Country Holidays Inn & Suites — False promises, managed fraud and not providing promised services after taking full payment as well as advance AMC

My Name is XXXXXXXXXXX. I had received a phone call from CHIS representative in April’2021 and they had informed me that we are lucky winners of CHIS and invited me along with my family (wife and daughter) in Hotel Raddison Blu at Kaushambi, Ghaziabad on 10.04.2021. Accordingly, we had attended that event of the Company i.e. CHIS, wherein we were welcomed by the sales representative of CHIS, Sh. Vijay Chauhan and Sh. Rikendra Kumar. After that they had requested us to listen about CHIS Holidays Membership Plan. They repeatedly had mentioned that this offer is valid for that day only and we have to take decision immediately there. They offered me a 10 years Holidays Membership Plan, which we have denied due to long period and being costlier. Thereafter, they had offered and promised us a 5 years Holidays Membership Plan (T-1) for two adults and upto two kids in their associated 4 Star/5 Star Hotels at a cost of Rs. 97, 000/- including GST and Annual Maintenance Charge (AMC) of Rs. 8, 000/- excluding GST to be payable only while booking of holidays of each 6 Nights 7 Days (6N 7D) per year. Holidays can also be carry forward to next year and also can be transferred or gifted to relatives. They had also promised some other offers as under:

Complimentary Offers:
1) One night at Hotel Four Points by Sheraton at Samalka, New Delhi with Breakfast and Dinner, to be availed in 6 months
2) Air Ticket Voucher of Rs. 8, 000/- to be availed in 6 months
3) Two complimentary 6N 7D Holidays to be availed in 5 years
4) Three Beauty and Spa Services discount Vouchers

Complimentary Vouchers (to be availed in One year):
1) 2N 3D Holidays at their designated locations in India,
2) Upto Rs. 500/- PVR Movie Voucher
3) Upto Rs. 10, 000/- International Air Ticket Discount Voucher

I have paid full amount of Rs. 97, 000/- on same day i.e. 10.04.2021 through my Credit Card. Sales Representatives of CHIS assured us that all these above promises will be mentioned in agreement and we have to just sign it. They had kept us busy in talking and had not given any time to read the agreement thoroughly and built pressure to sign it by saying that it consists of whatever they had promised. Since they had taken full amount of Rs. 97, 000/-, therefore we have no other option but to sign the agreement by believing on them considering the brand name of Country Holidays Inn & Suites. After that the Sales Representatives had requested us that you will get a confirmation call from CHIS so please accept the call and say OK to all the offers. We left the place after their assurance of all the above said commitments, unknown to the fact that we will cheated at each and every step, by not providing any services after taking full payment in advance, thereby breaching the agreement, which is a one sided contract and has not mentioned the roles and responsibilities of First Party i.e. CHIS.

I had availed only one complimentary night stay with breakfast and dinner at Hotel Four Points by Sheraton at Samalka, New Delhi on 25.09.2021. Thereafter, I have raised many requests in a period from 29.09.2021 to 09.02.2022 for booking of Air Tickets from Delhi to Jaipur or Delhi to Udaipur, Complimentary 2N 3D Holidays at Shimla and latest booking for 6N 7D Holidays in Udaipur & Jaipur. But every time, they have denied the services due to reasons like technical issue, internal issue, contract renewal issue resulting in non booking.

At the time of sale of holidays’ membership, it was informed to me that I can book holidays as per my choice at various four/five star hotels associated with CHIS, which includes Jaipur and Udaipur also in the list. But, while raising a request on 09.02.2022 for booking my first holiday with CHIS (20 days prior to journey date against requirement of 15 days), they have denied Hotels at Udaipur, in spite of paying advance discounted AMC of Rs. 8, 240/- on 14.01.2022. After having pathetic experience, I am sure that CHIS may completely deny availability of hotels in their listed/associated locations in future and will not book any holidays as per my holiday plan.

As per their policy, I had raised requests in September’2021 and November’2021 for booking of Air Tickets one month prior to the journey but they have delayed in processing the requests and informed that please contact later, as booking window opens only one month prior to each calendar month. Later, I have raised request for booking of Air Tickets by giving time of 20 days, then they informed me to raise request with one month prior notice. Thus, they denied the bookings indirectly, all the time.

Also, during working hours of CHIS from 10 am to 6 pm from Monday to Saturday, no body picks my call on any numbers as mentioned in email. However, after working hours on working days, response by CHIS through email has been provided. This is contradictory. I have also contacted sales representatives of CHIS who had given me membership, but Sh. Rikendra Kumar never received my calls and Sh. Vijay Chauhan has told that he has left CHIS.

After taking full payment of Rs. 97, 000/- and also an advance AMC of Rs. 8, 240/- (total= Rs. 1, 05, 240/-), they have not providing services as promised during sale of membership and also as mentioned in the Vacation Purchase Agreement, thereby doing cheating, fraud and taking away my hard earned money by making false promises and by breaching the terms of Vacation Purchase Agreement executed on 10.04.2021. This is a kind of managed fraud. I have all the proofs of above conversation in my email along with other proofs and documents, which I can provide whenever required, as I am not uploading here due to privacy reasons.

In view of above, my only request to CHIS is that please cancel my membership having Registration No. CHISNND780103 and refund my full amount back, after making necessary deductions for one night stay at Hotel Four Points by Sheraton at Samalka, New Delhi. Please look into this matter and refund my amount as I have no other option but to approach various forums and other available options to get justice under law. Now I have no faith or believe in CHIS that CHIS will not repeat this to me in future, after experiencing their pathetic after sale services.

I hope and look forward for early resolution from CHIS regarding cancellation of my membership and refund of paid amount.
