submitted complaint on 15th July 2009 against a Co-op Hsg. Society for various irregularities committed by them, including not filing bond under Form M-20. The dy.registrar is yet to act upon it.

Dear sir, Our Society is having more than 15 members . Till date since 2006 the society was formed there was no proper election conducted, no proper formalities followed. some time AGM conducted without proper quorum & short intimation & some people were selected as office bearers with out verifying the qualification etc.
our society Chairman will be capture society land without taken any permission. he is misuse out chairman rights.

kinldy advise where will go.

Please let me know as I have purchased new flat in Agarwal Hill view at Vasai (E) and the builder is not building Soc.Office, SEcurity Cabin and is telling to take charge of the society could you pls suggest what should be done please.

I am member of mangrove ho. so.beach complex naigaon west, they stop my water since 3 days, there is little dispute about taris repair fund, I am paying water charges every month, now there is no sceretory in society & there is no watchman sir, stop the water is an offence, so please help me to sovle this matter

How to make this system in proper way. To whom should contact for this.
Due to above we have not got the conveyance, water connections.

Our Society has 52 flats and 20 shops. The building is 25 years old. Till date since the society has been formed, no AGM has been held. For more than 5 years we have office bearers, not elected through a ballot. There are irregularities in the Accounts, building repair work approved without proper procedure following. Shoddy work done, building in a bad shape. Secretary, Chairman and treasurer not providing accounts. If anything is asked, the Secretary and Treasurer start fighting. Last meeting held in July, where it was inconclusive. Next meet was to be held in August with the accounts to be placed on the table. Till date no meeting held. Notice for meeting is passed one or two days before the meeting.
Some of the office bearers use force and abuses when matters are brought to their notice.
Please guide us in helping us to run the society properly. We have not got our deed of conveyance.

I am facing the Leakage problem from last four years because
of top floor owner and he is not ready to do the leakage work. Even society
also sent the letter to top floor person but he reply to society you can take
the legal action.

Also those same people do the plantation in his terrace area (big
big tree in dram).

Subject: Illegitimate Appointment of Provisional Managing Committee by Chief Promoter of Regal Heights (ABCD) Co. Op. HSG Society Registered As TNA/VSI/HSG/TC/27821/2015 situated at Vasant Nagar, Near Vasant Nagari Ground, Sector-8, Vasai Road – East, Palghar, MH ("said Society").

Dear Sir,

We wish to inform you that myself i am resident of said Society and owner of flat no. 303, wing D. Our builder "M/s Suvidha Enterprises" a Partnership firm, being chief promoter of said Society has called First Constituted General Body Meeting on 27th September 2015 ("said GM") under prior notice of 14 (Fourteen) days for appointment of Provisional Managing Committee (“PMC”) and other proceedings enumerated under said notice. Further to inform you that during said PMC the chief Promoter has constituted the said PMC by violating following principals of laws and natural justice:

1. For said PMC you have appointed Advocate Kirit Sanghvi (as verbally informed by said Chief Promoter) as your authorized representative to conduct the all formalities as enumerated in said notice, however to be noted that he has nor shared any of his authorization letter or order passed by you or any of his identity proof to relay upon such authorization.

2. Further to note that during the entire proceedings of said GM, he has not said anything about the proceedings and his behavior was totally biased and he has supported the activities conducted by Chief Promoters like anything. Pursuant to By-laws, he should be the dispassionate person and conduct the proceedings at its own, without any interference of Chief Promoter, but he has not at all participated in any of the proceedings and only sitting there as representative of Chief Promoter and noted whatever they instructed.

3. On perusal of aforesaid totally prejudiced behavior of your authorized representative one of said Socieity member has started taking video of such proceedings to present in front of you as evidence. But regret to say that he along with Chief Promoters and other appointed PMC members has started abusive language and forced that member to delete such video. During such instance, I have along with other present members of said Society has raised their strong objection, but your authorized representative has ignored our objections and supported such unconstitutional activities. The Chief Promoter said that it’s their prerogative to refrain any member to take such videography of said GM proceedings.

4. During said PMC Mr. Vilas More, resident of flat no. 502, wing-A has been nominated as President of said PMC, but regret to say that he has not actively participated in said PMC.

5. To defeat the right, interest of each and every resident of said Society and to give benefit to few so called nearest and dearest members, the Chief Promoter has constituted said PMC, which is against law of natural justice and society by laws. The Chief Promoter has not appointed the members in said PMC, who has more experienced and ability to take possession of said Society and conduct day to day affairs of said Society.

6. This is to be noted that said Chief Promoter has shown prepared list of said PMC and ignored the objections of present members and appointed already selected members by instructing your authorized representative. The Chief Promoter said that said list was already been approved by the said Society members, which is totally baseless and null and void under eye of law. This is pertinent to inform you that certain members of said Society has submitted their list (including myself) to nominate as member of said PMC, but the Chief Promoter has deliberately ignored that and even after our request he has refused to take that list into consideration.

7. According to bye laws, the quorum of said society members was also not enough to conduct such proceeding under said Notice and appoint said PMC. Also to be noted that after completion of said GM, the Chief Promoter has called person in his office and taken their signatures on attendance register, which is not legal under eye of law.

8. After completion of said GM, I have tried by best at several instances to submit my objection in hand written form, but the President of said GM and Chief Promoter has straight away denied acknowledging that. My hand written complaint is also attached herewith for your perusal, whereas other present members of said Society has signed as witness of such biased proceedings.

In view of above facts, it’s established that appointment of said PMC is illegal, arbitrary and request you to give your guidelines and instruct the Chief Promoter to serve appropriate notice and appoint new PMC in front of you or any of your unprejudiced representative and under the surveillance of videography.

I am believe and Indian constitution and laws and sure to get proper justice from you. Further request you to consider my complaint and passed your orders and also release instructions accordingly within 15 (Fifteen) days from receipt of said complaint.

Looking forward your appropriate action and in absence of any response from your end, I will approach upper authorities to get justice.

Sub: Lawrence Smruti Society – Grievances 07/10/2015.

Respected Sir,

I am residing in the Lawrence Smruti society situated at Naigaon (west) Vijay Park.

I am writing this letter to bring to your kind attention that the Chairman and Treasurer of the Society are harassing me as is evident from the following:

I had asked the Society to furnish me documents such as,
• Copy of the approved building plan will all the subsequent amendments, if any, approved till today. (Original Blue copy & building plan)
• Copies of the request letters for permission received from the members in last ten years and copies of the permissions granted accordingly.
• Copies of the minutes of Annual General Body Meeting’s and Special General Body Meeting’s in last 7 years.
• Architect Certificate
• Audit Report /Balance Sheet / Profit & Loss Account for last 3 years
• Despite giving sufficient time and also reminding them there in no response from them and till date I have not been given the documents.

I had given in writing requested them to give me permission to install Water Tank on the terrace. Such a permission has been given to other 6 members. However, I am being denied for the same. This matter is pending for last 1 month. Consequently, I am facing great inconvenience as regards water since I am not allowed to store the same. This is a day to day and pressing problem.
(Pl refer Anx – 2).

I am not been given Monthly Maintenance Bill regularly, in-spite of my reminding them to do so. In fact I am now being given Bill for September 2015 without giving me bills for July / August 2015. In September 2015 bill, the Society has charged me Rs. 200/- towards sub letting when this is not the correct position. I also apprehend that I may be charged sub-letting charges for earlier months of July / August 2015 when the bills are given. (Pl Refer Anx – 3)

Earlier, I have submitted the share certificate with Bassein Bank letter for change of my name with exiting owner. Till date I have not received Share certificate Or not send any communication to Bassein bank. I have already written communication with society & cc copy to you but till date I have no response from the him (Pl Refer Anx – 4)

I would like to request your intervention in resolving my issues. Please do the needful at an early date and oblige.

Dear sir I am staying In om Samruddhi chs . nallasopara this society is last 25 yes old. Society's management is so worst because they always take wrong decision. Recently they sold society open space to who people staying in ground floor in rs 5000. Without making legallegal document. sir we have already registered compliant at department on 21/09/2018 but still yet no action is being taken against society having name Shiv kutir co-op hsg society limited having reg no tna/vsi/hsg/tc/4053/1991-92 and all supporting documents attached with that complaint letter, so i am waiting from your reply when action will be taken against society

An application regarding suspected misappropriation of of Shivathan CHS Virar- West funds was made to your office and subsequently a request for reaudit was made. An order to this effect was issued on 09th-10-18 thereby appointing Auditor Mrs Smita Hemant Ahiyre .
The said auditor visited Society office on 18-2-19 and directed us to pay the requisite fee which was paid on 22nd-2-19 in state Bank as directed and informed to the concerned officer. Reciept enclosed. The auditor was provided all the required documents for inspection during her visit to the society only on two occasions. Thereafter no communication from her end

1) My question is - why delay of almost nine months from the date of my application in appointment of auditor and execution of work.
2) Why no communication from the auditor’s end till date
3) When will the job of reaudit start and how much time will it take to complete the work.
