1. Brief of the Case
The complainant purchased a holiday membership package from the opposite party on 30-March-2026 for a total consideration of Rs. 2, 79, 000/-, paid through credit cards.
At the time of purchase, the company representative, Ms. Sapna Rathod, made the following commitments:
Conversion of payment into interest-free EMI
Holiday accommodation with complimentary breakfast and dinner for 10 years
Reimbursement of local sightseeing/petrol charges
However, the opposite party has failed to honor these commitments.
2. Facts of the Case
2.1 Misrepresentation of EMI Facility
The complainant was promised that the credit card payment would be converted into interest-free EMI. However, this was never done, resulting in significant financial burden due to high credit card interest. The representative stopped responding to calls and messages.
2.2 Deficiency in Service – Coorg Booking (05-Apr-2026)
The opposite party arranged accommodation stating meals were included. However, upon arrival:
Breakfast and dinner were charged separately
No reimbursement was provided
Promised petrol/local sightseeing charges were not refunded
2.3 Lack of Customer Support
Repeated follow-ups with company executives Mr. Harish and Mr. Kushal were ignored. No refunds or resolutions were provided.
2.4 Cancellation Request Ignored
The complainant submitted a cancellation request via email on 17-Apr-2026. Despite multiple reminders, no proper response was received.
2.5 Failed Booking – Guhantara Resort (10-May-2026)
Despite requesting booking one week in advance:
No reservation was made
On 09-May-2026, the complainant was advised to "walk-in"
Due to lack of proper booking, the plan had to be cancelled
2.6 Violation of Terms & Conditions
As per the company’s own terms:
"In case of service-related issues, refunds (if applicable) will be processed after deduction of services utilized."
Due to repeated failures, the complainant is entitled to a refund. A final refund request was sent on 23-May-2026, giving 14 days’ time, but no action has been taken.
3. Grounds for Complaint
The actions of the Opposite Party amount to:
Deficiency in Service (Section 2(11))
Unfair Trade Practice (Section 2(47))
Misrepresentation and false promises
4. Relief Sought
The complainant respectfully prays that this Hon’ble Commission may direct the Opposite Party to:
Refund Rs. 2, 79, 000/- (membership fee), after adjustment of any actual services (if proven)
Compensation of Rs. 1, 00, 000/- for mental agony and harassment
Reimbursement of credit card interest caused due to false EMI assurance
Litigation costs of Rs. 25, 000/-
Any other relief deemed fit in the interest of justice
