Sub.: Complaint against M/s Vikram Pharmacy, Shop No. 1, Sindhi Panchayat Complex, Opp. R.R. Vidyalaya, Jalgaon for sale of expired medicine – “Mopaday-30” and falsification of sale records.

Sir,
With reference to the subject mentioned above the following facts and circumstances are brought to your kind notice for initiating immediate action against M/s Vikram Pharmacy for deliberate and willful violation of the provisions of the Drugs and Cosmetics Act 1940 and Drugs and Cosmetics Rules, 1945.


1) That the applicant is respected citizen of Jalgaon and is also a graduate of Nagpur University in Pharmacy holding the Degree of Bachelor of Pharmacy. The applicant is a law abiding citizen and considers his duty to report the violation of statutory provisions by a Licenced Medical Shop M/s. Vikram Pharmacy.

2) In view of the prescription issued by Dr. Subhash Chaudhari, the applicant had purchased medicines from M/s. Vikram Pharmacy on 16.02.2009. Amongst various medicines, was tablets “Mopaday-30”. The applicant had purchased 20 tablets (2 strips) of “Mopaday-30” manufactured by wock. M/s. Vikram Pharmacy sold me two strips of “Mopaday-30” each having 10 tablets but belonging to two different batch numbers as per following details mentioned in the bill.

3) It is submitted that after careful scrutiny of the strip it was revealed that the details of the batch number and expiry mentioned in the bill were not matching with the particulars mentioned on the strip. On the strip of medicine issued to the applicant the batch No. was mentioned as TMA-6022 and its expiry date was May 2008 (manufacturing date June-2006). The applicant has preserved the strip of the tablet and also the bill No. 34729 dated 16.02.2009.

4) The applicant had immediately approached the proprietor of the shop and pointed out the illegality. However he had no intention to rectify the mistake and was absolutely arrogant in his behaviour.
5) It is submitted that in the process of sale of Mopaday-30, M/s. Vikram Pharmacy had indulged in two serious illegalities.

a) That expired drug batch No. TMA-6022 expiry May-2008 was given to the applicant.
b) In the bill however different batch number and different expiry date was mentioned (TMA7001, expiry 03/09).


6) Thus M/s. Vikram Pharmacy are liable for action as per the Act and the Rules on all the counts namely-

i) preserving and distributing expired medicine.
ii) Mentioning batch number and expiry of different batch in the bill
iii) Falsification of record so as to cover up the offence of sale of expired medicine
iv) Cheating the applicant by issuing expired medicine and issuing a false bill.


7) I believe that this is a practice of M/s Vikram Pharmacy to purchase expired medicine from the market at throw away price and sell to the customers. A thorough enquiry should be conducted with the manufacturer i.e. Wockhardt about the medicine Mopaday-30 under Batch no. TMA 6022 to whom and when details of the invoice under which the medicine was sold.

8) In view of above circumstances you are requested to immediately initiate action against M/s Vikram Pharmacy, Jalgaon as per the provisions of the Act and the Rules so as to curb such irresponsible and reckless shop owners.
