Re: Harassment and threatened by CHOLAMANDALAM DBS Finance LTD.

Dear Sir,

I had availed a Personal Loan from Cholamandalam DBS Finance Ltd., on 30/05/2008. My first installment was presented in the month of July 5, 2008. Since then, on every 05th of each month, the monthly installments were being debited. But from Feb 5th, 2009, I am unable to pay the installments, due to the economic meltdown prevailing, which has affected my business. I am running a Computer Education Institute and Coaching Education Institute. Due to the economic meltdown, prevailing, the students are unable to pay the fees on time, and that has had a cascading effect on my income, too. I have availed Personal Loans previously, too. Never in the past I have faced such problems where in my Installments are not paid on time. You can verify this from the CIBIL, which shall substantiate my version. I had bought this to the notice of the Managing Director in my earlier mail and fax in the month of February, 2009, at the Corporate Office at Chennai. Ever since then, RECOVERY AGENTS claiming to be from Cholamandalam DBS Finance Ltd., deliberately keep on visiting my premises and keep on harassing me and my husband, for the outstanding amount. I and my family are being threatened by unsolicited calls made at my office landline number. The caller does not introduce himself and uses abusive language which can be termed as below the belt language. I have asked these recovery agents / Anti social and anti national elements (visitors) of the Cholamandalam DBS Finance Ltd. visiting my premises to send me a communication in writing rather then keep on visiting my premises at unwanted times and events. I am being coerced and threatened by informing me that the company has several buckets in row to solve such cases and that in the last bucket, a well known Anti social, anti national element will be visiting my premises to collect my due, failing which my family will be physically assaulted, and publicly humiliated. I feel threatened and mentally disturbed by the turn of events taken place since last 15 days, wherein I am subjected to humiliation. The company’s so called recovery Goondas are deliberately informing my loan / financial status to my neighbours and to my remote relatives and to persons known to me, who in turn called me to find out the real problem.

Dear Sir, we are in a democratic setup, where in there exists a law of the land. When I asked these so called recovery persons to let me speak to the company higher ups officials, I was refused. When I asked them to act as per the law of the land, I was shocked to hear when the so called visitor informed me that it was he who had given me the money and not the courts, and that he shall keep on troubling me till I don’t cough up with the outstanding dues. I was informed that my case has been referred to the last bucket wherein I must be ready to face retaliation from well known Anti national and anti social elements. I hereby, wish to state that - In case I or any of my members in the family are hurt or are physically assaulted resulting in also loss of lives, the complete blame and responsibility should be completely attributed to the recovery Goondas of, the CHOLAMANDALAM DBS FINANCE LTD. I conclude my letter with immense grief and pain,

Sir/Madam: Sub: Complaint against Cholamandalam financial service

This is to bring to you notice that I G.Kamal Kumar employed as insurance professional at wns Bangalore s/o Shri D.Giriraju residing at no 4/2, Rangswamy temple street, 5th cross, Bangalore -560053 have suffered mental agony and harassment.

I was offered personal loan from dsa - loan agreement no xsegban[protected](Cholamandalam dbs ) for the amount 1, 50, 000.00 @ 15% roi and I had submitted all relevant documents. when I received the loan the rate of interest and loan amount was not inline with agreement & offer made, I immediately went to cholamandalam office(ulsoor branch) to refuse offer but I was informed by Mr. omkar singh (cholomandalam dbs ) to accept the loan and he would correct rate of interest and he reasoned error due to 'technical error'.

There was no response from Mr. omkar singh or the bank then contacted cholamandalam dbs head office Ms Jayasudha (Deputy personal manager) for a month without resolution 'correct roi so that I could make payments(emi)’ informed executive that I would initiate legal proceeds they also directed me to taken legal action, informed that I would make stop payments until this issue is resolved. Also sent email to [protected]@choladbs.murugappa.com

A legal notice 'To correct rate of interest so that emi payments will be paid on every month' was issued thru Mr. H.S.Umesh (lawyer) to cholamandalam dbs (2 notices were issued) without response, when legal proceeds was actioned, cholamandalam dbs had sent 5 debt collection agents to my house (One of executive's name was Mr. Anand) Agents resorted to intimidation/harassment, humiliated me & my family members & threatening with life when I tried reasoning that issue is under 'prejudice'. I informed that the 'proceeds is in court of law' and talk to my lawyer gave my lawyers contact number to contact Informed this to my lawyer and my lawyer had also made formal complaint at financial ombudsmen services at Bangalore. Inspite of this debt agency came to my house and threatened with dire consequences and I used to get threatening and anonymous calls.

There were 3 court hearings at 'lok adalat'in Bangalore and cholamandalam dbs abstained from it. Could the bank adopt threats, violence, unlawful way to pressurize me members of my family. I used to get frantic phone calls to my mobile often & at home informed them to contact my lawyer and they refused to give their identity / name of debt agency. In the month of Aug 2009 I was contacted by Mr. Raghavendra (cholamandalam dbs) I informed him to contact my lawyer, but coercive practice was again adopted by Cholamandalam dbs and sent Gangadhar (mob:[protected]claims he belongs to Karnataka Rakshanna Vedike) visited my home on 22nd, 23rd sep 2009 and adopted uncivilized, unlawful means threatened with life and said I would be contacted at home and office at all times.

I and my family have suffered humiliation, could the bank adopt threats, violence & unlawful way to pressurize me & members of my family when I have civil agreement with bank and matter is prejudiced.
I'm looking forward for legal action against all these illegal acts with full investigation as per provisions of law and I will terminate/clear my loan after justice.

I regret to say i had defaulted in my personal loan payments due to loss of my profession. I feel more regreted by the abusive language used by your personal from your branch in bangalore towards my family members in my absence at home.A rep. by name Hemanth from collection dept has been harrasing even in the nights with foul language.I promise to pay my dues in time from now as things are changing for my good, but request you to kindly help me with this represtative. Unfortunately his Rep dosent seem to understand my speaking to him. I really wonder at scb is there any dept which can help me?

Cholamandalam dbs finance company — Even payment done they are troubling me

I am having personal loan with cholamandal dbs.I'm paying regularly through cash payment and taking cash recipts.last month(October) i'm unable to pay because of my family problems.i payed pending payment in this month,and requested to give time of 10 days to clear the next payment.They accepted it and taken one month due initially,From next day onwards they started troubling me.They using unparlimentary language and troubling me a lot.If I paying regularly why can't they give time atleast 10days.Please giveme solution of this problem

    I had a motor insurance policy from Cholamandalam. The cheque for premium given bounced due to lack of fund on the partcular date. On intimation I immediately paid the premium with fine.

    In between I met an accident, however Cholamandalam, declined to pay the claim, citing the reason of checque bounce and policy discontinuation. Further they took more than 3 months to issue me a new policy.

    Please let me know, If they can discontinue a policy for premium cheque bounce without giving an opportunity to the customer, also while collecting a fine for checque bounce.

      I have taken a loan from Cholamandalam Bank for Two Wheeler Loan A/c No.X2WHDTW[protected] against ECS of Rs.2074/- from my above SB Account.

      I have received a call from Cholamandalam bank that the server of the bank is not working properly, hence the installment of above loan is to be paid by cash. On 30.03.2009 I have paid the amount by cash vide receipt No. 1107666 and collection agent Mr. Vikram also confirmed the technical problem of the server of Cholamandalam Bank.

      The above EMI was already cleared on 21.03.2009 through ECS from my Bank Account. (Copy of Bank Statement Attached).

      After that I have submitted the documents with Cholamandalam bank for refund of excess payment.

      On 23.04.2009 I have received a DD of Rs.1538/- bearing No. 139978 after deduction of cheque bouncing charges of Rs.536/-. After discussion I have came to know that the reason was in-sufficient funds, but as per my bank statement the funds were sufficient to clear the EMI.

      I have also submitted a letter to my banker i.e. Vijay BAnk, NIT, Faridabad but that told me that ECS cannot be stoped because it is coming directly through RBI.

      Continuousely I am giving call to Cholamandalam bank people and not getting any response brom them

      Kindly help me to refund the amount deducted by Cholamandalam bank.

      I have taken a personal loan from Cholamandalam Bank A/c No.YSEGJAY[protected] against ECS of Rs.3547/- from my above SB Account

      I have received a call from Cholamandalam bank that the server of the bank is not working properly; hence the installment of above loan is to be paid by cash. On date 03.04.2008 to 05.02.2009 I have paid the amount by cash and collection agent also confirmed the technical problem of the server of Cholamandalam Bank. 05.03.2009 Ecs is fun citing properly

      But this (05.04.2008 to 05.02.2009) period bad rescored entered in my account statement

      I need to remove this bad record what do, because of this my sit loan rejected

      Kindly help me to remove the bad record in my account statement by Cholamandalam bank.
      Dear Customer Care,

      My loan account number is XSEGKOL[protected]. The EMI of the loan is 17470/-. It comes to my bank on 5th or 6th of every month. According to my bank statement, I have deposited adequate money on 5th of Oct'2009, though the EMI has bounced . I do not know the reason for this occurance.

      After that, I got a call from your bank regarding the bouncing of EMI and I requested them to re-deposit the EMI, but they said, 'it is not possible for them to re-deposit the EMI . So your collection agent again has collected a cheque of Rs. 17470/-, drawn on AXIS bank ( chq. No. 107763 dt. 14.10.09) and the cheque has cleared from our account today i.e. 24.10.09.

      Also, I have collected the bank statement of HDFC bank, wherin your EMI comes and I am astonished to find that, Rs. 17470/- again debited from my account. And for this reason, my another cheque has bounced due to insufficient fund. What is this?????? I have suffered for you. When, there is a probition of re-depositing, then why you collect another cheque from me???????

      Anyways, either you refund the amount or adjust the amount as EMI for the month of November, 2009.

      Besides, my address has changed, so any future correspondence, please follow my address, which is mentioned below for your reference.

      loan — Taken the amount of around Rs.30000 and now mobile switched off

      Respected Sir,

      I have seen an add in danik bhaskar classifieds around 2 months ago for taking loan.
      I called the no. they have given me an email address i.e [protected]@gmail.com to send them my scan copy of pan card , marksheet and my bank passbook . They said send us Rs.780 in our bank account number in SBI bank i.e [protected] account holder name Ranjeet Sharma. and said that as soon as you will put this money we will sanction your loan after I deposited that money they said that ok now deposit Rs.5000 more I deposited that amount also and then said ok we will call u in 20 mins and loan will be sanctioned , then after 20mins when I called them they said give us another 20 mins. and said same after every call and then when bank closed down they said ok we will do it tomorow since bank is closed today . Then when I called next day they said ok sir please doposit Rs.7000 more as filling charges and the same procedure repeated itself like this they have asked me for about Rs.30000 . I tried to know the situation of their mobile no. in website traceindia.com in that it said it's a delhi no. and they said me that they are in hyederabad . When I asked him is your office is in delhi , he switched off the phone and now its still switched off . This whole process took about 1 and half month. I have some voice clips of our conversation too which was recorded from my phone. Sir please do something about this .         I applied a loan agaist property with this company, Firstly a exeutive name ravinder kumar take a cheque of amount of rs-2809 and also take 4000 rupees for the purpose of increasing of property value but they could not give me proper status of my application today approximately 50 days has gone but he cannot pick my phone and last time when i visited Ludhiana branch then ravinder kumar and other official and they told me they cannot do my loan when i asked tem to return my whole amount they saidi will not be returned, they also talk with me rudely and using abusive language. please take this matter seriously.         DUE TO SERTAIN RESEON ECS HAS BOUNCED.I GAVE A CHEQUE NO.651590 WHICH IS CLEARED ON 22.08.2009 FROM MY BRANCH (ICICI RAJAPARK).AFTER THAT ECS RS.7334/-HAS CLEARED FROM MY ACCOUNT ON 24.08.2009.IT MEANS YOU HAVE TAKEN MONEY TWO TIME FROM MY ACCOUNT.I REQUEST YOU PLEASE REFUND MY AMOUNT 7334/- AS EARLY AS POSSIBLE.

          Dear Sir,
          I am using HDFC credit card, from last six month, last month(January) i could not able to make my payment on date, due to this reason only, HDFC recovery agent had gave me lotz of threat, they people are using slang word over phone, i am totally shocked for the behaviour of these people towards me.
          know i want to sattlemant.they dont want to sattlemant also for the card,
          Kindly help me, for the same ASAP.

            I got the 2nd hand car from the dealer(penta car, Coimbatore) were it was been fianced from cholamandalam DBS. They sold me the car whose owner was expired and after 110 days they asked me to return the car telling they cant to the name transfer and cant put the endrowsment seal.and promised me to return the Full Payment which i have lost but its almost 5 months but no response so i am going to publsh it in the Newspaper.If i don get a response by 10/12/2008.

              I am Md.Sitarey A/c Holder of Demat and Trading A/c in Cholamadalm BDS Securities Ltd. MY Client Id is 145M08 at Garia hat Branch Kolkata.
              Sir, four Month ago I got SMS in Cell of Debit Balance of Rs.132000 and I called up to my Dealer and asked about the Debit Balance, he said to me my boss has done trading, when called him Brach Manager he was not taken any my call.
              After one day my stock have Square off...

              The aforesaid loan has been taken as on 23rd January, 2008 from Cholamandalam DBS. for a period of 3 years for an EMI of Rs. 6717 to be represented as on 5th Of Every month to be started from March - 2008...Till the date all emis were cleared properly.

              As on 5th October, 2008, one of the emi got bounced inspite of having balance in our account.. For which we called ur customer care call center, which told us that there is no system of representation of emi which we asked for and we were told that an executive will be sent and payment can made to that person. An executive was sent by cholamandalam as on 11th October, 2008 and payment was made to him in Cash vide receipt no. 688438 to Mr. Ashfaq. So my emi for october which was bounced got cleared and no amount was due on behalf of myself.

              As on 21st October, 2008 when i checked my Hsbc bank account no.[protected] from which cholamandalams emi are going through internet banking id - gr8chirag, at 10 AM - IST, there was an entry of representation of emi of rs. 6717 of choalamandalam dbs, and there was a charge of rs. 309.75 from my bank due to insufficient funds...

              When i called customer care toll free no. of cholamandalam on[protected] at 10.20 AM, Indian Standard Time as on 21/10/2008, and talked with executive Miss Bhanu, she told me that there was a technical error from cholamanalam side and due to which the emi has been represented...and they are sorry for the inconvenience caused to me, When i asked for a complaint no. she said there is no system of complaint no. Loan account no. is only complaint no...

              When i asked her, are you going to refund me the cheque bounce charges which has been charged to me due to technical mistake from your side, she said we don't have any such system..we only refund emi, and not charges related thereto and we are again sorry for any inconvenience which has been caused to me.I told her to give call to seniors. My call was transferred to Miss Chitra. Miss chitra also said it is a technical error from Cholamandalam DBs and we are sorry and we won't refund the charges which has been charged by our bank. and We dont have system of giving customer any complaint no. and none of our managers and superiors are going to call you back with regard to the same. Miss chitra gave me a no. [protected] on which call was made from 28440130 but the no.was constant busy.

              (1) There is a mistake in your system...first you say there is no representation of emi. then you represented it.

              (2) You don't have system of giving complaint no. which is generally done and which is a must for all the banks and financial institutions..and such a system is very common..If your organisation thinks such a system should not be there, then rich you won't become but famous you will be surely by your technical expertise,

              (3) Payment has been made, but the system was not upadated...Updating system is your job, not of customers..I don't operate your computers..otherwise i would have done by myself...

              (4) Your both executives accepted that there is a clear technical error in ur system due to which the emi was represented inspite of saying no and inspite of making payment.

              (5) A lot of inconvenience has been caused to me. All banks have sorry as the last word...if there is mistake from our side, then you dont forfeit none of your charges. Late Fees, Penalty, Service Tax. Same rule is applicable to you also.There is a clear deficiency in consumer services as per the consumer protection act prevailing in India. You just cant get away just by saying sorry.

              - Compensation of Rs. 20, 000/- which is calculated on the basis of following

              (1) for inconvenience which has been caused to me due to disnonour of ecs without consent and due to technical mistake in your system.
              (2) Wastage of Time in talking and arguing with 2 of your customer care executives...
              (3) Writing this email and sending it to .
              (4) Mental Harrassment.
              (5) Refund the amount charged to me by HSBC bank.- Rs. 309.75
              (6) Spoiling my bank statement and credit worthiness and bringing down the reputation and goodwill of myself.

              You can directly deposit the money in MY HSBC Account[protected]. See i am so fast... or else we can meet in consumer court and surely in front of media... Your system is so unorganised which others should also know. so that no one comes to take loan from your bank...

              Kindly take down my written request for foreclosure of this loan and refund me the compensation amount.. Your sorry is not enough. If i delay your payment and say sorry then you will accept my sorry only with late fees charges. right...so similar rule is applicable to you.

              I find all your financial managers. very funny. who has made rules and your system of collecting payment and disbursing loan. Lawyers dont get loan, but i was given. from day one you are committing mistake...nothing more..Reply only with money ready and keep sorry for your wife and mother in law.. and be hero in front of them by saying that i am working in bank...not in front of me..

              This is Priya from Visag, ,

              I really want to appreciate you from the bottom of my heart for the above
              complaint you logged..It gave me some hope to fight for my friend regarding
              her personal loan with the same company.

              The funniest part is that I was looking for a customer care number online
              to log a complaint and landed on the same page of the above link you gave,
              which is really useless, but somehow this page opened up and grabbed
              my attention to go through the lines and here I am responding for the same.

              No wonder you managed to take the issue up with so ease as you are a lawyer
              yourself, but think how we, commoners can handle such peoblems, where in
              we don't have any idea how to take it up and whom to take it up with, so we just
              end up losing our money and prestige. I lot of times thought I should go to the
              consumer court for so many issues, but have nobody to guide or help me.
              and the spare time has always been a problem.

              I am posting the link of your complaint to couple of my friends, so it can become
              a JAAGO RE kind of campaign. Please post any such issues if you have tackled
              which can enlighten the public, and let me know if any such organisations where
              we can approach, for help..

              I had applied a LAP loan from your company on dated 12Feb2009. I made severall queries there after to know about the status of my application but no satisfactory response was received today it has been almost 45 days since i applied for this loan still my problem remain the same. Today when i visited Ludhiana branch Mr RAVINDER KUMAR and some other official behaved with me in a very bad manner and used the ABUSIVE language also. When i asked to refund my processing fee amount of rs:2809/. The official these will not be returned Mr RAVINDER have also taken rs:4000/ for the purpose of increasing of property value because he said that my property value is not suitable for this loan. I request you to please look into the matter seriously and refund my all money also clarify the reason for not giving the loan otherwise i will submit a case against your company in CONSUMER COURT.Please revert as soon as possible.

              Dear Sir/Madam,

              With reference to your settlement letter no 9531 dated 19.03.10, I accept this letter on behalf of my mother's loan. As per settlement letter I paid Rs.4500/- vide cheque no. 497900 dt 22.03.10 against recipt no 1663338 dt 22.3.10 as 1st instalment of settlement. This Cheque was cleared from my bank on 27 th March 10.
              But I am surprised to see deduction of Rs.2121/- through ECS from my mother's pention account against the same loan.
              therefore you are requested to pls refund Rs. 2121/- as I am paying the settlement amount as per the settlement letter.

              I am having a personal loan from Cholamandalam, my loan a/c number is xsegsh[protected], i had already received settelment Letter from your site in 4th strok in Amount of 16000/-, i already paid 9000/-of this month, my settelment due in this month and our site balansing Amount is Rs.7000/-, So this time i am not paid of Rs.7000/-, So requested to you please give 15days time (15 Oct 2010) i will paying Full Amount of Rs.7000/-So please understand my problem. Your But the Collection Agents is haunting me, every now and then.
