[Resolved]  Rto — Double time Tax on my Car

I have recently moved to PUNE from chennai due to official reasons and simultaneously moved my CAR via packers and movers. I have started using my CAR (it is bearing TN registration number) in Pune and on 17/12/08 i was stopped by RTO officials stating that i have to pay Registration fee for the car again in Maharstra and simultaneously impounded my original Driving Licence, Insurance card, and RC and given me a challan stating that i have to visit RTO office where in they will estimate the ammount which i have to pay then only i will be getting my original documents. I just cant understand that how many times i will be paying the Tax for one CAR, and more over Maharastra is in INDIA and i am using the CAR for private use and not for any commercial purpose. This is something ridiculous and they are making common public to undergo severe AGONY, this particular incidence has really given me lot of pain. Added to this when i have visited the RTO there i was unable to locate the window (no propoer sign boards are in place nor no personnel available to guide) where i will be getting the information regarding my documents. Ultimatley i have to take the help of a agent (who are doing rampant business within the premises of RTO) who quoted me Rs.500 for the service, and i was shocked to know that i got to pay 21, 000 again as Tax (i have payed 26, 000 TAX while i have purchased the vehicle in 2005). Can i understand from any source that why we should pay TAX these many times for the same vehicle, and is there any way out and what is the correct LAW.

I am in 100% support of Sudhkar's views. Just to mention, I am facing the same agony & It's not only we two, there are hundreds of indians who are facing such torchures everyday. We all feel that the Road Tax should be charged once to the consumer which should be valid across India (for the personal vehicles).

It's really a bizare that one have to pay Life Time road Tax everytime he shifts to a new state. It's one India but divided in states & it's all state governments, which are charging people of India, the tax to drive on their roads.

Here is our current law (as I have heard from Agents):
One has to register the vehicle in the new state, once moved & have to pay the Life Time road tax of that state (as per their %). Once registered, the RTO from that state sends some intimation to your previous RTO (where your vehicle was registered before) mentioning the new registration. Then, your previous RTO can refund some 75% of your Road tax paid. But, we all know that how refunds in India works, specially when it should be paid by a govt. body.

Law need modifications:
1) There should be only one body all across India which should be collecting LTT (Life Time Tax). If the states still want to have share of that money then they should internally work this out.
2) If (1) is not feasible for the Govt., then there should be an option to pay a term road tax instead of the LTT (which on an average comes to 8-10% of vehicle value). Life Time Tax covers the vehicle for 20 years. So, whatever tax we pay, it is for 20 years every time. The law needs a re-evaluation & there should be an option for the consumer to pay tax for 2 years only, if he is planning to stay in that state for not more than 2 years.
I am also facing same problem with my two wheeler active registered in Lucknow (U.P.). as per UP RTO there is no need of NOC if you are not going to sale the vehicle and once road tax is paid you don't have to pay again.
Now Traffic police hereat pune say that you have pay the tax of this government. Already i have paid fines to police for unknown reasons.
I don't know what to do?

Even I am facing a similar problem, but you can say it is a step further. I have come to pune for deputation for a period of 8-10 months and have shifted recently to Pune I was given to understand from one of my freinds in Mumbai that, we can indeed pay temperory tax for 1years I voulenterily intended to pay tax for one year and visited Pune RTO. Even, I was extended the same type of welcome and was ultimately told to pay the Road tax once again in Maharastra (earlier road tax paid was Rs.94, 000/- ) .

I am really shell shocked to note that having paid life time tax once, why should we pay one another time in the same country. This is atrocious and the Central Govt should be answerable to all tax payers who are prompt and their promptness is in a way more taxing!!!
the govt. must abolish the life time tax terms as the term is a total failure. The Govt. need to screw people of India by charging such an unwanted tax terms. If the Central Government do not have a control over the State Governments, they need to change the road tax from 'LIFE TIME TAX" to YEARLY TAX. They can also increase their revenue while charging yearly tax as life time tax is for 15 years only.
Otherwise they should accept the NOC issued by the State Authority from where the vehicle got registered.
Transportation comes under state government but not under central govt. If you are going to stay for long in Pune then you have to pay road tax. The road tax paid at the time of purchasing vechicle goes to TN govt Now since the vechicle is moved to MH road tax has to be paid to MH govt. Once you paid the tax in Pune, based on that, you can claim refund of tax paid in TN and you may get amount after deducting the tax for the perod of stay in TN. Yes there is lot of inconvience due to this but we have to bear that. Today I went to RTO for registration of my vechicle brought from HYD. Agents asked for amount ranging from 4.500 - 2000 to do the work. When I tried my self to finish the work and approached officer, I got help from him who gave me bunch of forms ( i have made a copy of these forms) along with list of documents required and the procedure. This gentleman signed, immediately, the letter addressed to the Commissioner of Police for verification of NOC brought from HYD. Then I have submitted the document at Commissioner's office. It appears to me that PUNE RTO is much better and people working there are very much helpful.

Really glad that you found that one elusive RTO officer who is kind enough to sign a ltter addressed to the c-of P's office. But wait, my friend, there is more fun and games ahead for you. Do let us know when you actually receive the refund of tax from Hyderabad, that would be the proof of the pudding! You will probably need to leave a mention in your will for your great grand children to make a post in these columns when the refund amount finally reaches you. Some questions, though - from my feeble mind:

1.So, if we are one country, and many people are facing problems moving vehicles across state boundaries, why not move this up as a central subject?

2. Since we have such helpful and resilient Government officials, what if the Pune RTO could simply write a letter to Hyderabad, and ask the RTO there to send the balance in your tax account to Pune ? Why is the onus on you?

ofcourse all the states are part of India but each State has its own law.When it comes to life time Road tax, i personally feel little modification is must in our law .. the percentage should be calculated in such a way the person(consumer) whoever shifting the vehicle from one state to another state, should pay a nominal amount of road tax as per the reules laid down by the law instead paying the whole amount of road tax again.
I fully agree with the views that if we treat India as 1 country, there should be only one fee and subsequent charges for any additional changes. Govt of India did this for Sales tax in terms of WAT to some extent.
Similarly for automobiles taxation, the Govt should consider one time taxation collected centrally and redistribution of funds as per the no of new as well as old vehicles getting registered in each state and road tax collected for no of vehicle-years. Road tax be collected for no of year slabs as per consumer choice. This will make states to compete for more registrations and will eliminate the corruptions in registrations.
All this will avoid heart burns and avoid holes in citizens' pockets. Apart from looting the public these officials catch U on streets and treat U worse than criminals. Most of the times these rides end up fattening their stomc than filling the Govt treasure. My son got to move to Pune with his 1 year old scooter and he is ending up paying bribes. Today the bribe was Rs 1000/- He was not transfering the scooter as he is planning to move back to AP in next 2 years or max 3 years. But toady I had decided to pay up the Govt greed and transefer as he already paid bribes to the tune of Rs.2000/- in last 6 months.
I hope all this is read by elected representatives and honnest senior public servents and make them act.

I am also facing the same problem in pune. I have my bike since 4 years in gujarat and i have to stay in pune for just an year, so i have brought my bike here, but the police tells me to pay the road tax.
I have inspected from gujarat's RTO that for first year in any state we dont have to pay road tax. I have all the papers issused from gujarat gov. (NOC letter, PUC, Isurance... )still the police whenever catches take money like anything.
Please we all have to be together and bring out some solution to it.
I hope all this is read by elected representatives and honnest senior public servents and make them act.

I totally agree with your feeling on this problem. My case is exactly same as yours and am really frustrated to see the cumbersome procedures in place to use a car within India.This is pathetic for people who freely move around the country with such difficult laws in place to follow.I guess we need to go a long way to get these things improved.

RTO — Need to relocate for a year and had to pay Life Time tax again

Hi,

I am relocating to Pune for an year and am required to pay Life Time Tax again. I will be there only for a year and why is it that i have to re-register my bike again in pune and then pay for the road tax again once i am back to Delhi.

Is there anyway out where i can pay tax only for an year and drive in Pune with my Delhi registration number.

By One more Murga of Indian Taxation law who is going to fall for a double payment...
We call India as one, and don't understand of paying tax for each state movement. Government should look into this and wave off this rule for people moving. Otherwise they shall implement the old vehicle mentioning the year of manufacturing not allowed to control the pollution.

THE RULE OF COLLECTING THE TAX WAS FORMED WHEN IT WAS A YEARLY TAX EVENT.THEY HAVE NOT MADE AMENDMENTS TO THE SAME.
THE OPTION IS WRITE COLLECTIVELY TO THE SURFACE TRANSPORT MINISTER IF NOT RESOLVED TO THE PMO OFFICE. AND FINALLY IF NOT RESOLVED FILE A PIL.
