Sir,

I booked of a 2BHK flat in Park Floor project of BPTP in Faridabad. It is low rise project having Ground + 3 floors. A brief of the problem is as follows:

• On 31/7/2008, I booked a 3rd floor flat at a Basic Sales Price (BSP) of Rs. 19.85 Lacs in the “Park Floors” group housing project of BPTP. In this project the BSP of ground/first/second floor flats is Rs. 22.85 Lacs whereas the BSP of third floor is Rs. 19.85 Lacs. Third floor also has terrace usage rights for which builder is charging PLC.

• The application for booking did not have any clause that the allotment will be through draw. BPTP vide letter dated 18 Sept 2008 raised demand for completion of 20 % of BSP and stated that the company shall make allotment of flats through computerized draw of lots. BPTP further stated that “in case number of applicants for any floor are more than the available flats on that floor, in that eventuality the applicant may not get allotted the flat on the floor opted by them then they may be allotted the flat on other floor, subject to availability”.

• BPTP vide letter dated 17 Dec 2008 informed me that company has allotted flat and asked to complete 30% BSP. Few days later, BPTP revised the demanded amount to higher value to. When contacted BPTP official told me verbally that I have been allotted with a ground floor flat having BSP higher by 3 Lacs.

• I did not accept the ground floor flat as allotted and requested BPTP to make allotment as per my application, and stopped making further payments due incorrect allotment and higher price. I made numerous requests to BPTP for allotment as per my application and several time I met their officials but BPTP did not respond to any of my letter. BPTP could not make allotment as per my application.

• After more than one year of, due failure of builder to allot me flat as per my application, I informed BPTP of withdrawing my application for allotment and thereby canceling my booking.

Despite my repeated request BPTP could not allot flat according to my application for booking and now, BPTP is not refunding the amount I paid for the booking i.e. Rs. 4.0 Lakhs. May I request you to please advise me what legal or other remedies I have to get refund of my money from the BPTP. I haven’t signed any formal agreement, though, I signed application for allotment which contained tentative terms to be included in the agreement and they are one sided only.

I booked a flat in BPTP Project “Park Floors”, Faridabad. It is low rise project with G + 3 floors. The Basic Sales Price (BSP) of ground, first and second floor are same whereas thr BSP of third floor is less by Rs. 3 Lacs. A brief of the problem is as follows:
• The Basic Sales Price (BSP) of the flat I is Rs. 19, 85, 000.00 (Rs. Nineteen Lacs Eighty Five thousands only) for 3rd floor flat (with terrace usage rights for which builder is charging PLC). The project has G+ 3 floors and the BSP of Ground, first and second are different (higher) than that of 3rd floor as mention above.
• Subsequent to booking, BPTP while raising demand for completion of 20 % also stated that flats will be allotted through computerized draw and that the applicant if do not get the floor opted by him may be allotted the flat on another floor. The booking application of BPTP did not have any clause indicating that allotment will be through draw.
• BPTP allotted a ground floor flat to me whose BSP itself is more by Rs 3 Lacs and total cost will be higher by Rs 5.25 Lacs than the flat I have booked.
• I did not accept the flat allotted to me and requested BPTP to make allotment to me as per my Application and I stopped making further payments, since the flat I had booked has lower BSP then the one they allotted me. BPTP says that they do not have any flats ( as per my application) and they are also refusing to refund 20 % (Rs 4 Lacs) amount I had paid toward booking & completing 20 % of the BSP.
May I request you to please advise me whether I have any option/remedies, legal (through consumer complaints), to get my money refund from the BPTP. Kindly help me by giving an appropriate advice.

I agree with Mr. Sharma. BPTP had shown arrogance in not refunding money of investors even though they have made blatant mistakes. I am surprised that authorities are not taking any steps.
Fate of villa is still unknown. BPTP is not replying at all.

    FRAUD BY BPTP

    I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS.     I have a flat 901 in BPTP Freedom Park Life in sec-57. These are the complaints that we have for BPTP:-
    1) Haryana Goverment has increased EDC about 55% but BPTP is charging the extra EDC of 267% for us. When we are asking the calculation are not able to produce any calculations.
    2) There are asking a huge amount of Power back installation but this was not mentioned in their aggrement. In their aggrement they have promised to give 100% power back but now they are saying that their power back is very strong that is why they are charging a huge amount from us.
    Also they are charging extra for the electricity meter installation.
    3)Their project is very much delayed but they are not giving any late penality charges. They are saying it is late due to Govt sanction. But they are charging huge amount of interest from us for our delayed payment. What a bad justification it is!
    4)They are charging a very high amount of maintainence charges for 12 months. We are telling them to charge for us quarter and meanwhile we will make RWA and maintain the society.
    5)Inspite of sale deed chages and stamp duty charges BPTP is charging huge amount of administrative charges. They are saying they are charing this for the registraion.

    It would be great help if anybody can take care of these unnecessary charges charged by BPTP.Lot of problem are in trouble due these actions of BPTP.

    I agree with all the points that you have posted. We need to take this up with BPTP collectively.
    I also own a flat in Freedom Park Life and struggling to know when do I get the possession of the flat. Its been couple of months for last one year and still it looks good to go for another one year.

    As per Buyers agreement, they should have been handed over flats to us within two years of start date of construction. Who knows what is the oficial start date of construction on BPTP's records but as far as I know... it has been more than 3 years since we executed and signed a buyers agreement with BPTP.

    I think, we should get united to fight against such things otherwise nothing is going to come our way... BPTP has been very rude in customer handling since begining (atleast that is my experience).

    I welcome other owners of Freedom Park Life's flat to contact me.

    I also own a flat in bptp freedom park life gurgaon ( 1402 ), n infact was looking for people to fight out on the points highlighted by mr Rajesh Gupta . I have also consulted a legal advisor who is already fighting a case of my earlier property in gurgaon, n have been suggested by my legal advisor to be collective n fight it out with bptp . So it is higly requested, all o[censored]s to get united and fight them .

    i agree also - there has been a delay in the possession - these people dont even respond on phone - i wanted clarity on the following :

    1 - are we residents doing something on the extra EDC IDC charged ?
    2 - are we suppose to pay meter charges administrative charges ?
    3 - are we looking at the latest service tax issue as per Budget ? any one has a clue on that ? BPTP officials donot have any clue - and this can be huge cost as well for the flats which are still under construction in Freedom Park Life.

    Yes i agree with you guys.

    I bought this apartment last year and they confirmed i will get posseion by oct 2009, basis that i got my babys admission in gurgaon.

    Now i have not got possion and paying huge amount as rent, where as i was staying at my house.

    Request RWA to do something on this. they should pay extra edc and monthly rent from specific period of time.

    I completely agree with the complaint. In fact there are more points on which BPTP is fraudulently charging the flat owners. People filed cases against the builder in the court to fight out the injustice. However after almost one year of struggle, the flat owners were left with no choice to give in because they were holding a double edged sword - paying loan EMI for the flat in BPTP Freedom Park Life, and paying rent for their existing rented accommodation. The builder is completely shameless and doesnt care what salaried people like us are going through in this entire struggle.
    If you are planning to buy a house, please stay away from BPTP. They are the biggest cheats.
    Hi all, I got the possession letter for my flat in Tower F. I was completely shocked to know the extra charges BPTP is levying. They delayed the project for over 16 months and didnt pay us penalty and they say this is due to HUDA delays and project was on time. This is clear cheating, I paid almost 10 lacs as interest for 16 months delay.

    Also, they sold us the flat with power back. They are charging 140, 000 for power back installation, this is absolutely ridiculous. They are charging 21, 000 for maintainence administrative charges and extra service tax. This is pure cheating and I plan to go to court.

    I would like to see if there are any volunteers to build up the case against this builder. I am based out of new jersey, US.

    Hi we also got the possession letter for bptp f tower...the good part was that the possession has come through and the extra edc idc charges mentioned above have not been levied. I do believe in the current circumstances this is good news! No doubt charges for maintainence are high and we hope the same gets reduced as and when a RWA is formed. Since, i have taken the same on 2nd sale i am not aware of the penalty charges if any...

    I was on the lookout for an appartment in Park Life and was almost ready to finalise the deal. But seeing the above comments I am quite apprehensive now in investing my hard money in such an unscrupulous builder. This blog is a great way to get inside information which no broker or the builder is willing to provide. Infact when I last went to see the flat I was about to finalise, I was shocked to see the roof leaking and water gushing out of the roof. The whole room was filled with water and there was complete seepage in the next room through the wall. I was disgusted to discover the construction quality and thanked God that I was saved at the last moment.
    I do not want to alarm anybody because this might be an isolated case (and hope it is), but this was enough for me to decide against investing in not just this one but any BPTP project.

    I totally agree with your comments & second it. I am also one of the owners in Block A which is mucu much behind schedule. Now they tell possesion may be around 1st quarter of 2011. As per agmt.i/c taking grace period etc.in my case possession should have been given in June 2009 where as now they say 2011.Means clearcut delay of almost 21 months. I have written them 3-4 letters but they are least bothered to answer. I think we should address all the allotees & fix a mutual convenient time to meet on one Sunday at site & form a committe to take up & fight for all irregularties being done by BPTP & own willing charges which they want to cahrge s you have reflected.Since in our case possession is not yet give, I am not at all aware of these injustice techniques adopted by BPTP.
    We should jointly fight the case & tale all other allotees in confidence to unite to give lesson to such cheat builders.Pl. revert for our further joint proposed action. Even if we all have to take matter legally, we should be ready otherwise all o[censored]s will be in loss & befooled by the builder

    I will be moving to my BPTP apartment later this month.I had a an issue of seepage similar to the one mentioned above. I had put a request to fix a luckily it was attended and was fixed. I suggest take up the matter with the ons-site team an that should help.

    I own a unit in the BPTP Freedom park life and have seen the AAJ TAK piece. The site of BPTP even today claims EDC at 261Rs./sqft and IDC at 34.45 Rs./sqft.

    Are these rates still correct. Have flat owners paid the higher sum prior to taking possession? Is the registration cheque to be paid to BPTP account only, can we not register individually using a letter they would be so willing to give!?

    i have a flat too in freedom parklife. we too were harassed at the time of possession with a large additional bulk amount to be paid, of which we had no idea. this seems to a standard practice by the builder to make that last minute buck. besides quality of construction is very bad, walls are crooked. the apartment on possession is nothing like the sample flat.

    Dear colleagues,
    It is more than 1 year that I had posted my comment. The situation of Occupancy Certificate for Tower A even after 1 year or may take another year or few months remains unchanged. The customer care contacted from time to time gives a standard reply with no clarity. They also do not reply to the point of payment of penality by them for delays which is almost more than 2 years.

    When contacted there site engineer Mr.Jain at his no. [protected], clearly says that the balance and uncompleted jobs in my flat in tower A shall only be taken once Customer care of BPTP informs him about Occupancy certificate yet to be issued from authorities in Chandigarh. The other reason may be since EWS quarters are not yet completed, it is understood that Occpancy Certificate is not being issued for thsi reason. GOD KNOWS THE BEST.Lets meet on one sunday may be on 17th Sept., 2011 at about 11AM at site and discuss the further course of action and to jointly move in Consumer court.

    I fully agree and support your genuine issues but this builder BPTP is not only making fool o[censored]s but charging at his on will and person under pressure has no other alternative then to pay. You are even lucky that either you got possession or likely to get, but in my case for Tower A although it is almost going to be 5 years in Jan., 2012 [ abt. 4 yrs.9 months at now] and no body knows what the fate of occupation and when shall be. On contacting BPTP they have a standard reply of ZERO value.

    Still if any thing can be done, I am at your support as I shall have to bear same or even more problems as and when we get notice of occupation and hefty amount which BPTP is going to demand not caring hat penality delays they have to pay us.

      I had booked a villa in BPTP and they have already collected the 35% BSP + EDC +IDC. Last year they have colleceted 10% for completion of foundation. Since then there is no demand. Now I hear that they are relocating some of the villas, but they have not given any thing in wiriting. Can some one have knowledge about their plan for relocation? They are not replying any of the querries.

      I had booked a villa in BPTP and till now BPTP has already collected 35% of BSP. BPTP has collected the money against completion of fondation. Now they are talking about relocation of Villa. Futher they are not giving any definite reply to any of our querries and always trying to furnish ambiguous reply.

      Can some one suggest how good is BPTP in termes of their credibility?

      Will they construct the remaining villa?

      I have also booked a Villa in their Faridabad project. It is almost three years that they have collected part of BSP, EDC, IDC and had also signed contract but no information on the project status. Learned from the market that there are certain villas that need to be relocated for some legal complication. It was only on enquiring that they informed that there is some problem and we will inform about it in 15-20 days. Two months have lapsed and no response again. It is not possible to reach out to the seniors as you are not allowed by their secretariat and on top of it they have the audiciy of telling you go and do whatever you can as if we are asking for some personal favour.

      Is there some scope for individual customers or we have to live at their mercy that even after three years there is no clarity on the property plus their is no assurance that those who have invested in their project will not be cheated by giving villas in some secluded or say non prime area of the project.
      i also purchased 350 sq yds villa.. from the 1st allottee on a huge premium.. on diwali 2011.. i am the end user.. i am living on rent.. i dont know when bptp will offer possession???? please guys write to me on my mail.

        Hi

        I have invested in BPTP Villa's in sector 88 Faridabad. The agreemnet terms state the BPTP will deleiver the villa by 2010. Now they contemplating relocation Villa's apperently becuase of some land disput with oroginal land owner. Almost 50% Villa's owner's fate is hanging (of 500 odd Villas) as there is no official communication from BPTP.

        I am feed up of the callous response from BPTP regarding the status of Villa’s relocation. I was told to touch base with them today (23rd July) and that decision about relocation and modalities will be complete. Upon calling them, I received a rude shock that no progress has been made and the decision is still pending. I asked them if there is any option for refund, to which I did not get a very convincing reply. What to do????

        please suggest the legal course i have as a customer !!

        Yeah very true same is the case here. I also have a villa booked for 150 sq yards and there is no activity for same. Moreover there are reminders for making next payments else they attract penality per Agreeement.

        Surely something needs to be done to have the situation cleared up with BPTP. They are making huge promises for luring new customers and there are no hearing for one's lurching in Dark as they have already paid up considrable amount and none of Banks are either financing there Vialls project till date.

        I agree with you. BPTP is not giving value to their promises. BPTP had eralier collected payment against completion of foundation and now they are talking about relocation. Can we combine together and represt our case to them. They are unwilling to reply any of our question on this.
        I am also having a villa in BPTP and they are saying it would be relocated. I think first we should form some frum to keep our point. BPTP is not listening at all individually.
        This is a problem with all who have applied for Villa's in BPTP project. Even though Allotment money including EDC and IDC charges have already been paid still there is no clarity on the progress of the Project.

        Can the consumers expect a better response from the company.

        I am also Villa holder in BPTP. They are delivering me the villa but it is too much delayed. I booked in Jan 2006 still not got the possession. Also, booking a 225 yrds villa one expects to have at least 3 bed room house but what we are getting is two bedroom house. Its disgusting. You have spent your hard earned money to have duplex of 225 yrds just to have 2 bed room house?
        Its complete cheating on their side. Company already was going through troubled water last year when they reverted their deal in Noida. Now they are trying to cut costs through these stupid measures by penalising their existing customers who trusted them during tough time.
        I m also in the same boat.I was allocated villa 350 yds now they r saying it has to be reallocated but when no answer.their staff is uneducated & hs no knowledge of latest developments.I don't know what to do?
        What is the size of your villa? If you want refund, could you pls let me know your contact no. I would like to discuss. Currently, I am in UK.

        Hi, Even in May 2010, is there any status update? I also have a villa booked for 225 sq yards and there is no activity for same till date. Almost two years back, I was told that some of the Villas had to be relocated owing to their decongestion plan as directed by State Govt and papers have been put up for approval of the relocated villas in the adjacent area.There was not much clarity from the persons in BPTP. Even after two years of tine, BPTP has not officially communicated any update on the status. I feel that we need to be united to take up the matter with BPTP for any solution to the probelem.
        BPTP needs to be more professional.

        We bought land from BPTP faridabad in J-block. Now they are saying that they are going to relocate J-block. How can they even do this? Our property is funded by bank..Not sure what options do we have?

        I had booked a 225 sq yds villa in BPTP parklands Faridabad in Feb' 2006. In June 2007 villa no F-22-08 was allotted to me, however in April 2010 I was informed in writing that this villa will have to be relocated and consequently a new villa will be allotted to me within one year. Despite of several letters/reminders there is no response from BPTP so far even after Seventeen months. It appears BPTP officials are completely clueless about relocation of the villa. I would like to be part of this forum where we should get united to take up this matter with BPTP or any other appropriate body like consumer forum, CCI etc.
        I am also agree with all u guys . Now I am so fed up that i am planning to file case against the company .         I PURCHASED A DUPLEX 350 YDS FROM THE 1ST ALLOTTEE AT A CERTAIN PREMIUM. THIS WAS IN JUNE 2010. STILL I HAVE NOT GOT THE POSSESSION. ON ASKING WE ARE INFORMED THAT PAPERS ARE WITH HUDA AND AS SOON THEY GIVE OK WE SHALL GIVE POSSESSION. WHEN IT WILL BE?

        Same case, I was alloted villa F 1 17, and was told for relocation 2 years back but no information from company till date. Don't know what to do? Any suggestion.

        BPTP — Electricity meter of 38000.00

        Meter cost raised by BPTP is 38000.00 in Faridabad. I think complete GEN set can be purchased with this amount. How it can be possible to compel customers to purchase this meter. How Haryana GOVT can allow this to sail? BPTP's project is not in sail so they want money at any cost by hook or crook.
        Finally BPTP has given us the time of Nov. let us wait till Nov, going there will be pointless tomorrow.
        Same is the case here too. I booked a 150 sq yard in 2007, I was allotted in F block, in 2010 they shifted me to L block, some construction happened in 2011 but since then no progress has been seen on the site.
        We all have to fight in unity for the common rights. Lets form a group and move forward. Pls send me a message on my number [protected], we will form a group on whatsapp

          Hi,

          BPTP Ltd has launched a new project, Elite Independent Floors in Parklands Faridabad. The price of the house is so lucrative that I got interested. I went to one of the agents that advertised the Floor (3 BHK 180 S. Yd) for 15.36 Lacs only. They were so convincing about the property and the Payment plan and told me that they have tie ups with all leading banks and can get me a loan of 85% of the total property cost and that I will have to arrange only 15% of the cost.

          I was not convinced, but also didn't want to loose the opportunity, I gave them the application form with 2 post dated cheques each of Rs 1 Lac, and clearly told them that I will confirm once I am sure that I can get a loan of the remaining amount.

          The very next day, after consulting with the representatives of many finance organizations, after they told me that I can get only 75 % of the cost as loan, I told the agent not to place my booking and that I want to withdraw.

          He told me that he has also got the booking logged in. I told him that I will get the cheques payment stopped via the bank and that he should convey the same to the company.

          Even after that yesterday, the cheque came to my bank for clearing and it was dis-honoured, as I had already instructed my bank to stop the payment on the same.

          I wish to inform the general public that it is better to go through the company directly and not through agents. I am not sure if BPTP is a group that cheats people btu their agents certainly are.

          The agents are giving wrong information to the public and also telling that that they can offer the property on discounts too.

          Beware aspirants...
          This is an exceptional case. BPTP do not offer any discount. 75% finance will be available that also after making the second installment. That means the first and second payment will have to be paid by the customer itself. As regards to discount BPTP offer 5% on all installments (after the application money) if they are paid on or before due date.

          However one has to book the flat through reliable agents only those who give after sales service as the customer need the support of the agent for 3 years / till possession.
          I also booked the flat through agent ( BMR ) . Agent had promised me that he will allow me discount of 5% on BSP and same will adjusted in 2nd installement .
          But now when the second installement come, he is giving me 5% discount on BSP and now discount will adjusted in 10-12 installement instead of second installement.
          after paying 3 lakhs in advance now u r helpless . you cant do anything .

          I also booked one flat in Elite floor.I am service class men and I invested my hard earned money in this project for a house in NCR.I got scoked when i read these message that there project is not approved.If any body have correct idea then please update.My Agent promise me 6% Discount but till now he have n't paid a single coin.I really stuck.Please guide me what i need to do.Should we form a group and file case against them.

          These gyes are defenately checting people.
          I booked a flat trrough Go Direct infotech and they promissed me that they will give me 5% Discount on BSP but thay are now refusing me to give any discount
          I reported same with BPTP in written and no result and no call back.

          over document they mentioned that you will get allotment paper on November but this is December and no allotment paper yet.

          also you have to pay 35% as cash then only you can get bank Loan or you have to arrange Loan Sanction letter other wise they will not allot any Property to you and this information on Mail nothing Verbal.
          All banks are asking for Guranter who can pay in case you failed to pay that guranter should have no Loan and should be willing to pay all money.
          It means Property of BPTP have no Vlaue for them.

          as i did not get discount from broker so Marketvalueof my Flat is BSP-1.25Lac

          menas if i sell my property now i have to pay 1.25 from my Pocket confirmed from many Brokers.

            Cheat on property

            I booked property with BPTP in faridabad, The deal for a particular plot of my choice was closed at comparatively higher price than available in market at that point of time. I paid the 10% booking amount and was issued an allotment letter for the said plot; For the rest of the money to arrange the funds I demanded few legal papers related to property. And BPTP refused for that, later after some time on pressurizing them they said the plot...
