Subject - Family Living in peacful possession for last 4 years, robbed & forcefully thrown out by 20-40 unsocial elements in bright daylight on 25th JUNE 2011.

Sir,
With due respect I state that i and my family(husband-wife my son 1yr old , my doughter 9yr old) were living under peaceful possession by the order given by citi civil court at Dindoshi, Goregaon, Mumbai on 18th June, 2011. Copy of stay order is attached with this letter. On 25th June, when I was at my office at Jogeshwari-west mumbai, and my wife was also out for some personal work, around 20-40 unsocial elements under the supervision of Himanshu Khurana and his family knocked the door of my house, 101, A-wing, Sweet Home, Andheri-west, Near Jankaidevi School, Mumbai-400053.

My house-help servant has not opened the door. But they kept on knocking the door and forcefully broke the house door and entered forcefully. At that time one house-help servants and two kids, one daughter 10yrs old and one son 16 months old were inside.

Two persons from unsocial element forcefully took my children into one of my bedroom, beaten them and locked them from outside. Rest all o[censored]nsocial elements along with Himashu Khurana, Yula Khurana, Harina, Rita Pandey, Rupa suddenly started robbing my house articles like sofa-set, fridge, LCD TV, Microwave, Washing Machine, Clothes, Wardrobe, Cash, Jewellery, etc one by one to the 2 tempo's standing near the building. In the mean time my wife Punita sharma came to the building and saw his house articles were moving into the Tempo. She rushed to the house immediately and try to stop the people to rob her belongings outside the house. But these unsocial elements started beating her up. By some how she manage to enter her house and try to stop Himanshu Khurana and his company not to rob her articles from her house. Himashu Khurana, Yula Khurana, Harina, Rita Pandey, Rupa were did not listen to her and started beating her and stopping her to not interfere to moving articles out of the house. Himashu khurana did some unsocial things with Anjali by touching her private body parts under her cloths.

The FIR regarding this incident is registered at Versova police station under 'FIR Number 276/11'. the copy of this FIR is attached with this letter.

In the mean time I manage to come to my house and called police by calling 100. I tried to stop the Tempo to move my articles from the bldg, by blocking the way of tempo by putting my vehicle MH04DJ 9385 in front of the tempo. In the mean time I kept on calling '100' for help and updating them what is happening at my house. My wife was screaming, my children’s were crying but nobody had come to help us. When tempo driver thought there is no way to escape to move tempo along with robbed articles, they started moving backward. In the meant time they saw police has arrived they started unloading articles of the house near my building. At that when Himanshu realized that police arrived, they forcefully thrown my wife and my children’s, taking help o[censored]nsocial elements outside my house. In the mean time Himanshu manage her wife Yula Khurana and his mother Neelam Khurana to enter into my house and told them to lock the door from inside. All unsocial elements disappeared one by one after police came into picture.

My wife and myself knocked our door but Yula and Neelam inside our house doesn’t opened the door. While doing this act Himashu Khurana, Harina, Rita Pandey, Rupa, himashu's brother manhandled with us and tried to push us outside the lobby of my house. When police came to my house we narrated this incident to them and ask for
help to get our house opened. But we were shocked to know when police told us 'This is not our job'. We kept pleading them to get our house open but our efforts gone waste. In the mean time our robbed articles unloaded from the tempo near our building were looted and taken away by unsocial elements which were companied by Himanshu khurana while he break into our house. All this incident was happen in front of eye witness of versova police, but the police was fully manage by Himanshu khurana and his company.

After this incident I went to versova police station and met with senior police inspector Mr. Borse. And requested him to please let me go into my house and report FIR of theft, robbery at my house. But again I was shocked by his answer when he told me, "Its a civil matter and we cant do anything. You have to approach court and bring the order to open the door and to get into the house". I request Mr. Borse 'sir, atleast please take an FIR of this incident'. Then I showed him the stay order of citi-civil court generated on 18th June, 2011. And reminded Mr.Borse that 'its a duty of police to protect their citizen, so please help me'.

After seeing this order he instructed his Junior to take my FIR. My FIR was totally managed by Mr. Borse as only 4 sections were introduce in my FIR at that time.The sections were 452, 323, 427, 34. And complaint was registered only against 3 people, Himanshu Khurana, Yula Khurana and Neelam Khurana.

At that I came to know that Versova police is helping the criminals and my efforts will end up with frustration only.

From 25th June, me and my family are staying in the lobby of my flat in front of main door. And 2 police men are appointed by Mr. Borse to make sure that we dont try to get into our.

On the same day of incidence I approached my advocate Mr. Ashok Sarogi for help. We are in legal proceeding to get into our house from the same day (25th June). On 27th June, we took this matter in front of citi civil court, Dindoshi and requested them to call Himanshu Khurana and his company to come and sort out this matter. On 29th June, Himanshu Khurana came into the court. My advocate Ashok Sarogi requested to appoint a court commissioner to see the possetion and list of auricles which are lying inside the premises.

Honorable Judge R. B. Hange has appointed court commissioner and told to submit the report on Monday 4th July, 2011. On 1st July, me and my wife luckily manage to opened the door of our house with the help of house key and tried to went into house to see our belongings inside the house, we were again attacked by Himashu khurana, Yula Khurana along with 4 society members accompanied by 4-5 unsocial elements inside our house. They beaten me and my wife with hokey sticks, steel rods and some unidentified objects, first inside my house and then they have thrown me and my wife out of my flat again. And again beaten us in the corridor of our house. Himanshu khurana's unsocial elements stood in front of our flat gate and prevented us to move into our house. In the mean time Himanshu and his family again manage to put some family members in our flat. This incidence took place around 11am in the morning. Arount 12.15 noon citi civil court commissioner came to visit the site along with police to check the current status of our flat. Himanshu khurana and his family members managed to have citi civil court commissioner proceedings in peace. The commissioner told me to come along with her to see the flat articles in front of me, when we went inside i was shocked to see most of my article were removed by Himanshu khuran and his family members. But still they are so many unmovable articles of mine were lying inside the flat. Court commissioner had noted all those articles in my presence. Court commissioner did her job and left but still 2 ladies are inside my house.

After this we approached, Additional Police Commissioner Mr.Nagre at bandra-west. He was shocked to know that versova police is helping the criminals. He immediately ordered senior police inspector Mr. Borse to take the FIR of mine and add section 395 to first FIR made on 25th June. The new FIR 'No. 281' got registered (The copy of this FIR is attached with this letter). And section 395 got added to FIR 'No.276'.

After this incidence when police approached to arrest Himnshu and his family, Himanshu used his political contact of rullling party and managed to stop the arrest.

Now we are having very bad impression that police is finding themselves helpless in arresting the culprit of this robbery under the influence of political contact. Now we are feeling very scared to live in a financial ciy of Mumbai.

Himanshu khurana and his family members dont have the keys of my flat but still they are managing themselves to be inside my house, police is still showing helplesness to move them out from our house. We are also feeling very helpless in the financial city of mumbai where 20-40 unsocial elements barged into in house and tried to disturb the possesion of family by robbing their articles, beating them, throwing them in a day light. And police is not doing anything in this regard. All our movable electronics goods are missing / robbed from my house. Police had taken down the complaint but no arrest had done till date. Himanshu khurana and his family has managed mumbai versova police, unsocial elements to do this robbery in my house. These people has taken my human rights to live peacefully.

Please look into this matter and provide justice to me and my family.
