Respected Sir,
I am Mr. Swapnil Mayekar residing at B/705 Ichhapurti Sai Prestige Chs, Taki Virar Road, Near Datta Mandir, Nalasopara(E).
I would like to draw your attention which we are facing. We are facing low quality of construction issues
like (Beam crack, Ceiling Leakage, Chamber Chock-up etc.)in building also illigal construction which is happned inside building.
in all this issue we complaint to the society...

Society transfer charges: exceeding 2.5% of difference between book value and realised value

Good day
Requesting your help and support with the society transfer charges of 25000 compared to the 2.5 percent charge. As you are aware the byelaw states that transfer fee to be charged is transfer charges at 2.5% of the difference between the book value of the flat and the price realised by the transferor on the transfer of the flat which in my case is 11, 789. But the society is charging us 25000 irrespective of the difference.
please find below explanation:
As per 3rd party auditors & as authorised by the bank, the current GOVERNMENT rate falls @ 4153/ sq ft. (note: also verified by the registering authority)
Hence the total book value is : 970 Sq ft (as per agreement) x 4153 = 40, 28, 410 INR.
Agreement value paid to seller is 4500000/-
Difference between book value vs the price realised is (as per byelaw) : 4, 71, 590 (2.5 % society charge) hence the current society charges I presume should be 11, 789.75 /-
Appreciate your help and understanding in regard.
kindly advise if i have misinterpreted the bye law as per books.

This is inform and place record that, as aforesaid, i had made several diligent efforts went in vain, i through this gist, i would like to place record that, i had submitted letter dated 11/03/2017 & 08/04/2018, through these letter, i had mentioned my grievances regarding structural damages occurred due to repair work carried on in the year 2007-08 by the society’s committee members. The concrete columns of my flat damaged due to usage of jackhammers for 8days on terrace for laying tile chips in the year 2009-10 to stop terrace leakage but our wing b-02 terrace had no leakage at all, than the gallery of flat no. A/309 collapse in the year 2014 and committee members repaired it by using society’s fund through collected from every society members by force it is pertinent to note that, by using jackhammers damaged has been caused to the columns & beam of my flat and flat no. A-309 due to heavy vibrations through any aforesaid letters, i had requested committee members to repair it as the society is insured by the insurance company but till today no any action has been taken.
Again in this present year committee have estimated for rs.30lakhs for building repairs, and has been passed in absent of society secretary and chairman, chairman has been given resignation before agm, it is on record that committee members have not issued any
“indemnity bond” as per prosecution of bye laws. Now i would like to humble request you to endorse instructions to committee members to repair columns & beam of my flat at the cost of society’s fund in this regard, again i have requested to order investigation about collapse the a-209 gallery, misuse of society fund and violation of bye laws, i have attached structural report in which it is crystal clear that there is damage to the columns, beam and now slabs.
Hope for kind consideration and needful at the earliest.

Builder refuses to come for registration

Sir, I have purchased flat in NALLA SOPARA (w) in 1988 I have paid the Builder
full amount by one cheque, I have paid my stamp duty, but the builder is not coming for registration in spite of repeated request. Can i get the registration done as single party and pay again stamp duty and registration charges.
All other documents since 1988 are in my name ie Ghar patti, society out going, electricity bill since 1988 are in my name amount paid till date.
The builder is my wife cousin, the land had belong to my father in law, he is harrasing me because of their family dispute.

our building Attar co-operative housing society, M.B.Estate, Virar (w) is planning to go for re-development but the managing committee is not going through proper channel and misruling the society and want to go with their favourite builder with no additional benefit to the society and its members. please look into the matter and guide us with the proper guidelines to be followed....
