Subject:- in reply to your letter no. Cbhfl/lko/sar/2019-20 dated 05.11.2019 for declaring property npa under sarfaesi act, 2002.
Sir,
Applicant sapnesh kumar s/o late sarvesh kumar r/o 10/459, indira nagar, lucknow humbly requested you several times for rescheduling his loan on below mentioned ground which applicant requested you on numerous occassion which seems gone in vague.
1. That the applicant is still having the currency in small denominations of rs. 1 & 2.
2. That the applicant has requested numerous times for rescheduling his loan so that he could be able to pay the loan emi.
3. That applicant’s previous letters dated 14th august 2018, 23rd october 2018 & 19th may 2019 has explained all his situation of facing difficulty in depositing the requisite amount in bank due to which he could not able to maintain the minimum balance which require.
4. That the previous letters of applicant went unnoticed.
5. That before declaring applicant’s property under n. P. A. You haven’t consider applicant’s situation at once.
6. That the request of applicant went unheard and declaration of applicant’s property under n. P. A. Seems an arbitrary action taken by bank as you have never replied any letter sent by applicant in which applicant simply requested you to reschedule his loan.
7. That the applicant still not in a position to pay the emi and requesting again to reschedule his loan.
8. That the action taken by you against the applicant without considering his previous requests of rescheduling his loan, seems you are in mood of taking the property of applicant this way or that way which is absolutely arbitrary.
As you haven’t consider the previous letters of applicant and took action of declaring applicant’s property under n. P. A.in very arbitrary manner is illegal.
Kindly reply the notice within 15 days of receiving it.in case of failure or no-reply from your side the applicant would take the shelter of court with competent jurisdiction.
