Sir
I am the resident of the above mentioned society for last 35 yrs, and this society composed of 21 buildings on plot no 18 which were built by Cidco and the flats were alloted to the residents on ownership basis by executing deed of declaration with individual owners by forming apartment ownership association, which were later converted to cooperative hsg society in the 2018 by cancelling this deed of declaration by the consent of majority of the apartment owner
The purpose of this conversion was to undergo these buildings to redevelopment which were declared as dilapidated by NMMC a planning organisation
Sir, CIDCO Town Manager service Mts 1 and Mts 3 has issued an NOC in the year 2017 for the period of 1 year (Copy attached herewith) to the said society for the re development of these buildings with 22 conditions to be fulfilled prior to start of the re development, this NOC is been extended every year till date and the existing term of this NOC will expire in April 2022
Sir, Here i will like to mention that in the recent NOC issued by CIDCO still mentions that the conditions mentioned in the NOC remains unchanged which indicates the conditions are yet to be fulfilled .
Sir, in this respect i have made many communications to the Manager town services which has issued NOC to find out if the conditions are been fulfilled but till today my mails, letters remains unanswered and when met to the concerns it is answered that the dept is not monitoring the conditions laid in the NOC .
Sir it is very surprising to learn that the authority issuing the NOC doesn't take the responsibility of monitoring the conditions mentioned in the NOC
Sir CIDCO being the lessor of this land has its primary duty to see whether the title of this land is cleared before demolishing of the buildings, sir there are many cases where the said flats in the buildings are mortgaged with bank and some financial institutions and the litigations are pending with Hon Bombay High court, Civil court
Sir I have enquired about the fulfillment of the conditions stated in the NOC but no dept nor the officer has addressed my quieres hence atleast I have to approach you with the complaint against the concerns and requesting you to give necessary directions to the concerns to strictly monitor all the conditions laid in the NOC issued for redevelopment and not to permit the further process without fulfilling the said terms
