[Resolved]  Country Holidays Inn & Suites — fraud company , illegal practices in hotel reservations

I, Dr Nitin Aggrawal, has purchased the membership services of CHIS for domestic and international vacations on 19th August, 2018 and made full payment in advance. As per agreement, my membership is entitled for 3 adults for 10 years including breakfast.
Under the membership services, I have made several requests for vacations at different locations but they are unable to provide the requisite services and give different excuses every time. In this regard, I have met with Mr. Ujjal Roy, Vice Chairman and Ms. Jyoti, CRM of CHIS(on 23rd November, 2019) to discuss the poor services and violation of terms and conditions of the contract. But now they are re-negotiating the terms and conditions of the contract and misleading me to agree with it by refusing to refund my membership fee which is illegal act that I have denied to accept. Hence, I hereby lodge a complaint of illegal practices by the company and seek full refund of my membership fee.

Currently, I am suffering from the following illegal practices by CHIS team:

1. As per agreement, CHIS provides only 4/5 star properties for vacations and their sales team also committed that only hotels listed on CHIS website shall be provided.
But at the time of reservation, they are providing 2 star property that are not available on CHIS website and forcing us to take the same or booking is not available. I faced such illegal practice by CHIS for vacation at Dubai, Vrindavan and Ranthambore.

2. Recently they have introduced the policy of 90 days advance intimation that is not stated in their agreement.

3. In agreement, sales team has offered membership for 3 adults but reservation and customer care team are denying to accept it for any bookings and asking for extra bed charges that is they are deviating from the agreement that was signed by their sales team.

4. In agreement, food services are optional for the customer but in mail communication, the reservation team is making it mandatory and seeking payments.

5. In agreement, 4 bonus weeks @ Rs 999/- + GST would be provided to me and upon seeking clarification, the sales team has committed to provide the same (i.e. including breakfast & GST) @ Rs 1600/- per day (maximum) but the customer care and reservation team are denying to the communication of the sales team.

6. To acquaint the services, CHIS provided complimentary vacations at its properties including breakfast at no extra charges. However, on actual booking under membership plan, the reservation team denied to provide similar service and instead demanded extra payment for breakfast.

7. The sales team has concealed various hidden charges at the time of sale that are being revealed by the reservation team on every booking. Thus, CHIS is misleading the customer to agree to their terms and conditions which are continuously re-negotiated. This is cheating.

8. Despite giving 90 days advance request for Vrindavan booking, the reservation team showed unavailability of CHIS property i.e. Sarovar Portico and instead offered us a 2 Star cheap property (Kadamb Resort @ Rs 1862/-). Upon escalating the issue with the sales team, the next day the availability of Sarovar Portico was confirmed. This shows, that reservation team is showing a fake communication o[censored]navailability and using corrupt practice to generate margin for itself by offering poor facilities to the customer.

9. At the time of sales, it was promised that booking shall be provided at all times throughout the year but at the actual time of booking, reservation team is always denying to offer the services at peak time, Recently, I requested on 23rd September, 2019 for Ranthambore booking for 28th29th and 30th December, 2019 which they later denied and requested to make a fresh request in Novemeber, 2019. Subsequently on my follow up on 5th November, 2019, the reservation team turned down my booking request by stating that all properties are sold out and not available. This is how they are not able to give the services when required.

10. For Dubai vacation, at the time of purchase, the sales team committed to provide Millenium Hotel including breakfast. Accordingly, I made a 3 months advance request to make the bookingsbut the reservation team provided a very cheap hotel and asked for additional breakfast charges.

As a legal practice, the commitments made by the Sales Team of CHIS are binding on CHIS but in actual practice the reservation and customer care team of CHIS are not agreeing to it and disowning all the commitments that are documented. Such action of CHIS is illegal and violation of agreement with me. Thus, I am aggrieved and request for cancellation of my membership agreement with them and seek full refund.

CHIS denying to accept their sold agreement, can we file a case in consumer court under THE CONSUMER PROTECTION ACT. for refund.
