On November 21, 2024, I purchased a one-month badminton membership on the Cult Fit platform for ₹6, 490. I specifically chose the one-month plan because I will be leaving the city on December 21, 2024, and wanted to utilize this membership for the limited time I am here.
Before making the purchase, the Cult Fit platform displayed that all slots for all days and times at their Kondapur centers were available for booking. Additionally, the platform advertised unlimited booking of slots, which seemed ideal for my needs, as I planned to play badminton for 4-5 hours daily. Based on this information, I decided to proceed with the purchase, despite the membership being relatively expensive.
However, immediately after completing the purchase, I discovered that:
1. No slots were available for the next 3 days.
2. Only a few slots were available after 3 days, making it impossible for me to utilize the membership as per my requirements.
It became evident that the platform displayed false slot availability to mislead customers into purchasing the membership. Had I known the actual availability of slots, I would never have purchased this membership.
Realizing this within 10 minutes of my purchase, I immediately requested a refund from Cult Fit, as I felt cheated by their misleading advertising practices.
Cult Fit’s Response and My Issues with It:
Cult Fit has acknowledged their mistake in displaying false slot availability, as evident from their emails to me. Despite this acknowledgment, they have refused to issue a refund. Instead, they keep suggesting that I “adjust” by booking slots in advance, like other customers. This suggestion is irrelevant to my complaint. My issue is with the misrepresentation of slot availability before purchase, not with my inability to adjust afterward.
I have communicated with Cult Fit multiple times, both via email and their social media platforms, but their responses are repetitive and do not address the core issue.
Nature of the Problem:
1. False Advertising: Cult Fit displayed false slot availability to lure me into purchasing a membership.
2. Breach of Trust: They acknowledged their mistake but continue to send irrelevant responses instead of offering a resolution.
3. Unfair Practices: Refusing a refund despite the clear misrepresentation and inability to deliver the promised service.
Relief Sought:
1. An immediate refund of the ₹6, 490 membership fee, as the service was purchased under false pretenses.
2. A commitment from Cult Fit to improve their transparency in slot availability to prevent other customers from facing similar issues.
Evidence Provided:
1. Screenshots of slot availability before and after purchase.
2. Emails and responses from Cult Fit acknowledging their mistake.
3. Proof of payment for the membership.
I request NCH to take strict action against Cult Fit for their deceptive practices and ensure that I receive a fair resolution. Thank you for your assistance in this matter.
