[Resolved]  Country Club India — Non refund of member ship fees, even after canecellation fo membership within cooling period of 10 days

I had taken membership from country club in July 2013 and after card payment of Rs 500000/- the disclosed additional fees. Since the same was not financial viable, I request to cancel the membership an reimburse the amount, to which they refused. Hence I approached ICICI bank. After three months they came and said you need to continue to pay the EMIs and the dispute is against you since you have authroised the transaction. I explained them the following 1.The transaction is authorized by me (this was informed to ICICICARE from the day the dispute was raised. 2. False information provided -The following information like annual charges Rs 8000/-to be paid if the you opt for the vacation and the tax amount to be paid (per day) for the number days stayed was disclosed after the card payment. 3. Membership cancellation requested - Based on this false information, I had requested Country Club via email and phone to cancel the membership immediately i.e the next day after the card payment. They haven't responded to the call or email. Hence raised a dispute with ICICICARE. Note - As per the ARAI, the member ship can be cancelled within the cooling period of 10 days 4. Non receipt of service The member ship login id and user id were to be received within 48 hrs from the card payment, the same is not received to my mail id [protected]@yahoo.com. Secondly the membership physical card are still not delivered to my residential address. (in one of the attachment Country Club states the same which is false.). Recently the have come with following reply that ICICI bank cannot help in case of non delivery of goods. We acknowledge the receipt of your e-mail of November 27, 2013 addressed to Head Service Quality regarding the dispute on your ICICI Bank Credit Card 4629 XXXX XXXX 2008. We understand that you have raised the dispute for the transaction of Rs. 50, 000.00 debited towards COUNTRY CLUB, PUNE on June 16, 2013. We would like to inform you that your aforementioned credit card has been used as a payment mode while making a transaction at Country Club. However, the bank is not responsible for the quality or the information provided by the merchant at the time of transaction. We request you to refer to our terms and conditions under Clause XXI. Quality of good and services, which clearly states that, ICICI Bank shall not, in any way, be responsible for merchandise, merchandise warranty or services purchased, or availed of by the Card Member from Merchant Establishments, including on account of delay in delivery, non-delivery, non-receipt of goods or receipt of defective goods by the Card Member. It must be distinctly understood that the Credit Card is purely a facility to the Card Member to purchase goods and/or avail of services, ICICI Bank holds out no warranty or makes no representation about quality, delivery or otherwise of the merchandise. Any dispute or claim regarding the merchandise must be resolved by the Card Member with the Merchant Establishment. The existence of the claim or dispute shall not relieve the Card Member of his obligation to pay all the Charges to ICICI Bank and the Card Member agrees to pay such charges promptly. Further, we request you to get in touch with the merchant for the clarification of the points raised by you. We affirm that ICICI Bank at all times acts with diligence, in good faith and in no manner prejudicial to the interests of its customers.
