[Resolved] Tata Housing Development Co. . Boisar — Possession of the flat has not been given post agreed date of June 2011 | |||
To, Tata Housing Development Co, Shubh Griha , Boisar. Project 1 BHK – 465 Sq.ft Dear Sir, Dead line of Possession mentioned in Agreement for Sale (AFS) is June 2011. Same date was also advertised in various media article. Last communication received from you was 6 month ago stating that possession will be done in phases. Till date, no communication has been done from your side. Numerous phone calls from me received various reasons for delays such as, labor and material shortages, drainage issues etc. I would like to point out that reasons for delays are TATA Housing’s responsibility and well within your control. Also note that Clause 12 in AFS states for ‘reasonable delay’ of possession from Tata housing however term ‘reasonable’ is subjective and should not count more than 6 months from agreed date in AFS, In the event of ‘No response’ or “ unsatisfactory’ response from Tata Housing, cost of further delays will be solely bared by the seller, I hope that sincere efforts will be done to ensure early possession date and to keeping high expectation from TATA group.
