[Resolved]  jain housing chennai — Delay in inseli park project

Hi,

I have booked a flat thru ADF (advance disbursement facility) where I paid 8.75 lacs as booking amount and took remaining 40 lacs thru loan and disbursed full payment even before the construction is complete. Jains promise was to pay the EMI for this loan till 2009 end or project completion whichever is earlier. They also promised to complete the project by 2009 end. But now its getting delayed for another 2 years and only in 2011 mid or end this will get completed. I was asking for a cancellation from 2008 june and was willing to repay the EMI paid by Jains from Apr to Jun and asked them to return the remaining booking amount. But they delayed this and had numerous discussions and excuses and by Dec 2009 after enjoying all my money and still by Dec 2009, only few floors were complete in block G, they finally recovered all my booking amount and cancellated my flat, repaid the loan amount. Now I lost 9 lacs in this process. Without completing the project or when asked to recover EMI for a few months, they were totally unethical, impractical, disloyal and totally money oriented.

We enquired the details of Inseli park-3 bedroom flat-While enquiry with the marketing executive at site and GM/Marketing before realisation of token advance both of them had accepted for certain additional works at the cost of the client. We trusted and paid the token advance, but immediately the next day both of these people have cheated us by negative reply. This is the pathetic situation of jain housing executives- i do not know why they are behaving in such an unethical manner.
Once you sign the Agreement - You have to follow the Jain Housing ONE SIDED Rules.

Here you go
1. Power Of Attorney Holder will Sign the Document - Please get the Live Certificate for one who gave POA as per Supreme Court Judgment

2. If you paid the advance Rs.50, 000/= No Issue please try to get back otherwise leave as it is. If you are lucky dont Proceed further.

3. The Payment Clause should be adhered strictly to enable the Party of the First part to go ahead with and Complete the construction of the building in time without any stagnation. INTEREST AT THE RATE OF 18% per annum shall be charged for all the delayed payment. if payment is not received within 10days from the date of intimation. The party of the First part will have the first charge or LIEN on the said flat/premises on all balance due by the party of the Second part until they are paid. > They will send the notice on Friday or Saturday. If you delay one day then they will charge 18%

4. If the Construction material prices or Labor costs increased by more than 10% during the period of construction as per No 1(a) herein, the said difference shall be borne by the Party of the Second Part(Customer) > For Threatening the Customer - Though Its not valid as per the Consumer Law.

5. The party of the first part (Jain Housing) also agrees to compensate the party of the second part(Buyer) at the rate of Rs.6.50 per square feet per month in case of any delay in construction beyond the above stipulated period the party of the second part makes the stage payments without any default. > if you delay the payment even one day you are not entitled to claim the same
6. The party of the First Part shall not incur any liability, if they are unable to deliver the possession of the said schedule "C" mentioned property by the date aforesaid, if the completion of the building is delayed to due circumstances beyond their control, such as non-availability of steel and or any other building materials or by reason of war, civil, commotion, riots, epidemics, acts of God or if non delivery of possession is the result of any order, Rule, Notification of any court of Law or Government Agency and or any other public or Competent Authority or in the event of any revocation of permit by the Competent Authority of if the party of the First Part is unable to deliver the possession due to circumstances which make the performance of the contract is impossible. > if any delay then they will say Steel is non available etc.

7. The party of the First Part will not liable for any delay in Corporation, TNEB giving the connections in respect of Water drainage and Electricity in spite of the initiatives/follow-up actions taken by the party of the first part. . No Accountability - Always they say we approached but it got delayed

8. The possession of the flat will be handed over to the party of the second part only after ten days from the date of receiving last/final payment from the party of the second part against the party of the second part signing the concerned taking over letter WITHOUT IMPOSSING any CONDITIONS. . Either Take Possession with Problem or Don’t take Possession. We are at the receiving end, so no other Choice?

9. The party of the First Part/Promoter shall provide the recreational facilities such as Health Club and Gymnasium at their own cost. The PROMOTER WILL ABSOLUTE OWNER of the same or under their SUPERVISION HAVING FULL CONTROL and AUTHORITY. The decision of the promoter shall be final and binding in maintaining such recreational facilities. The purchaser shall automatically become member of all the recreational facilities provided in the building complex. The purchaser/Customer shall pay the maintenance charges and recurring EXPENSES for using such recreational facilities as may be fixed by the PROMOTER from TIME to TIME. - ADDITIONAL INCOME FOR JAINS - REGULAR EXPENSESS FOR CUSTOMER. As per the CMDA Rules / Law Promoter should not hold anything inside the premises

10. The party of the First Part can use the Terrace Area in the Building Complex only to erect holdings, publicity boards and display advertisement for their own purpose in such area without any claim from the Purchaser, or their Association who hereby consents and has no objection from the same. - As per the CMDA Rules and Law Promoter should not hold any rights on the Terrace.
I have booked a flat in Pebble Brook Phase 1. There is inordinate delay in handing over the flat. The customer service is most irresponsible and they do not reply to emails.
I think the people who have talked good about Jain Housing must be definitely either close associates of Jains or its employees who have been compelled to provide good feedback about Jain housing. Do any of these men bought a flat at their pallavaram project? do they know what fights went on there and how many had heartburns fighting with Jain Housing? Do any of these guys having a booking in Jains Inseli Park @ OMR, which has taken 8+ precious years and still not delivered. Can any of these guys imagine its 10% of anybody's life time or even more the customers have to wait to get this project completed and get the handover? Can they imagine the financial loss that anyone who booked flats must be incurring? can they think of the fate of any retired people or people in the verge of retiring from their jobs who have invested here with the hope of getting a flat in 2 year which has ultimately taken more then 400% of time over run and more than this the cost over run? Will Jain housing has any ethics in compensating for it?? Gentlemen please think how unethical this company could be not just to use the money rotating from one project after another but not delivering any of the projects on time. ITS TO ANYONE'S IMAGINATION OR DECISION TO THINK IF YOU NEED TO BE ASSOCIATED WITH SUCH AN UNETHICAL BUILDER?
Two Major issues in Jain Inseli are listed below.
1. No STP in Jain Inseli park and associations has to bare the cost of setting it up completely. It's shame from Jain housing.
2. We have to pay the 3 years maintenance upfront, but this excludes Diesel cost for the back up power.

Other issues
1. There is no AC drain water provision, which leads to water spills over the entire building and spoil the external painting and plasters which looks ugly in another year. Even small builders having this provision nowadays. It's shame from Jain housing.
2. Customer has to bare the swimming pool water changes.
3. The advertisement says Jain Inseli park is "Grandeur" but if you see the finishing it is not even close to normal quality which small builder used to provide nowadays.
4. I heard that current external coating is going to be the final which is not upto the minimum standards. Jain has to compare the external painting nearby projects like Purvankara, XS-Real, TVH, Ruby builders etc.
5. All blocks are not having same fixtures and design. A block has the maximum benefits (Eg: in lobby steps - Glass siding in the hand railing). If you see the B, E & F blocks it has not having full outer ring which used to project the block in cylindrical. E is awkward look has only one wing and I am sure it has design flaw.

Why I am listing all these issues, please don't buy from Jainhousing. If they keep the customers happy, they can sell the apartment very quickly. Now they lost the branding and they doesn't know how to do a business, I am sure that Jain inseli is going to have almost 40% unsold apartments for another 5 years and you can think of the state of the building by that time.

Please mail me, I will tell other problems with Marketing team and great customer support. They never been prompt and never pick up or call us except for payments.
They started handing over keys ( incomplete state though), hence you would be seeing lot of complains in near future.

With this I am concluding, Jainhousing will be out of business very soon.

Never go for these builders. I’m living in one of their project for the past one year,
Jain Sunderbans located in Nolambur.
You don’t even have the freedom to choose your broadband, landline and tv operators.
You are forced to choose the services for which they give permissions. They won’t allow other operators inside the premises.
Who are they to decide my operators.
The maintenance after sales is worst, the committee is just for sake.
