[Resolved]  HIRCO - Hiranandani Palace Garden Chennai — Taken money and HIRCO does not provide any details on building start or possible handover dates.

I invested in this development several years back & this was to be my retirement place. But I truly don't see myself getting there for the next 7 to 10 years if at all, with the delays due to land acquisition, approvals, funding, etc.

And I also think we are @ their mercy now that we have invested our money into this pit (pun intended). Is there someone here who can offer credible legal advise to seek a redressal?

The other day I say the senior Hiranandani appearing on NDTV and saying all old investors will be offered suitable properties.
But now a new outfit called "EVITA constructions" are offering new plots/flats at meagre discount to the estranged / cheated buyers. Their agent is HRREALTY. The terms are even more dangerous. They will adjust the past payment for Hirandani parks only at the time of new purchase registration!!! Till then you pump in fresh investments so that their coffers are full.

I too received a mail from EVITA construction that suggest the option for further investment either to other buildings or Plot being developed and customer need to make the balance payment after adjusting the booking advance. It seems the company not satisfied yet with the corpus they have collected and holding for no reasons.

Even am a victim of this scam.

I had booked a flat in Modena 1BHK in Palace garden, Oragadam, during August 2011.

We have paid an advance of 20% of the total cost and we were assured that the project would start in the same year by December.

Till now nothing happened and when contacted they offered illogical offer to invest further into them with a bigger apartment or a highly priced plot.

Is there any better way to get the money back. Has anyone already proceeded further legally.

This is harassment of the highest order. My sister is also a victim of this. I request all of you to get together and file a lawsuit. This is a large amount of money you have given them. Your hard earned money. Waiting indefinitely expecting something is not going to help. Please act as soon as possible.

Even we have been affected.
Initial booking for Modena -1 (1bhk) in 2010 after paying a booking amount of 20% .
Now, being approached by Evita Constructions, claiming to be a subsidiary of Hiranandani to either move to an existing flat or buy a plot ( priced at 2200/sqft ) while after checking up am told that all plots outside the township are lesser priced ( dtcp approved)!!!
Informed Mr Swaminathan and Tarun Mukherjee but, of no use. They only try convincing you and vehemently say that there is no exit option and in fact, said "you may win the case but who will pay you as hirco is bankrupt and bank will not refund this large amount " when I mentioned taking it up legally!!

We want to exit and not sink in more money into this project. Please include me when the forum decides to take it up legally, which I think would help. Is there anyone amongst us from the legal fraternity or related to someone who can at least file a case collectively. Am sure it is a long drawn process but do not mind waiting if we are to get back money with interest later.

Evita Construction have now sent demand for final payment for Wilton II apartments in Chennai with a view to handing these over. Has anyone else received this and are the apartments really ready?

Hello All, have also booked a flat like many of here and have put down 20% with no progress or no hope of realistically recovering my payments until I got an e-mail from the Bombay High Court regarding the liquidation of Palace Gardens Chennai SEZ Pvt Ltd.? It appears that they have sent me a letter top my old address which I never got, but the Official Liquidator (I cross-checked the name and this letter seems legitimate) sent an e-mail based on the information the court has received from the "ex-Director" of the company. The high court letter said they have received only 3 claims from "creditors", and called me a creditor, and asked to submit proof of debt. If anyone else received a similar letter/e-mail I would very much appreciate learning about that.

Hi friends, I am victim too, we had made several visits to Hiranandani HO, but of no use. Our money is locked with them. We ended up with this so called sub vention scheme with HDFC and paid the full amount for our apartment (Hirco). They are yet to hand over the apartment to us. Its been 10 long years and we have lost all hope.

Please include us if any plans to protest against this issue.

I had booked an apartment in 2008 Longleat building which never was n build the reason given on phone was there will be a sweage area in that place. No formal email or letter has been send. It has been 10 years now.

We have been trying to chase them from Chennai to Mumbai HQ but no results. I am looking a way forward how to get my money back which is a huge amount.
