Sub– complaint against your retail asset hub kothrud, pune branch housing loan department particularly mr. Sagar ukade - manager, for committing breach of trust and misusing our cancelled signatures & documents to illegally deduct amount from our account maintained at dahisar west branch (Mumbai) and illegally holding an amount of rs.5, 000/- from my husband’s account at new marine lines branch (Mumbai) and and causing physical & mental harassment to us on 27/09/2017.

Respected sir,
I have to address to you my complaint against your retail asset hub kothrud, pune branch particularly mr. Sagar ukade, manager of housing loan department of kothrud branch,

1) myself and my husband both are your bank’s old customers since long. We had accounts with your mahim west branch (Mumbai) since year 2000 which we have now transferred to dahisar west branch (Mumbai) and we also have an account with your new marine lines branch (Mumbai) for more than 13 years.

2) in august, 2017 we decided to avail housing loan for a flat purchased at baner pune on 05/08/2017 by a registered agreement of sale, and hence a loan proposal was forwarded through dahisar-west branch to kothrud branch. It took about around 40 (Fourty) days for your kothrud branch to process our proposal. On 27/09/2017 we travelled from mumbai to your kothrud branch, pune as per their instructions for the purposes of completing process of disbursement of loan. On our arrival at kothrud branch about 10.45 a. M. We were informed that pre-sanctioning formalities are completed and the demand drafts of loan amount will be handed over to the vendors on the same day once we sign loan documents, mortgage deed, receipts.in good faith we signed all the blank (Unfilled) loan papers. Thereafter your loan officer required us to bring vendors for their signatures on receipt of demand drafts. The vendors were at their service place, hence they arrived in bank at about 4.15p. M.. Till that time we were in the branch (Except a lunch break), but we were not informed anything about conditions put by bank’s panel advocate advisor. After arrival of vendors they were also informed that once they sign receipts, original demand drafts will be handed over to them. Your said loan officer showed us xerox copies of demand drafts. Relying upon his words, vendors signed the receipts. Thereafter we requested your manager mr. Ukade to hand over demand drafts but he refused to hand over demand drafts and told us that we should execute, register and submit a sale deed to the bank if we want the demand drafts. We were shocked to hear this unwarranted condition mentioned at the eleventh hour to us. We told him that the vendors have already signed a receipt of demand drafts because your loan officer was supposed to hand over demand drafts to them for which they have signed a receipt in good faith, and now putting such anilllogical and illegal condition at eleventh hour is not warranted by logic as well as by law. We told your manager that he should have informed us in the morning itself that without execution and submitting a registered sale deed bank will not hand over money to the vendors and then we would have been in a position to decide whether to accept this condition or not i. E. Whether to proceed with proposal or not. We told him that if the demand drafts are not in hands of the vendors, then it legally means that the price consideration is not paid to the vendors in the eyes of law and in that position we will not execute a false statement on oath that payment of price consideration is paid & received without having amount transferred to the vendors’ accounts on said date. Further, it was highly impossible to execute & register any document at that time of day i. E.4.30 pm. However your manager acted highly adamant and refused to budge. At that time we went through the sanction letter and observed that execution of sale deed was never required by your panel advocate advisor as a condition precedent for disbursement of loan and same was put as a condition post-disbursement. Thus your manager acted against the report of your panel advocate too. (Said report & sanction letter are with your kothrud branch.) hence we decided to not to proceed further in the proposal and we cancelled the proposal by submitting a handwritten letter dated 27/09/2017 to said branch interalia mentioning the reason and declaring that all signatures, authority and documents are treated as cancelled. Hereto annexed copy of our letter dated 27/09/2017. We had to cancel the proposal only because your said manager acted adamant, against report of your advocate and demanded performance of an unwarranted & false act from us as a condition precedent for disbursement of loan amount.

3) on 28/09/2017 we learnt that your said manager deducted an amount of rs.343/- from dahisar west branch. He did it on the basis of authority letter on which he had obtained our signature on 27/09/2017 but was cancelled by us on 27/09/2017 itself. We had not availed loan facility from kothrud branch altogether, and said letter & all documents & signatures were already stood cancelled/non eston 27/09/2017, hence he had no authority to deduct amount from dahisar west branch. His said act amounts to misused of our cancelled signatures and cancelled documents in breach of banking trust and personal trust.

4) on further enquiry with your new marine lines branch, we learnt that an amount of rs.5000/- was kept on hold i. E. Can not be used by holder, under the instructions of kothrud branch. It is highly illegal on the part of kothrud branch to assume authority and to instruct new marine lines branch which was no way concerned in said proposal of housing loan, to keep said amount or any amount on hold i. E. Make it unusable to my husband who is first holder. Kothrud branch has no authority neither written nor implied to do so. By doing this your said branch had inflicted serious mental pain and agony to us. We have already suffered a loss of amount of rs.3100/- which we paid towards payment of stamp duty of mortgage deed which is one of the documents cancelled on 27/09/2019.

5) your said manager and his loan officer of kothrud branch have misused the cancelled documents & our signatures of loan proposal which were obtained from us under a false pretext. We required them to destroy our signatures and documents as same are non-est, however they have not done it till date. We apprehend that they will further misuse our cancelled signatures. We are under constant mental pressure which has adversely affected our health too. Your said manager and loan officer of kothrud branch have inflicted physical and mental harassment to us.
