[Resolved]  Puravankara Projects Limited — Purva Swanlake at OMR, Chennai

Plan sanction given to Puravankara Projects Ltd., in March 2007 by Town & Country Planning for "Swanlake Project" at 1.8 FSI for construction of 8 storey buildings, was suspended by the authorities in July 2007 until the company surrenders OSR and road area going into the plot to local panchayat. The suspension subsists even after 3 years. The company did not reveal this information to the prospective buyers when entering into agreements for sale and has been collecting monies on monthly basis. The Swanlakle project which was scheduled to be completed in April 2010 is still under construction and the Developer has postponed the expected time of completion to March 2011 or beyond. While this is the status, Puravankara has submitted a modified plan to increase the FSI to 2.5 for construction of additional floors. Town and Country Planning authorities have rejected the modified plan of the company in December 2009 and as on date (Sept 11,2010) no approval for the said plan has been given to the company as per the information obtained under the RTI Act. Yet, the company has gone ahead in constructing the 9th floor in certain blocks. Many of the buyers have paid over 75% of the cost of the housing apartment unit way back in January 2009 with no commensurate progress in work. Further, the money is stuck in a project which has no proper legal sanction. Many of the buyers have requested the company to refund the money. The company is quoting the agreement conditions by which the Developer has the right to charge penalty of 15% of the apartment cost. When the Developer has failed to fulfill his obligations, how can he cite a condition in an agreement for sale, which itself is entered into by giving misleading information. In India public are taken for a ride and they don't have guts to take these cheats head-on irrespective of the consequences. Without courage and conviction such builders (from Kerala I believe) will take the lifetime earnings of middle-class people income just like chit fund frauds happened during DMK rule during[protected].
The concerned authorities!! please take some action so that the middle income people are provided a roof over their head at the earliest.
Buyers can individually or collectively file petitions before National Consumer Disputes Redressal Commission, New Delhi demanding the refunds of the amounts paid already together wtih 24% interest from the date on which the delivery was due. Puravankara is a past master in cheating and will not take action to refund on its own. They have behaved in the same manner in Bangalore also.

Iam based in Dubai and one of the early investors in the project, obviously got carried away bt the name and the standing, Few days back I sent an email to Purawankara Office in Madras asking them what compensation they would offer to people like me who paid a much higher rate and thus lost about 8 lacs excluding the interest that would have accrued to me had I not invested. The reply was that they would give an amount of Rs 7000/- for 3 bedroom apartment investors. I immediately wrote back saying it is ridiculous.

I think we must take the matter up with the concerned authorities to seek remedial action and adequate compensation. If nothing happens, the matter should be taken to electronic media to expose these people who have no regard for the consumers.

I cant understand how they can go on launching new projects without completing a project and fulfilling the commitment made to comsumers.

Please don't go ahead and buy or even talk to them. I have booked a flat and waiting for the possession since the last two years. Absolutely ridiculous management, pathetic service to customers, and most importantly, just when the promised date of delivery is nearing, they send you a mail with a pdf attachment stating that they expect more delay in handing over the apartment.

My sincere suggestion to you would be not to venture here and have a remorse for the rest of your live.
Swanlake-Chennai:I have paid 5 instalments so far (july 2012) and only two more remain. I had good opinion about Puravankara earlier-which i now understand is totally a misplaced one. The delivery is suposedly by Setember 2012, which is next to impossible the way it is progressing. Further, the penalty for late delivery is peanut whereas if you are a defaulter you have to pay heavy penal interet-violative of Interest Act 1972. Principles of natural justice is not applicable to Puravankara. Further, defect liability period is quite a farce and they will just hand over if at all and vanish from the scene, i am sure come what may to the structural performance and other items. now I regret, but it appears too late. Another thing, they did not reveal the hidden cost at the time of purchase-Service Tax which is more than 12% now, i was under the impression this will be to their account until i came to know about it much later. Puravankara is no better than any other contractor who does not give value worth. I am really upset since i had paid more than 80% of the cost. plus registration cost is also there. There must be some honesty in dishonesty-but here this is total dishonesty. I pointed out the flaws in the contract agreement-but they conveniently did not reply. So you are now between devil and deepsea-very costly experience indeed. i have come to know all are cheats-heartless people. To take legal action-it will be a long drawn process-so better to get reconsiled to the situation. what to do-no option. Puravankara-be humane and try to make money by honest means.

The corrupt govt officials and the their political boss who are sold out to the business people are to be blamed. We the ordinary people don't have the resource to fight the corrupt system. We cannot blame the builders alone.In the present position only we have to join hands with the promoter and get our flats at the earliest possible.
PROJECT SWANLAKE on completion has come out really well, all this waiting has given good result, Feel happy about the project, Yes it was really painful, but suggest me one Developer where delay is not there, Delay is not with the developer, it is in the Admin system of various govt entites who are corrupt individuals irrespective of the role they play, why blame the developer for someone else fault.

Today I have also booked apartment in Provident Cosmo city, which has all the amenities away from the city and completed project is awesome on completion.
