1. I have taken a loan from CLIX Finance India Private Limited for purchase a CT machine in the month of August 2018. The loan Ref. number was [protected]-001-000 and account number was HNHFSRCEZ00375827. The new Ref. number was[protected] after they changed the name of the company to Clix Capital services Pvt. Ltd.
2. At that time an agreement was made on the date 19.8.2018 between the finance company and me. The loan amount was Rs. 7823622 which was payable in equal installments and installment value was 170495 inclusive of TDS. The total agreement value of repayment was Rs. 10059205 the company divided this amount into 59 installments. Two advance installments were taken in advance on 06.08.2018 even prior to the start of EMI. The finance company sent me a letter of loan agreement with repayment schedule which was to be completed on 29 may 2023.
3. On the date of agreement, the company took postdated cheques for installments till NACH is registered and an advance cheque of Rs.340990/- has also been taken by the company for 2 advance installments.
4. After this I have regularly paid my installments on or before the due date of installment. In the start due to banking Cheques clearing function these installments were paid 1-2 days late but then after I always remit the installments by electronic system on time.
5. In starting of loan payment, my firm was not liable to deduct TDS on interest amount paid to company against the loan and hence no TDS was deducted and deposited by me up to March 2020. I am ready to pay shortfall in TDS amount. Then after I deducted TDS on interest amount as per provision of section 194A of Income Tax Act, 1961 and deposited it to the Government account timely.
6. I have provided all the form no. 16A for TDS deposit by me for the F.Y.2020-21 to F.Y.22-23.
7. In month of January 2022 the company has changed the repayment schedule without my consent and sent me the new repayment schedule which falls illegal to prior agreement. If the company wants to change the repayment schedule then it is moral duty to the company to take my prior consent before the change of repayment schedule.
8. As per the welcome letter and first agreement between me and the company, I have paid all the installments to the company up to June 2023 but the company wants one more ie 60th installment on 2nd July 2023. This exceeds the contract Agreement value of Rs. 10059205 to Rs 10229700 which is a clear violation of the Contract. Till now I have paid a total of 59 installments and the entire amount on time.
9. The company also reported some overdue in CIBIL from January 2023. The company tried to present NACH o[censored]ndefined amount on 21 dec 2022 without any prior information and it was failed. I asked the company in an email why NACH was deducted other than EMI date, they informed that it was due to TDS difference. (Your TDS amount is pending of Rs 13070, which is due to decreased TDS rate from 10% to 7%). There was no prior information regarding the TDS difference amount and without informing the customer deduction other than EMI is illegal.
10. Although the contract clearly states a fixed EMI and fixed schedule with ROI of 11.10% Clix Capital increased the interest rate in the new schedule, which is arbitrary and against the rules of the contract.
11. We requested multiple times by email, Phone calls to escalation team and Higher authority officers of company but they all were not able to understand my concern and were very late in replying to my mails.
12. We request you to investigate the matter of fraudulent activity of Clix capital Pvt. Ltd against me and take strict action against the company.
