The Mobile Store — defective handset

Hi,
I had purchased a Sony Ericsson W580i handset from The Mobile Store Infinity mall, andheri w, Mumbai on 16th July '2009 under an exchange offer whereby i gave away my old phone and got a discount on the newer one. Right from day one I had encountered sevearl technical and display problems with the handset which I had informed the store keeper immidiately. To my surprise they completely disowned themselves from the accountability of getting it replaced saying that it is a look out of the SONY and they are mere retailers. On my insistence, they supported me by accompanying me to the SONY SERVICE CENTRE nearby to get the matter sorted out.
There at the centre, individuals from Sony and THE MOBILE STORE indulged into an argument over their terms of agreement and policies resultant which I wasnt attended for the main cause.

It only added to my dissappointment when people at SONY showed negligible interest in helping me out any way other than saying "WE WILL UPGRADE THE SOFTWARE, THERE IS NO REPLACEMENT POLICY FROM THE COMPANY". From that day till now, I have gotten this software upgradation done thrice and it hasnt helped a bit. Infact, a few problems occured after it returned repaired from their centre.

I sent a few mails to the ESSAR GROUP(the mobile store) and SONY as well, but no one has paid heed to my complaint. Please help me raise this up to the highest level of escalation in both the companies.

I bought a Xperia C phone from Mobile Store on 8th Dec at 5 PM and then when I opened the Box, I saw the cover of the phone is damaged. I took the phone to the same store again in 2 hours, and they recognised the phone is defective and said, this need to be replaced by the Sony service centre.

The cover is not fitting properly, and the phone is popping up most of the time on standard use of the phone.
I took the phone to the service centre, they are refusing to replace, saying it need to be replaced by Mobile Store.

Sony and Mobile store is saying they can't replace as there is no tangible damage. Also they are saying they can send the phone to service centre but it will take 7 days. They can't provide the backup phone.

It is difficult to understand, when the product is defective, how an Sony and Mobile store refuse for an immediate replacement?
