[Resolved]  GM Property Developers and Builders, Bangalore — Non Completion of Building Work

I had booked a flat in 2006, in a semi finished contrction work. At that time the builder had promised to handover the flat in six months. I paid the total cost of the flat. In October2007 i occupied the flat after completing the interior work. I was not been given a possession and occupancy certificate. Till today the documents like VAT and Service Tax receipt proof of remittance to Govt.Dept has not been provided. They have collected huge amount for the same. They have not provided with BWSSB connection to the entire building. Poor quality of material used in construction of building. There is leakage in the rooms, because of which my interor got damaged.. They have also collected Maintenace Deposit but building are not maintained.
Original sanctioned plan was slit+GF+3 floor, but now two flats on the terrace roof has been constructed.
Khata transfer has not been completed. Painting for the building not completed till today. With great difficulty i was able to get my flat registered. Now builder is not responding to the calls for documents and work completion.
Should we all the flat owner approach the consumer court for the above failure.
Request everybody not to buy or deal with GM Property Developers for purchasing a flat or property.

Hi All,

GM Infiniti E city has launched the 2nd phase and I am interested in booking a 3bhk Apt there. However, they do not have the BDA approval yet & the their office assures of getting it by June. They are also asking to pay 20% after 15 days from booking date.

I visited the site and figured that the phase 1 construction is off to a good start. Anyone here booking in 2nd phase.

If anyone has booked yet can you please help me with your experience and things to watch out for.

I have booked a flat in e-city phase 2, I paid 1 Lac as booking amount and They are asking 20% to be paind with in 15 days of time, They say they will only provide a MOU which an agreement between us... They say they will get teh approval of second phase in june -2014.

I asked for the submitted plan for approval, they told they have not yet submitted...

Can anyone help me out as to what are the document which I can check even if they have not applied for BDA approval??
Has anyone booked in Ph2, I visited the site in electronic city, but builder is asking 20% upfront, when I asked how come taking this upfront without the approval, he told me that we need money for approvals, can somebody guide here ... .is this a safe investment? appreciate if you can reply ... right now the going price quoted is 2950 ...

Everyone. I am also interested in the phase 2 of this project and wish i could talk to someone who has recently booked the flat. Yes they are to get the BDA approval in the month of July - Aug 2014 as per the marketing guy.
Can anyone please let me know the carpet area they are offering, as far as i know its 74% which less as compared to other builders.

I have very recently booked a flat in Phase 2. Last Sunday(20th April) actually at 2950 per sqft. I was told that Phase 1 has been approved by BDA. The bank approvals are there as mentioned by other users on this thread but they did not go for SBI approval for Phase 2.

Phase 2 is supposed to be approved by August - I would need those documents to apply for loan. They also told me that a MOU will be provided which would state that all the money would be returned in case they fail to get the approval. I did visit the site and the P1 construction seems to be going ahead.

I am glad that this thread exists as this is my first time buying a house. Few things that I am not clear about are-

1. When will the agreement be done? (Paper work that includes the names of occupants as owners.)
2. The registration happens after the handover right? (How do you go about it, whats the process?)

Would be great if someone could share the knowledge.

I have also booked flat in phase-2. have anybody going thru paper verification so far before deposit 20%? land owner, registration# etc.
all paper is ok, land is ok??

and they are still waiting for BDA approval. so as per marketing guys..once BDA get then they will go for agreement and loan process.

Beware of GM Infinite any project as they will put a clause in their agreement that if you want to cancel the booking or ask for refund then they will eat your entire money, on other way you are forced to buy once you have done the booking. Read the clause below:
Clause in Sale Agreement
If any breach continues for more than 2 months or any breach not being rectified within a period of 2 months, for whatsoever reasons, the vendor/developer at its discretion/option will be entitled to terminate this agreement and treat a sum equivalent to 20% of the entire sale consideration as forfeited and adjust it as liquidated damages from and out of the money paid by the purchaser/s and the vendor/developer will be entitled to deal with the schedule “B” undivided share, including selling the same to Third Party, without any further reference to the purchaser/s. The balance money, if any, due to the purchaser/s shall be paid within four weeks of the disposal of the schedule “B” property. Against the cancellation of this agreement by the vendor/developer, the purchaser/s rights under the Construction agreement executed on the same date shall stand terminated without any requirement of execution of any further documents.

Did anyone have information weather GM infinite have got the BDA Approval for phase II ? As they ready with sales agreement paper. and they are charging Rs 2090/- for it.
