Eicher Motors Limited / Royal Enfield — New bike totally unsatisfactory

I paid an advance of Rs 1000/- in November 2010 at the Bandra showroom and was informed that I would get the allotment after 3 months. On 8th Feb I paid an amount of Rs 1,13,961/- I eventually got my bike on 3rd March, 2011. After a waiting period of 4 months I got my long awaited bike which I was so eager to have as i had heard so much. Prior to this bike I had 6(SIX) other bikes. Assuming this would be great I purchased the ROYAL enfield.

Right from day one it has giving me starting problems. I have to kickstart for 10/15 mins after opening the choke. It starts and then stops again. This happens around 2/3 times. I even hurt my knees as the kickstart gave way as there was no resistance in the kick. Thus damaging my knees for which I had to take antibiotics for 5 days. I was informed to go to Malik Service Centre which is at Kurla East for my first service. Went for the first service on 12th April, 2011. I told him the problems I am facing with the bike but his action was to change the oil and the filter. And he charged me Rs 870/- without giving me a bill and did nothing to improve the performance of the bike. He further stated that there was a kick paul problem and he would get the the part from the company in a day or two and call me back. But has not done so.

On 15th April, 2011 I went to the showroom at Bandra (from where I purchased the bike) and they directed me to the service Spark Motion at Grant Road. They said they will call once the locate the fault (problem) I am still waiting for their response.

This bike seemed to have not been checked for quality or I have been given a SECOND hand??? I DREAD TO RIDE THE BIKE ...this was to be the bike of my dreams. I WANT a replacement or want my money back. I wish to sue this company. Please advice how I can go about this.
