I had booked a flat no 1002 in the a wing, building: maxima, casa bella gold, dombivali being developed by lodha developers in 2010. The total cost of the flat is rs. 28.52 lacs. I had intimated lodha developers that I had availed a loan of rs. 20 lacs from hdfc bank (empanelled with lodha for this project) and paid the own contribution of rs. 8.52 lacs within the demand raised by lodha developers. The project had not been approved by hdfc till april 2011. Lodha developers constantly maintained that unless the project was approved, I was not liable to pay them any amount and only after approval of the project would they raise a consolidated claim for the stages completed by them (this was after I received various demand letters from lodha before project approval and called them to clarify). Now during the 7th slab demand letter payment, lodha developers have levied a penal interest of rs. 16,871 on delayed payment and have unilaterally proceeded to deduct it from the payment made by me for the 7th slab. It may be noted that I had protested the interest levy through their online helpdesk as well as writing to the customer care head - mr. Yatin kamat on his email ID yatin.[protected]@lodhagroup.Com. No revert has been received from mr. Kamat or their customer care till date. Please help me from this cheating builder.
