IS BETTER YOU HOLD THAT, AS THE LEGAL TERMS MENTIONED ARE NOT IN YOUR FAVOUR ANYWAYS.

        Sir/Madam
        We took a plot admeasuring 250 sq. yards @7,450 Rs. per sq. yard from BPTP Ltd. Having there registered office at M-11 Middle Circle, Connaught Place, New Delhi – 110001,India & having their corporate office at BPTP Crest, Plot # 15, Udyog Vihar Phase-IV, Gurgaon -122 015, Haryana, India on 1/09/2005 in a prelaunch state as they advertised for the same. The deal was done through signing advance registration form in the company’s format after which the company took cheques from us for Rs.3,00,0000&Rs.1,00,000 respectively which was duly honoured & receipt for the same is with us. Then the company after intervention from a Social Consumer Cell under which my whole family is also working as a part of our social responsibility for consumer interest under the name of “Consumer Federation of India” after which the company gave us an allotment letter for the plot after taking more than 50% payment of the total basic price as quoted above & allotted us Plot no.G3-25 admeasuring 289 square yards instead of 250 sq. Yards on 25th feb,2008 that is after 3 years of pre-launch that too after running from pillar to post & a lot of pressure & efforts of the consumer cell. Then since I ,Mrs. Kamlesh Bansal, r/o A-22,Green Park Main, New Delhi-110026,the plot holder purchased the plot thinking that we ,i.e., me & my husband who are in there senior citizen age will construct the plot into a house for our residence purpose so that we can get relief from the heavy rentals that we have to pay right now at our current residence, we keep on calling, writing & talking to the top management of the company to get physical possession of the plot so that we can make the payments for the leftover amount & take the possession but the company keep on giving us false baseless commitments of time till which they will hand over the physical possession of the plot. Then one fine day we happen to visit there site at Faridabad feeling that the company is not giving us satisfactory answers & know the exact status of the plot, there what we enquired & found we were taken aback the plot that the company has allotted us was not in existence there not even the block they were just digging going on that too after 5 years of launch then we came to know from the staff of the company there that the company did not even lay down any sewer & water lines & were also told that they don’t have clear permissions from many government departments so the process of giving physical possession to the plot holders are on hold till things are done& all formalities completed by the company & the government then it would be done with the company & the plot holders. Thus, we wrote a letter to the company asking for an explanation for the same, the company on the contrary through a phone call asked us to deposit our further instalment so that the company can further work on the completion of our plot. Honouring the telephonic demand made by the company we gave them further payments a cheque of Rs.2,25,384/- On the 24.01.2009 so that our work can be finished on a priority basis along with a letter again from Our Voluntary Consumer Cell to handover the physical possession on the immediate basis & take there residual amount. Then on 14th June,2010 the company send us a letter in which they pointed out a due of Rs.10,87,921/- as actual balance due out of a total amount of Rs.24,69,939/- & in addition to the above charges the company levied a Interest due(Calculated upto the date of letter ,i.e.,14 June,2010) amounting to Rs.4,60,842/- thus objecting to the interest they levied on us we objected the malpractices of the company through a legal letter to the company through Voluntary Consumer Cell “Consumer Federation Of India” .Recieving the letter company staff called us again after one month of receiving the letter& told us to pay the balance amount in order to get a complete waiver of the interest amount .Acting on the call we gave the company Rs.5,00,000/- on 29/07/2010 for which the company send us a receipt on our official email ID updated in company records then again send them a cheque of Rs.2,01,058/- one month after that for which again the company send us the receipt then when we were preparing to give the cheque of the residual cheque of Rs.3,86,863/- which although as mentioned in the company’s letter was meant for laying of sewer and water lines/development of parks & laying down of Roads & none of this was implemented near the plot which the company has allotted to us till the date the last demand letter was drafted to us & send to us So we spoke in the company regarding the same to kindly do the needful as they have mentioned in there demand letter but the company on the contrary gave us a Notice of Termination of the plot on 2nd November,2010 along with a cheque of Rs.20,18,484/- deducting a amount of Rs.64,592/- which they called it as brokerage. Acting on the letter we again spoke to various Top Management in the company so that our plot can be restored as we were dependent on the same as our future residential place shelling out all amount that we earned to get a self-owned house for residence in Faridabad in there project. We did not get any positive answer or solution from anyone in there Company moreover the Company’s M.D. Mr.Kabul Chawla even denied keeping a meeting to resolve the matter as we enquired in that area the plot rates were risen from Rs.7,500/- Per sq. yard to Rs.25,000/- per sq. yard as told to us by the brokers there as there was nothing available on the rates that the company has allotted the plot initially to us on their prelaunch state in 2005 on which we depended. Now the company top management, after intervention from a prominent lawyer who is even the counsel of the company & a common friend to us told us that they will restore the plot only in one condition if we are ready to pay a sum of Rs.10,00,000/- instead of actual balance of Rs.3,86,863/- more in total as they say the prices have gone up there particularly for this plot as the company’s developments are taking place co incidently around this plot now so M.D. of the company have a close eye on our plot & even threatened us that if not agreeable they will sell the plot to some other person for a price more than what they are asking. We tried to convince the company by telling them that we will go to the Honourable Consumer Court for the injustice they are doing with us as a consumer, on that person from there top management told us that they are not bothered about any litigation & we can do what we can as the M.D. the company has got powerful links with bureaucrats ,judges& politicians so no one will do anything but the case will go on in the courts for 5-10years & said that we will till that time sell this plot to someone else for more rates so we would be left with nothing else but to take the amount what the company is offering that can be even if the Honourable Consumer Court hear the matter can be that the court will levy some harassment charges or some other charges which will never be equitable to the current value of the plot. Sir, we pray the honourable court to kindly take our matter to your kind perusal for judgement sir so that we can get our plot restored back to our name by this fraudulent company. Sir we even spoke to their legal team they very clearly told us that by litigating with this company we will do nothing but waste our time & money since company have several cases going in the court for the same reason that cn be handled easily by the prominent legal team for which the company pay them, they even informed that we will get nothing by litigating but dates & dates. Then after a long duration of litigation a small amount of compensation which the company is always ready to pay. Sir, then to enquire the same we went through the www.consumercomplaints.in site in which after merely writing the name of this company “BPTP” we got so many complaints of similar nature about this company that we learned that this company is habitual of doing such things & are fully prepared of the repercussions of the same. Sir but we being the honourable senior citizens of India working for the Consumer Interest from past 12 years as non-profit ,non-political NGO, not supported financially from either Indian Government or elsewhere under a Organisation by the name of “Consumer Federation Of India”.Thus, sir we pray you to kindly help us in getting our residential plot restored back to our name so the we can pay back the actual dues of the company & get our plot back restored. Sir we look forward to hear from you at the earliest before its late & the company succeed in grabbing our plot as they have their evil eye on it due to increased prices & seek justice against this Fraudulent company.

          Hi There,

          I have booked a 3BHK apartment with BPTP Park Floors - Sector 76. BPTP sent me a letter last year Mar/April saying my allotment will get cancelled if I do not pay the due amount, for which I clearly replied in email saying that I have already paid 5 lakh rupees and am waiting for agreement papers and LIC to start loan disbursement for the project - before I can apply for loan with LIC. Since BPTP did not respond for many months I still went ahead and got my loan approved.

          I kept checking with BPTP about the LIC approval, which I was responded well, but I was never communicated about my cancellation of allotment. Recently when I again checked with them and I was shocked to know about cancellation being done last year in April.

          The case is clear miscommunication from BPTP and now they have stopped responding my emails also.

          My 5 lakhs are still with them and the only written option they have given is try to get allotment at current market rate.

          I can share my entire email communication with you.

          Please suggest.

          I have booked BPTP elite floor & I have paid Rs.6.5 laks. They say they have send final opportunity letter for payment on 14/03/2012. I have never recd.such letter. Now I am asking for the the solution / options. They only say that the Unit is cancelled. Further they don't say any thing. Actually they are trying to be fool the people. Suggest me what to do.

            I applied for an independent floor in Park Elite Floor project by M/s BPTP. I have paid 3 instalment. I am getting areply from the company that I have not paid the 3rd instalment in time. Hence I am not eligible for allotment. But the fact is that I send the instalment by DD through speed post on 20.10.09 whereas the payment due date was 23.10.09. It is further learnt that M/S BPTP has accepted instalment on 24.10.09.Again 25.10.09 was Sunday. and as per customer care reply they have received on 26.10.09.

            Hence M/s BPTP is playing foul for non- allotment as the property price has escalated.

            I request that BPTP may be advised to allotmnet me floor in Park eLITE fLOOR PROJECT.

            bptp elite floor — NON ALLOTMENT

            ALLOTMENT NOT DONE EVEN AFTER 35% AMOUNT PAID
            I feel like cheated by BPTP. I have booked park-elite floor at Faridabad and I have paid 35% of BSP. However, I have not been alloted the property in the first allotement. When contactated to BPTP official, they also do not have any idea as to when the next allotment will be done. They have simply fooled us. By this mail, I request authority to take action against this fraud.
            Its really a serious issue.
            BPTP should take cognizance of the matter and resolve the issue of suffering customers.

              1. BPTP can change the site of flats:
              The applications were sought for Park Elite Floors in Sector 85, but the actual floors were alloted in sector-85,75,76, at distance of 5 kms
              2.The company overbooked the flats.
              3. The complany will sign the BB agreement after 10 to12 months.
              4. Possession of flats will be given after 4 years of BB agreement.
              5. 95% payment will be taken within 2years of booking and possession will be given after 4 years of booking.
              6. Park Arena flats are being sold at discounted rates before applying, see the site of resort highrise in sector-5

              I am 100% agree with U . I have also suffered due to BPTP for the villa i booked in year 2005 and till dt there is no possession letter for which i have submitted my complaints many time but there is no response from the officer of BPTP . JOIN HANDS TOGETHER . HOW THESE builders can behave in such way . why we are silent after investing our hard earned money .

              I am sure if we consumer join hands together certainly they will act otherwise we shall force them to act or return whole amount with 18% interst rate which they usually charge in case customer delay the installments.
              The project is delayed .on top of it they are charging penalty for delayed payment & asking to sign undertaking. What should I do?

                Hi ! I applied for BPTP park 81 floor in Nehar paar project in sep 2009 . I have paid 7 lacs so far ( 20 % BSP ) . But till date I have not got allotment letter from BPTP.Several mails have been written to VP customer care Lipi Bhatiya & Kabul Chawla promotor but to my surprise nothing has been done & BPTP is using my money for their projects which is totally fraud on their part. Shame on them .I will suggest NO one should invest in any BPTP project & file case against the company.
                I want govt & Huda to take up the matterwith BPTP & cancel all Land alloted to they as they are not doing justice to normal investors .

                Seek urgent help to get myallotment letter.

                  I have given cheque to BPTP Rs. 2.5lac cheque number 375472 ,dated 24.02.10, that is got misplace from their bank, now it is 6 month for the cheque. they are asking for another cheque i am ready to issue freah cheque for the same.
                  i want clarity for non extra payment in particular installment in future.
                  decision is pending from their side. now they are writing mail for clear installmet otherwise they will charge interest for the same.

                  BPTP people is not comeup with solution. earlier they are not pick up phone...now they are repetatively deny for my queries arised in previous mail. everytime asking it is pending for mgt decision.. i went to their office several time but no one entertain me properly... i am confused the way are going with the company... whatever company has been committed earlier is got wrong... i am surprise they are are keep on launching new project & misguide no. of investor who want to take dream home from there...

                    - In May 2010 we booked a flat with M/s BPTP Ltd. Regd office M 11, Middle Circle Cannaught Circus, New Delhi 110 001.
                    - Scheme Park Floors, Flat No.101, Y Block, Sector 77, Faridabad.
                    - Now after several follow up they deny "...unit no 101 which was offered to you at the time of booking in not available...."
                    - They have not refund the booking amount till date.
                    - For refund of principal amount they ask for affidavit etc., having certain clause which are in favour of company eg advance reciept of refund cheque.

                      I had booked a flat in BPTP elite floors, Sector 85, faridabad in Aug'09 and as demanded by the builder, initially paid around 30-35% amount against 3 payment demands. However, I was not being considered in the 1st phase allotment held in Jan'10.
                      Post enquiry, I got the reply over email & letter by post that my name would be considered for 2nd phase to be held in next 2-3 months.
                      Thereafter, I am regularly enquiring about the date of next phase allotment but not getting any concrete answer on the timelines & builder is also pushing me by giving suggestion to surrender the application and take my money back with interest @ 9% PA or else shift the paid amount to other BPTP projects by paying additional amount as premium and with no initial discounts.
                      Later on, I also came to now that there are no. of other people, who are also the sufferers like me.
                      So, my request to all such sufferers (who are not being given the allotment in Elite floor project even after paying the huge booking amount) is to come together and raise your collective voice against builder's irresponsible act and fight for our right to get the sure allotment against the hard earned money paid.                         My name is vinod kumar sahu . i have applied a flat in BPTP elite floor project . they have alloted me the flat . I am having the bank sanction latter for my home loan. but we did not get any demand latter from BPTP.suddenly we have got the letter from BPTP that they have changed our flat no. and send us the demand latter on 17 jan 2011. when we have asked the neccessary documents whcih are required from them to get the laon disbursement they are unable to provide.THey have mention the last payment date 02 feb 2011. after that BPTP will charge the interest rate of 18%pa and they are also not providing me the NOC and permission to mortgage beafore the 2 feb 2011.

                        Please help me out and suggest me that if BPTP will not provide me the complete document than how can i get the loan disbursement. while BPTP is forcing me to make the payment on time which is not possible for be before the laon disbursement.

                          Major changes have been effected by BPTP in its flagship project named PaRK-81;AQ Block(300 sq yds.) ,Faridabad to the detriment of customers. The size of balconies have been changed unilaterally reducing its size drastically thereby completely compromising on its utility . As per actual floor plan, front balconies were supposed to be 20'x8' against which actual construction has divided the balcony into two of size 8'x3.3' and 8'x5'.Rear balcony's width has also been reduced from 5' to 3.5' . All this is going the render the balconies useless as it cannot be utilized even for sitting purposes.All customers having their floors allotted in AQ block of Park-81(300 sq.yds.) are requested to join together and raise a collective voice so that the developer does not get away with the booty duping teh customers.

                            my customer code is 120942 in park elite floors faridabad, having L-27 ground floors

                            1. I use to visit the spot where these flats are in under cunstruction
                            2. That before one month I visited there and saw that they are using very worst qulity of material specially bricks. I also physically made a complaint to the project office of bptp.

                            3. after two days again I visited there but same proceder was there
                            and not any actions were taken against the construction party and sam brick were using. I also told about this to an engeenier
                            but he did not give me any satisfactory ans.

                            4. I went to the bptp office at middle circle C.P. delhi and met miss/mrs.parul and told about it. She satisfied me with some sweet words.

                            5. Today I again visited there but the same bricks are being used to made the toilet and kitchen walls. I brougth an engeeneer of nice project pvt ltd. but again he did not give me any satisfactory answer

                            6 In the meanwhile every time I made a caal to bptp middle circle
                            they just told me to forward my complaint but not even single step is taken against my complaint.
                            7. I requst to concerned officials that the walls of toilet and kicthen and back boundry wall mus be reconstructed.
                            8. One of my brother is in India T.V.

                            No. 8. Is only becouse I fed up by giving u again and agin information but no necessory steps are taken

                              Hi, I'm M. M. Maurya a sufferer of BPTP. I have booked a flat in BPTP park elite Faridabad and deposited 2 installment of Rs. 4 lac and a sanction letter of loan ammount of Rs. 14 lac. HDFC bank has sanctioned the loan for unapproved project. When I asked BPTP to clarify, one Ms. Pooja Behal replied me that they have all the necessary approval with them. After some time I met Ms. Parul Julka and asked him about unapproved project, she replied that they dont have all the approval with them. and the next draw will be held in 2 or three months latest Aug. 2010. Now they are advising me either shift to any other project of BPTP or take refund. When I ask for 2nd draw they expressed that they are not in a position to tell me any time frame. Now I am of the opinion that the BPTP company is fraud company. Kindly advise me how I get flat from BPTP.

                                Dear All,

                                I been to bptp office today and inquire about the allotment of park elite floors. They are not confirming any time frame for allotment and asking you to opt for refund.
                                If all the unallotee in Park elite floor will be united and make a forum, some result can be seen, otherwise till now we are fighting like an individual with bptp which will not have any result. Unless until we don't approach to legal help nothing can be done.

                                Please share your views and if interested lets make a forum and do somethings.

                                BPTP Elite Floors — Delay in allotment

                                They are delay the allotment, please let me know my allotment. I had paid 35% payment them and still not received any allotment paper..

                                I also went to the BPTP office on 05-JAN.-2011 and got the information from Asst. Manager (Parul Julka) that they are going to inform by sending letters to the unalloted customers that allotment is going to happen in the month of May 2011. Please also enquire about the same and do let me know if get any update on the same. I am also suffering through the same situation.                                   I need support.
                                  I booked my flat in BPTP Park Floor-76 T41 G+5. After more 2 years, BPTP has confirmed that they are unable to acquire land for this particular tower.

                                  BPTP has suggested in the mail to proceed for refund through refund formalities. They are confirmed to give 9% interest.

                                  They want us to fill surender form and get the dealer noc( no objection certificate) or else they would deduct the comission ammount. Dealer is denying to give the same. We have with us dealers discount certification of 3.5 %. Pls suggest way forward.

                                    Dear Sir

                                    I would like to compliment the team behind management of this portal as it is doing an exemplary job in addressing the consumer grievances by taking companies to task in case of deficiency in service. The system is working well as the issues are addressed immediately but when it comes to issues related to BPTP the resolution is not so convincing as despite so many complaints on builder nothing seems to have worked. The builder is taking consumers for granted and is launching new project every now and then without paying heed to the previously launched project.

                                    I had booked a 150 sq. yd villa in BPTP Parkland – Faridabad in 2005 which was allotted to me after lot of persuasion in “F Block”. Nothing moved for three four years till I came to know that there is some land dispute in that area. After taking up the matter with company officials it was re-located the villa in “L-Block” in Nov’2009. Since then nothing has moved again, five years have lapsed since I booked the Villa but construction have not commenced as yet, worthless talking about the possession.

                                    Approaching company officials is pointless as no one gives any clarity on the actual date when the work will start, the only phrase they stick to is whenever you talk to them is that it will start in three four months.

                                    It is very upsetting that the company is getting away with such callous attitude and launching new project every now and then. On raising this concern the company officials have an audacity of telling you that if you don’t want to continue withdraw your money we will pay 9% interest. You would appreciate that an investment in real estate is made either as an end user or if done as an investor then it is not done for 9% as there are many other avenues which offer much higher returns then offered by them apart from normal FD rates which went upto 10.5% during recession period. Even by Capital indexation method the appreciation is much higher than the interest rate being offered by them.

                                    Customers are suffering and will be duped further by BPTP if no corrective action is taken by an authority like you. It is only you who can protect consumer’s interest.

                                    Thanking you in anticipation that like other industries you will take up the matter with them seriously to help consumer suffering at their hands and end the “MIGHT IS RIGHT” policy adopted by them.

                                    I completely agree with Asheesh and I am also in a same situation like him. Mine also have been shifted from F to L block with no progress since last 5 years.
                                    Can you do something about this or check with the developer ?
                                    Calling them is useless as they always say it will take 3-4 months.

                                    No information as yet. Request the authorities to intervene and push them to start construction. The website of theirs shows one set of pics which is for 350 Sqyd villa beyond that there is no information on the site or to the customers.

                                    At BPTP things started rolling after six years only after competent Government authorities managing this portal intervened against my complaint of 25th Sept’10. Post that complaint the company initiated some work on villas and had asked for additional money. The construction was more of an eye wash for the Government agencies as after raising demand in Dec’10 the work is stalled again. The company is least bothered to inform its customers the reasons for stopping the work which started only after six years.

                                    As referred in earlier complaints as well that the officials of the builder (BPTP) either oblivious of the actual realities or do not share the exact reason for such delays and stoppage of work but maintain the stand the work will start by month end.

                                    Will it be possible for you to take up the matter with them again seriously and help many buyers like me as I am paying heavy interest on the housing loan whereas builder is least bothered about completing the project? It seems the builder is using funds raised from this project to complete their other project. On asking for the refund the company is offering 9% interest, though it might be mentioned in the agreements (which is normally one sided) but how come they can charge 18% to 24% in case there is delay from the buyers side.

                                    I seek your help in pushing them to either complete the project or refund the money with interest of 18% (so as to have some penalty element built into it) as by paying just 9% they had luxury of arranging funds at a rate much lower than market rate which they would have got to initiate t. The other option could be to consider cost indexation method to arrive at the cost but certainly 9% is not good enough to make good the financial and opportunity losses one incurs.

                                    PLEASE HELP AS DON’T KNOW WHAT TO DO AND HOW TO AVOID BEING TAKEN FOR RIDE BY SUCH PEOPLE. ONLY THIS AGENCY CAN HELP IN PROTECTIONG THE INTEREST OF COMMON MAN WHO IS ALLURED AND GET TRAPPED WITH THEIR BIG ASSURANCES/PROMISES AND THEN KEEP ON STRUGLING TO GET THEIR HARD EARNED MONEY BACK.

                                      I have booked one 180 sq yards elite floor in BPTP naharpar FARIDABAD and has paid all the dues timely.At the time of booking,I was told that I shall get confirm allotment but after that the BPTP PRO told that since the no. of persons were more than the no. of houses /flats to be constructed,it will be given very soon and till the allotment is not given the BPTP shall pay the interest @9% p.a. to me.
                                      After the promised date of Jan. and Feb.2010,the BPTP is continuously promising me that extra land is being purchased and I have not to worry at all.
                                      Sir, here the question is of mental torture being given to me by BPTP as every time they are giving separate date.I have taken the loan from my PF being GOVT. Employee and my one daughter is at the verge of marriage.

                                      I have booked in 250 Sq yd plot. But still floor is not allotted to me. Whenever you called then they will tell you that your name is there for second phase of allotment. But they are not telling the dates.

                                        Dear All,

                                        This is to bring to the notice of all through this Forum not to sign the Addendum being forwarded to be signed by BPTP.

                                        I own a 250yrd IInd Floor @ BPTP Park Elite Floors & signed my Flat Buyer Agreemnt in the month of May.

                                        I am surprised to come to know while browsing through all the Forums that nobody has read between the lines & understood the actual objective of this Addendum.

                                        While Clause 2 under the Changes mentioned is very much clear, whereby it has been mentioned that the period of 24 months shall be counted from the day of Approval of Plan or the day of signing the Agreement whichever is later ; which clearly means that it is to be counted from the day of signing the Agreement as Agreement with all the buyers was signed after the Approval & many buyers are still to sign the Agreement.

                                        The major catch is in the clause 1, which states the detailed definition of Super Area. While it seems to be very normal & simple in the first look, but there is a bigger Game being played by BPTP.

                                        I trust we all remember the product beeing presented ot us since starting & lets revisit the same: -

                                        1. In the initial Offer the Area mentoned through the Brochure was presented as a) Built UP Area b) Terrace Area & c) Total Usable Area. The Basic Sale Price was quoted in Lumpsum for the Total Usable Area.

                                        2. In the Flat Buyer Agreement the Built - Up Area was mentioned as Super Area & within the defination it was mentioned that it will be inclusive of Balconies & Stair Cases (Of which the Floor Plan had been enclosed within the Agreement).
                                        For the notice of All there was no reference made of the terrace area in the Flat Buyer Agreement & thereby the Per sq ft. Basic Sale Price was calculated by using the formula - Lumpsum BSP / Built Up Area whcih should have been - Lumpsum BSP / Total Usable Area.
                                        When it was brought to the notice of the Representatives at BPTP at the time of signing the Agreement they very smartly mentioned verbally that the terrace area is free of cost as mentioned in the brochure & therefore not mentioned in the Agreement & thanks to my foolishness I got convinced.

                                        3. Now please read the Addedndum carefully whereby the Terrace Area has been very smartly induced within the definition of the Super Area. This will mean that your Super Area will be = Built-up Area + Terrace Area which is going to increase the Super Area by 30% - 55% dependent on the Floor.
                                        This is going to Empower BPTP to proclaim the charges on artificially depicted Addtional Area (Terrace Area) @ Rs.2450/- per sq ft as mentioned in the Flat Buyer Agreement at the time of Completion certificate.

                                        I have reached this assessment after consulting 2 Senior Legal Personnels (VP Level) in the Real Estate Industry.

                                        I hereby request All the Buyers not to sign this Addendum without legal consultation. This could be withdrawn by BPTP only when we as Buyers do not sign this & boycott this together.

                                        What they are threatening is to withdraw 5% timely payment discount which they can withdraw any time as per the Agreement & is very meager when you compare it with 10-15 Lacs they could charge on the basis of this Addendum.

                                        I have also got small response letter to be forwarded to BPTP through the Legal Expert.

                                        I will share the same here on Tuesday & could be downloaded from here.

                                        God May safeguard us from these attempts of Fraudulent acts .
