[Resolved]  Lodha Casabella — Scraping the flat after registration.

Dear friends,
I have booked my flat at CASABELLA D-602 on August 2009 and registered on Dec 2010 at DOMBIVALI registrar office. I have paid total 7 lacs from my pocket till now. Now for further payment they have to show some progress in construction. In between they have already extended the possession date upto December 2012.
The problem is that builder has scrapped the wing D and E of SERENA from their plan without intimating the flat owners. Now on calling, their response is that it will be indefinitely delayed. Some of my colleagues are sure that the builder has no land to construct these wings. On repeated calling they are giving some options to the customers to the already registered according to their wish in the under construction wings A, B and C. Please note they have approval still for A only not B and C wings. Builder is giving me option on either ground floor or topmost floor of course very poor options are forced. Now some people have chosen options panicking that if options are finished then they will be on loosing side means they have to accept the money returned by builder, which will be quite less than the inflated money of flat. But builder is not saying formally or even orally that these wings will not come in future. Infact on transfer options the reason of transfer is highlighted as hurriedness of customer not problem by builder. I have decided that i will not chose options in panic and in fact wait for their formal (written reply).
Now friends especially property lawyers, how should i approach this problem? as they have time up to December 2012. Should i wait for their formal reply? Or should i approach consumer forum for clarification on the issue of the flats. I am sure that builder will be not able to deliver flats at promised date and will ask for again the extension of the delivery date or take money back at 9% interest rate. Then what will we do ? If i go to consumer forum, will court force builder to return money spent in the registration and stamp duty.
There are hundreds o[censored]nfortunate customers like me? If some group is being formed for legal batting please contact me also or want to start then please response.

I want written clarification from the builder about the status of the flat. they know that Their oral statement does not carry any meaning so they keep on lying on many issues. Builder is very cunning and dos all tricks to postpone and confuse. I am bracing myself for legal battle in future but i am naïve in this field . I will be grateful if i can get the some guidance to solve this problem.

I have booked a Flat in Casbela in Sept 2009 .And as per the commitement given by the Lodha group in the Letter of Allotment .I was assured the position of Flat by March 2011 .The delay has been for a year .Now I have received a Demand Letter regarding the Possecsion of my flat but to my surprice there was addation charges of Rs 1.5 lac which was demaded from me .These charges was Civic Governace Charges of Rs 45000 and WAT of 90000 @ 5% . On calling up the Customer Care I was told the Civic governace charges are for the Road and garden buliding which was to be owend by the Customer .On asking him why these charges was not informed to me at the time of sale why at the last miniut when I have already invested 25lac .I was clearly informed at the time of sale that the Road Buliding and the Garden buliding charges are all included in the Flat amount
Now they are denining the fact and are clearly stating that they will not be able to hand over my flat keys unless i pay these charges
