Builder (Rajdeep dey) has taken advance maintenance even before the construction was complete and now he says that the maintenance money is completely spent (On what don’t know) and nothing remaining to transfer to rwa.

The builder has defaulted the maintenance money and cheated the resident owners.

Builder has not yet given noc even though all dues are clear

I am paying double maintenance now
1. 30k advance maintenance paid
The builder has to give a break up of where he spent this money

2. Now I have to pay 2500/- every month to the rWA

    After making agreement money, due to personal circumstances, decided to terminate the contract and requested builder accordingly - request to refund the balance after deducting penalty. The builder is not ready to any money - point blank saying that they don't want to cancel the agreement.
    Not sure, what can i do here. I can understand, i should have not decided to buy at first place, if i would have known about snr reputation.
    The builder is finding so easy not return any money and not honoring the agreement!!???
    I communicated many times with the builder, but, no response. I don't see it makes no sense to communicate with the builder anymore.

    First payment demand, i received from the builder as on 20th march, 2018. Unfortunately, my current situation forcing me to terminate the agreement and requested accordingly.

    Here is the clause about penalty:

    2. If the second party commits any default in the payment of any amount as aforesaid within 15 days from the date of issue of the notice for payment by the first party to the second party and/or in observing and performing any terms and conditions of this agreement, the first party shall have a right to terminate this agreement and forfeit 5% of the entire contract amount agreed to be paid by the second party irrespective of the advances paid by the second party and the first party shall refund the balance amount, if any to the second party and the first party thereafter shall have a right to allot and/or construct the schedule ii property to any other person or persons without any further reference to the second party.
    2 (A).in the alternative and at the sole discretion of the first party, the first party may instead of the aforesaid forfeiture clause, charge interest at the rate of 2% per month for the delayed payments.

    After having a long and constructive discussion with the company representative Mr. Sathish Kumar over phone and on WhatsApp, I am deciding to mark this ticket as resolved. Both me and SNR agreed to honor the agreement. As per the agreement, after deducting 5%, SNR agreed to refund the balance that I paid at the time of agreement. Sathish's phone number is 9600247014.

      I have requested to cancel the agreement and as per agreement ready to pay penalty, but the builder is not ready to refund any money, saying no way it can be terminated after these many months, but, nothing is mentioned in the agreement. I am requesting him to honor the agreement, but, he just ignoring me.

      Is it so easy in our country to cheat like this?

      Yes, there was a typo. One of my friends sent the above message, I copied and pasted, on his behalf - so, please instead of "I" read "one of friends". Anyway, it's not important to know the name {I am sure, you know whom I am talking about}. My friend is living abroad now a days and hence it's difficult for him to make frequent communication with you, still he tried but not received reply from you with proper solution. I can find out the latest and can ask him to drop another reminder, if you want to.

        1. The complaint is as follows:
        a) During the initial payment in March 2015 I was told that the registration amount will be approx. around 1, 25, 000/-. Hence, I saved that money and contacted the seller in July 2017.
        b) During this time, I was informed that the registration amount has changed due to the change in the government evaluation price. (Annexure C attached). The difference amount was about 90, 000/-.
        c) There was no problem here as it was the case of change in the govt. evaluation price.
        d) I had to postpone my registration in order to arrange for the additional amount.
        e) When the additional amount was arranged by the month of September 2017, I had got the DDs ready and contacted a person called Somu (an associate of SNR Pvt Ltd) for the proceedings of the registration.
        f) I had called Somu many times to clarify the details and all required documents to be carried.
        g) However, upon arriving at the Attibele registrar office, Somu asks for the 20, 000 cash as a fee to proceed with the registration. Upon asking him, why he had not mentioned this to me earlier when I had contacted him, he had no reply. He and another associate of SNR Pvt Ltd named Satish informed me that until I pay the 20, 000 fees the registration will not happen.
        h) This was the beginning of the problem. If they had mentioned to me in advance I would have arranged for the money and would have planned the registration at a later date.
        i) However, since I was this close to registration I borrowed 20, 000 from a friend and payed the 20, 000 fees on the same day to complete the registration.
        j) Once the registration was complete, I asked Satish (the associate of SNR Pvt Ltd) if anything else was pending and if everything was clear.
        k) Satish mentioned to me that nothing was pending, all is clear and he asked me to come and collect my keys post the registration documents were submitted to the bank. The Property is mortgaged with Corporation bank.
        l) There was a delay in submitting the papers. Upon calling Satish to enquire, he said that he was on leave and to contact Somu. Somu had stopped answering my phone by then.
        m) I called Satish again after a day to confirm if the registration sale deed was submitted to the bank and that if can I can collect my keys, he said that the documents were submitted and I can collect my keys.
        n) When I go to collect the key, I was informed by the site engineer (Srinivas) that I had to pay another additional amount of 30, 000/-
        o) Upon enquiring I was told that this was the future maintenance charges for one year in advance.
        p) Here is where the problem started. I called Satish to ask him about these charges and why he didn’t inform me about this in advance or at least on the day of registration when I had asked him if anything else was pending. To this his response simply was “everybody has paid so you have to pay also”.
        q) By this time, I was furious as every time I approached closer to possession, I was demanded an additional fees.
        r) Satish was very insensitive, disrespectful. He even called me a ‘fool’ for not understanding that the maintenance charges were normal.
        s) I was curious and slightly doubtful and hence enquired about why the maintenance charges to be paid in advance when the amenities promised were not yet ready. To this his reply was Lift and power backup was ready and that I will get my keys only if I pay 30, 000/-.
        t) My question here really was not about the maintenance charges. It was about why I was not informed well in advance. I would have planned better.
        u) I would have delayed my registration until I had arranged the full and final amount. First it was the 20, 000/- and later it was 30, 000/-.
        v) Now I am in a debt of 20, 000/- and I don’t have 30, 000/- immediately to arrange.
        w) I am not able to take the possession and the keys are still with the SNR Pvt Ltd even after registration is done and all money from bank is released.
        x) I decided to escalate this matter to the Managing director of SNR Square Pvt Ltd – Rajdeep Dey.
        y) I have explained this to Rajdeep in detail and have also communicated to him clearly about how Satish has miscommunicated that has caused me problems and that upon confronting Satish he has spoken disrespectfully and insulted me. (Annexure A and Annexure B attached)
        z) To all my communication with Rajdeep, he has been extremely rude, arrogant, very disrespectful and has even threatened me for writing him an email with a complaint (Annexure A and Annexure B attached)
        aa) Rajdeep has failed to manage customer grievance.
        bb) Upon having attempted to communicate and negotiate with Rajdeep, it was apparent that he was least interested in my problem and kept on insisting that I had to pay 30, 000 to get the possession.
        cc) I expected Rajdeep to understand my case and help me but instead I was put through harassment. He did not understand my problem and was very stubborn.
        dd) Rajdeep has not attempted to provide a solution to me. Instead he has put me into more problems for sending an email complaint.
        ee) It was due to Rajdeep and his team’s miscommunication there has been a delay in possession.
        ff) Rajdeep is responsible and accountable to keep his customers informed.
        There are two parts to this case

        Part 1: Satish’s miscommunication – due to this I am in debt and the possession of the apartment is delayed and I don’t even have proper information of what will happen in such a case. Can I take possession later or can I take possession now and pay the maintenance later? There is no communication to keep me informed.

        Part 2: Rajdeep’ s mishandling customer complaint: When a customer escalates a complaint to the MD, what is the role of the MD?
        Did Rajdeep understand my problem and try to manage my issue? – No
        Was there a proper customer grievance process? – No
        Did Rajdeep accept there was a problem? – No
        Did Rajdeep acknowledge that there was a problem? - No
        Instead of solving my problem, Rajdeep in turn has accused me of blaming him and has attempted to threaten me.

        This has caused a lot of mental agony, mental and physical stress and financial damage.

        2. The Builder has declined to negotiate both to email request and SMS request made at rajdeep.[protected]@snrsquare.com and at +91-[protected].

        3. I am stuck without possession of the apartment and without any possible solution or negotiation.

        After all the discussion with the builder, i paid the 30 K maintenance on the 29th Jan 2018 and took possession of the flat on 2nd Feb 2018. However the builder has given me a possession certificate dated 30th September 2017.
        Is this right? what should i call this attitude?
        There is some pending work, the main door polish and corridor painting, the door is some chipping which can hurt.. so far i am disappointed with the quality of service.

        So far the builder has not replied to this complaint? Apparently the MD, Mr. Rajdeep is too busy for his customers.

        After all this discussion i still see that as customer i feel very dejected and disrespected. I have no say and will continue to be exploited i guess.
        The builder is just not willing to take the responsibility of this doings.

        Now they are asking 30k for ekhata... 30k for what?
        the builder is not willing to share if he has got the release order/completion certificate from BMRDA?
        The builder is not willing to share the current khata documents which is in his name name, which needs to be transferred to individual apartment owners..

        After agreement for a flat of SNR Verity, due to some personal reason, I requested SNR Square to terminate the agreement and by honoring agreement, requested the Builder to refund balance after deducting penalty.
        The builder is saying that they not going to refund any money- saying either I have to go for buying the flat, else, ready to loose all money that I have already paid to them.
        This is really clear cheating case. I am ready to pay penalty as per the agreement, but, the builder is just not ready to refund any money that I paid at the time of agreement.
        Is it so easy for builders to steal customers money? Don't they need to obey any laws and we salaried people are easy for them!!?

        I would like to mark this issue as RESOLVED - it took a bit longer, because it seems the concern person, who handles these issues were absent for a long and then became busy for other stuff.
        Anyway, Both me and SNR agreed to honor the agreement. As per the agreement, after deducting 5%, SNR agreed to refund the balance that I paid at the time of agreement.
        So, I would like to mention that constructive communications and patience helped here to resolve the issue and I have nothing to say against SNR and I would do business with them in future, if situation changes.
        There are so many corrupt builders are around and they are surviving well, by stealing money from ordinary citizen of India.
        SNR is one of the most corrupt builders in Bangalore - I can't understand, why this builder is not blacklisted, yet - builders like this target always very simple, salaried people like us, who are completely depended on salary and all our money is white.
        My suggestion, please, let everyone whom you know or who want to deal with this cheater/corrupt builder - never think to even talk for any deal with this builder.
        Since, the system does not allow to delete any comments on discussion forum, so, I thought to put a comment again here.

          Cheating and false promises by snr builders/snr square/snr wind mill and vertiny

          Recently booked an apartment with snr square snr wind mill and faced a couple 0f problems.

          1.Initially they told me that i have to pay 8 lakhs within 1 month of booking and the next payment would start from 2016 aug onward's, this was ok with me but within a month they called me and said i have to pay 20 lakhs and the followup mails mentioned that they would charge me interest if don't pay immediately, i was devastated as i didn't have that money i called up the sales guys who committed and after much follow up that issue was not rectified

          2. Then started the agreement signing process since i live abroad they sent the copies to my overseas address the first time they sent me a wrong copy and then i had to send it back to them to correct and send it back to me, the next time it was ok and my overall postal charge was 100$. Then i requested them to send the final s & c agreement to my address in tamilnadu its been two months now the agreement has not reached, the courier guys are calling my parents and saying we cant deliver it your home you have to come and collect it from the office since my parents are aged they cant go and collect, so i raised this matter with the snr square/snr builders staff and they are saying we cant help it its up-to you to go and collect it if your parents cant go arrange someone else we cant help you. I am really surprised at their casual attitude.

          Since this is my first home i wanted to go with a reputed builder for a hassle free experience, looks like i am completely wrong

          Dear sir i have made payment of rs 7000 on[protected] to snr arts and science
          college for my son college sem fees. Now college is not issuing hall ticket for my son reason college fees is pending. Plese verify the details
          SNR is one of the most corrupt builders in Bangalore - I can't understand, why this builder is not blacklisted, yet - builders like this target always very simple, salaried people like us, who are completely depended on salary and all our money is white as they know they can play with us, because, we don't have time to take case to the court, neither we want to - whatever this builder puts in agreement, does not honor at all- Try to cheat, make customers fool in every respects.
          My suggestion, please, let everyone whom you know or who want to deal with this cheater/corrupt builder - never think to even talk for any deal with this builder.
