We live in the colony behind old Gandhi Medical College, Basheer Bagh. This site is under construcion by DLF since the last 3 years.A 60 feet cellar is being dugf or the last 3 years.The recent rains have collected as dirty water in this cellar leading to hordes & hordes of mosquitoes in our colony. We cannot sit without getting bitten by these dangerous mosquitoes day in & day out. We are tense about our health getting affected on this account. Please see that anti mosquito measures are taken at this site and also warning be given to DLF to take appropriate draining measures & save our colony people from ill health.

Please take immediate action.

    I booked a flat in Express Greens project of DLF in October 2008 and have paid up nearly Rs.20 lakhs todate. Despite repeated, written assurances by the company, there is no sign of commencement of construction in the project.

    This is deeply worrying to me, as my savings at a critical time of my life are locked up without fetching me any return and without any guarantee of when the flat will be delivered. I am in the last couple of years of my service and am apprehensive of the present situation.

    Make a group and file RTI and legal case via consumer court
    The case was characterised by a lot of drama as DLF, acting in a typically guilty fashion, tried all legal tricks to ensure that the case was shut down.

    n During the trial, DLF threatened cancellation of allotments to the complainants, which the CCI stopped through an interim order on September 20, 2010.

    n DLF tried to get out of the trap by challenging the jurisdiction of CCI before the Competition Appellate Tribunal, but failed as COMPAT directed the CCI to proceed.

    n DLF raised the issue of CCI’s jurisdiction by pointing out that the case was arising from contracts signed by the allottees in the year 2006 etc, before the enabling provision in the Competition Act came into force in May, 2009.

    n DLF tried to suppress the investigation report by the director general by filing a writ petition in the Delhi High Court. The court did not oblige DLF, but directed CCI to allow DLF to inspect the report.

    DLF vigorously argued throughout the case that it was not in a dominant position as defined under the Act, looking for various loopholes in the Act to pull off an escape. This is despite various pronouncements and postulations in its annual report and at different fora, where it claims to be the largest property developer in the country and boasts of being the dominant player. It is only when such information was used against DLF that it started crying foul

      Hi,

      This is to inform you that we all are facing problems of very huge power cut at DLF Dilshad Extn-II Sahibabad, Ghaziabad. There is no schedule of power cut as well water supply. Continiously, the power would not be available at night as well as at day time, we are only getting power of 3-4 hrs out of 24 Hrst and this is on reqular intervals of 15 min to 20 min. It is very difficult to servive without power in this area and somebody can die without power due to humidity and summer.

      I request you to take a veery serious action against this issue for us.

        i bought this house due to good residential location but after 3 years my dreams shattered for . here devloper is supporting those residence who have encroached illegal area infront of there plots which is marked for public area or parking for cars but dlf own employees protecting those people who have encroached that particular area with permanent iron fencing with big gate in the name of green area .other residence park there cars on road so road which is actully in maps is big size become narrow lane. it is inconvient to everyone .when after 5-6 years these palnts become trees than in the name green environment one cannot remove .
        nobody is listening in dlf management .so whom we should contact please guide

          Misbehavior
          This is to bring to your notice the very rude and irritating behavior by the DLF guards in front of the Infinity Tower, Gurgaon.

          Firstly the parking is very inadequate relative to the number of buildings in the complex.

          Secondly your staff is not at all helpful and is very rude at times and they do not know how to speak and explain things politely..
          I had a massive misunderatanding with a gentleman today and he was unable to explain anything to me.
          On top of it he was very rude and misbehaved and raised his voice with me in public... He does not know how to speak with women...
          We are all educated people and we deserve a certain amount of professional attitude and I think nobody has a right to speak to any professional the way this gentleman did today..

          Lastly, all your lifts have some issues or the other at certain point of time.. Maintenance is very poor..

          I request you to please look into these issues..

          I faced the same problem "Misbehaviour by Security Personnel"
          This is to bring to your notice that the Guards at DLF Infinity Towers Gurgaon -refused to allow my car in Free Visitors car park. I was visiting IBM Daksh(tower B).Time was around 3.30PM (11th Nov). I noticed the Free car park had space for at least 4-5 cars.When i asked why i am not allowed the personal was rude and told me, they have complete rights over this place.They told me i am not allowed to even check if there is free space available.I am not allowed to step inside there compound unless they give permission? This person told me he is the in-charge of the security but strangely was in civil dress.
          Is this way your security in-charge behaves? I was not given any reason why my car was not allowed inside the Free visitors Car park.Is this person involved with the Paid parking people? He told me i have no business to ask why i am not allowed to park the car??On my way back when i asked the other SLV security persons, who this person was.They told me they are sorry and to leave this matter.They refuse to give the persons name.
          I had a similar experience with the security guard and the parking agents. I was trying to park my car in front of the Infinity tower when the Parking agents starting misbehaving regarding the parking. When I protest against them they all gather up together and were ready to man handling with me. I tried to highlight the thing to security in front of the parking but end up with this conclusion that all these people have a good tie up and there is no need to waste the time here finally I went away from the place.

            I FULLY AGREE THAT DELAY IN CONSTRUCTION OF DLF NEW HEIGHTS WILL EFFECT ON DLF TRUST
            The crooks have lost yet another court case.

            This disputed land is right on the main NH 8, next to Signature Tower and DLF is already halfway done building this 5 million sq.ft. compound. Accenture is already operating from here and shall occupy the upcoming towers as well. This is a very prime property and not less precious than Nathupur. Both these buildings would amount to not less than Rs. 1500 crores atleast.


            In similar case of Nathupur land scam, DLF had pitched in Harish Salve as their lawyer in the supreme court and won the stay. They are going to do it again in this case as well. What I have observed during our research that DLF has never won a case in any of the judicial court of this country but they would use the lucane in the system and kept dragging these cases forever. They would have Harish Salve, Arun Jaitley, Ashok Desai at their disposal and use them against innocuous litigants and their honorary lawyers. A simple investigation of DLF board members would reveal their true intentions, in terms of negotiating with these litigations. Mr. Kameshwar Swarup, 70 year old, is third from the top in their organisational hierarchy. He is the legal head of the company and draws a package of Rs. 2.10 crores p.a.. Mr. Ravinder Narain is the Executive Director of the company and his team is responsible to contest all the legal cases against DLF. They also have Luthra and Luthra as their strategic partners to fight and negotiate legal and corporate cases in India and abroad. In terms of cases against them,


            In Supreme Court (means they have lost the respective cases at all the lower courts and have seek the refuge of the supreme court now) :


            1. Almost 60 litigations pending from the allottees of Regency Park, Gurgaon.
            2. Income Tax case with a demand notice of Rs. 1180 crores on account of tax evasion.
            3. CBI case against DLF's Ajay Khanna for bribing DDA officials. A case of FAR violation in their Jhandewalan Head Office building.
            4. Nathupur case with a building worth more than Rs. 600-700 crores.
            5. Silokhera case, Sector - 30, Accenture building case worth more than Rs. 1000 crore.

            In Lower Courts :


            1. In Delhi at CCI : Belaire Owner's Association, Park place Resident's Welfare Association, Magnolia Welfare Association, New Town Heights (Via Pankaj Aggarwal), Mr. PD Sharma, etc..
            2. In Indore at Consumer Forum : Garden City allottees in different individual capacity.
            3. In Bangalore at Consumer Forum : Garden City allottees
            4. In Chennai : DLF were booted out and their MD was manhandled by the allottees. The project update is not available on the web.
            5. In Hyderabad New City Town Heights : Numerous cases in the consumer forums today.


            In informal chat with one of their executives, I learnt this about KP Singh and DLF. If there is something they would want to remember from their Army experience than it would be :


            1. Land belongs to those who captures and hold it and owning is not enough.
            2. You need army to thrive and in older days you would need goons but now you need lawyers to defend.
            3. Leave the elegance to the tailor, do what you have to do to win.
            4. There is a difference between a civilian and an Army men and that shall remain.


            We are not against DLF or KP Singh but only would want to know why we should not have what is justifiably ours. Why we, the civilians, should humbly submit to the dictates of these corporates and their new age goons. We are not alone against DLF, as you could see now, the common civilized men of this country has awakened for its rights and this shall continue for the betterment of our children and the future of this country. We are doing whatever little we can to stop these corrupt people from ruining this country so that one day when we would look back we would not repent that we did not do what we should have done.

                Apatment: NGL022, DLF New Town Heights, sector 90, Manesar Gurgaon

                The apartment was alloted in Feb 09 with 3 years completeion from date of Agreement but whole apartment cost is being taken from Application date i.e Feb 2008, agreement was sentn in August 08. The agreement is completely one sided.
                The company is charging preferential allotment charge as well, though there is nothing like preferential allotment.
                The company alloted apartment though it did not have license to book and kept on collecting time bound installments withoutb making any progress and kept on threatening to sign the belated agreement.

                Company is not refunding my money and cancelling this allotment. It is progressing on construction front as well. Several reminders are having no effect.

                Any forum who can take up investors concerns is most welcome and is requested to get in touch immediately.

                The date of application was Feb 08 and not Feb 09 as mentioned by mistake in the complaint. All are requested to read Feb 09 as Feb 08.
                I dont see any progress in the construction of the apartment, While we are paying interest on loans, but there is no income from the apartment.

                  I have applied for a 4 bhk apt in DLF Gurgaon 86 sector. After one year of booking there is no work which has started on the project.

                  I have listed down the points which i have raised with DLF but I have still not received any solution. DLF asked me to take legal recourse if i want to cancel the contract. I am based in Mumbai and hence unable to visit Delhi frequently.




                  1. While applying I had given the option on pool & club facing for PLC, where is my consent on making it green facing. If I am paying a premium charge I should be given a choice of selecting my property.

                  2. DLF has charged customers even without starting work. Why should we keep paying DLFmoney when the project is not even taken off.

                  3. There was a big delay by dlf in sending the agreement on account of which there were delay in installment payment. DLF has charged me interest for the delay stating that had the disbursal been on time I would have paid the finance company interest and hence i should pay DLF interest even though the delay was at their end.

                  4. DLF sent me the signed agreement in Feb 09 one year after booking that too with lot of pages unsigned and witness page also not signed.

                  Now I dont trust DLF and would like to exit from this project with an interest on the payments made. The DLF spokesperson has asked me to go legal if i want to claim anything from them.

                  Also there was a commitment from DLF to communicate status on the project on 15th of March which has still not been done.

                  Are there any other people who are facing similar issues.

                  I completely agree with you.
                  This company DLF is absolute CROOKS. You are not alone, there are millions of such people. I can assure you that you will not find a single satisfied customer of these CROOKS in India or Abroad.

                  Take them to court and link up with like minded people who have already filed a case against DLF in CCI (Competition Comission of India).

                    DLF launched New Town Heights project in Gurgaon in last year (FEB 2008) and it was communicated that construction will start in 3-4 months but nothing has commenced so far.

                    I have booked a flat in sector-86 and paid 35% of payment to DLF even there is no construction started yet.
                    Since August, every time we are told the construction will start next month. Now recently we have been told that the authority environmental approval is still not in place. There is no fixed date for starting construction. Still we all investors have gone ahead and paid our entire installment in full.

                    DLF has offered 5% dis on Base Price, 10% on Terminal stage on Selling Price and additional 5% area ( Free of cost) . This discount is highly unacceptable. In slow down of global economy, reductions in salary and poor DLF financials we need discount of 30% upfront. We have already paid 35% of Selling Price. DLF has not started construction in Sec 90 - not even a brick has been installed.

                    After more than a year of allotment, DLF informed me that DLF doesn't has necessary approvals i.e. Environment clearance is not in place. When I asked them to refund my money they are saying I will have to pay 5 lacs as penalty.
                    It's not my fault that DLF couldn't arrange for Env clearance even after 1 year. I have lost faith in DLF and want my money back with interest as I don't feel that my money is in safe hands
                    If discounts not given as per your suggestion, I would like to withdraw my money from the project
                    i am also facing the same problem for booking a flat in sec 91 and paying a heavy plc which is totally unjastified please if anyone can --

                    Construction in DLF New Town Height is very slow and not as per schedule. This is a serious concern to all o[censored]s.

                      i have booked an apartment in dlf's new project in kakkanad, cochin. total cost was 30 lakhs. they told they can arrange loan from sbi and if i pay the loan amount in advance, i will get a rebate of 12. 15 %.
                      everything was agreed beteween me, bank and dlf. but now the bank is sayin they will not give the loan amount in advance. as that is the case i will have to pay 3.66lacs extra. i find this an extra burden in this recesion period and i want to cancel the booking. now dlf is saying, i will not get back the booking amount of 3 lacs. . now i feel like i am in a trap.

                      DLF are crooks. They now have a Dispute with their Labour contractors for DLF Belaire. The labor has walked out and all the construction has stopped. I wonder when will get our property which was legally due in January 2010. At current speed this is not possible before Jan 2012 a delay of 2 years.
                      The crooks must be punished.
                      The Competition Appellate Tribunal (Compat) today refused to stay the proceedings of the Competition Commission of India (CCI) against real estate major DLF and permitted the competition watchdog to go ahead with its inquiry.

                      Compat will hear the case on February 10. DLF had approached Compat against the CCI probe into the complaints raised by some of its customers over alleged “abuse of dominant position” by putting “discriminatory and abusive clauses” in the apartment agreements provided to the allottees of two of its high-profile projects in Gurgaon, Haryana.

                      Early this month, the Delhi High Court also refused to grant a stay on the CCI investigations against DLF.

                      The petitions before CCI, filed by associations formed by some of the customers of premium residential projects like Park Place and Belaire, complain that DLF failed to deliver the residential projects on time and put “discriminatory and abusive clauses” in the apartment agreements provided to the allottees. It also says the builder is abusing its dominant position in the market.

                      The two projects are expected to have a total of 2, 200 flats, priced between Rs 1.5 crore and Rs 3 crore each, making the total worth of the apartments in the range of Rs 4, 500-5, 000 crore.

                      The projects, which started in August 2006, were expected to be completed in three years, but the developer extended the deadline to April 2011.

                      The director general (investigations) of CCI, who gave his findings to the commission recently, is known to have endorsed the charges made by the allottees against DLF.

                      GSK sues DLF in separate case
                      In an unrelated development, GlaxoSmithKline Consumer Healthcare Ltd (GSKCH), the FMCG company that owns leading brands such as Horlicks and Boost, has filed a case against DLF over charges of violations of its agreement in one of the commercial projects in Gurgaon.

                      GSKCH alleges that DLF had violated its agreement with the company over the purchase of a property in its City Centre project, which was later renamed Horizon Centre. GSKCH claims that by relaunching the project, DLF had violated the agreement it had with DLF Ltd and DL[censored]tilities Ltd for Tower 3 in the City Centre together with parking and proportionate share in the common areas in the project site.

                      Real estate sources associated with the marketing of Horizon Centre said the commercial space that were up for sale now were not related to the one specified by GSKCH.
                      K.P Singh and his battery of lawyers from DLF are trying very hard to stall the investigations in their Crookery and Fraud. They bought land from farmers are Peanuts - Crookery No-1, They sold the apartments at Sky High Price, collected 60% of the price before signing Agreement - Crookery No-2. They had no approval plans for these apartments called Belaire & Park Place when they sold the apartments in 2006, the approval came in 2009 - Crookery No-3. They violed every single law for FAR, increased the floors unilaterally - Crookery No-4. The agreement is illegal as this did not provide EXIT Clause to the customers.

                      K.P Singh you will ROT in Hell and you son & grandsons will die in a Road Accident or Air Crash and join you in Hell again. All the Baddua's from all the farmers & customers cheated by you will not go waste. Deepak Kapoor & gang will be licking K.P Singh's rear even in Hell.

                      In informal chat with one of their executives, I learnt this about KP Singh and DLF. If there is something they would want to remember from their Army experience than it would be :


                      1. Land belongs to those who captures and hold it and owning is not enough.
                      2. You need army to thrive and in older days you would need goons but now you need lawyers to defend.
                      3. Leave the elegance to the tailor, do what you have to do to win.
                      4. There is a difference between a civilian and an Army men and that shall remain.


                      We are not against DLF or KP Singh but only would want to know why we should not have what is justifiably ours. Why we, the civilians, should humbly submit to the dictates of these corporates and their new age goons. We are not alone against DLF, as you could see now, the common civilized men of this country has awakened for its rights and this shall continue for the betterment of our children and the future of this country. We are doing whatever little we can to stop these corrupt people from ruining this country so that one day when we would look back we would not repent that we did not do what we should have done.
                      CHANDIGARH: In a major setback to the real estate major DLF and Haryana government, the Punjab and Haryana High Court on Thursday quashed the acquisition of land by the state from farmers, which was later released to the private developer for a special economic zone (SEZ) in Silokhera village of Gurgaon.

                      The SEZ was to come up on around 30 acres near Sector-30. The court has directed the government to remove any construction in the next six months that has been raised on the said land. While pronouncing the order, the HC also observed, It is not understandable why state is showering favours in favour of DLF and other private companies.

                      Terming the act of the state government in execution of sale deed of the said land in favour of DLF as not legally permissible, the High Court also imposed a cost of Rs 2 lakh on DLF, Haryana government and two other private companies.

                      The orders were passed by the division bench comprising Justice Jasbir Singh and Justice Rakesh Kumar Garg of the Punjab and Haryana High Court while allowing

                      a petition filed by Harkishan, a resident of Mohammadpur Jharsa in Gurgaon and others.

                      Petitioners had brought to the notice of the bench that Haryana government had first acquired a big chunk of land for the purpose of developing the land for residential and commercial areas in Sector 30, but later released it to private companies illegally.

                      It was stated that the state government, in January 1989, issued a notification under Section 4 of the Land Acquisition Act, to acquire 210.38 acres in Silokhera village and 5.2 acres in Sukhrali.

                      In January 1990, the government under Section 6 of the Act issued a notification in which 169 acres in Silokhera and 2.13 acres in Sukhrali village were acquired.

                      Then in September 1995, the state government released 30 acres of the acquired land in favour of M/s East India Hotels Limited under the garb of providing a hospital of 300 beds and other medical/educational facilities of the area. However, later the said land was illegally sold by M/s East India Hotels Limited to DLF Limited and Chandra Jyoti Developers Pvt Limited.

                      Making allegations of nexus between the state government and the private companies, petitioners informed the Bench that the state government not only allowed such illegal transfer of land in April 2006 but also accorded all kind of facilities to these companies including the approval of setting up of SEZ on the said land by DLF.

                      Accepting these contentions, the Bench of the Punjab and Haryana High Court quashed the acquisition process of the said land and directed the Haryana government to take possession of the land and allot it further for public purpose only.

                      A DLF spokesperson said that they would not be able to comment until they get the copy of the order.
                      The case was characterised by a lot of drama as DLF, acting in a typically guilty fashion, tried all legal tricks to ensure that the case was shut down.

                      n During the trial, DLF threatened cancellation of allotments to the complainants, which the CCI stopped through an interim order on September 20, 2010.

                      n DLF tried to get out of the trap by challenging the jurisdiction of CCI before the Competition Appellate Tribunal, but failed as COMPAT directed the CCI to proceed.

                      n DLF raised the issue of CCI’s jurisdiction by pointing out that the case was arising from contracts signed by the allottees in the year 2006 etc, before the enabling provision in the Competition Act came into force in May, 2009.

                      n DLF tried to suppress the investigation report by the director general by filing a writ petition in the Delhi High Court. The court did not oblige DLF, but directed CCI to allow DLF to inspect the report.

                      DLF vigorously argued throughout the case that it was not in a dominant position as defined under the Act, looking for various loopholes in the Act to pull off an escape. This is despite various pronouncements and postulations in its annual report and at different fora, where it claims to be the largest property developer in the country and boasts of being the dominant player. It is only when such information was used against DLF that it started crying foul

                        You would be shocked to know that I was embarassed by the manager at DLF Dt city centre Mall, shalimar Bagh, New Delhi when i was shopping at lakshita .

                        Mrs. Diamond Peter is such a ruthless and out of senses lady with no brains and use abusive langauge and does not know how to treat customers, her behaviour would soon lead to failure of the mall.
                        What happened was i went to Lakshita International, they were not aware of certain offer, also there internet was not working, so i went to various shops but no access, I went to customer service desk, nobody was present to attend and computer was on, so i googled out citibank metro card offer and showed it to its employee when his owner came, the receptionist returned and closed the window of the page and began to suppress me trying to cover her fault of leaving the place like this .soon the manager pulled a huge crowd and argued with me and asked the security to take me away, they all feared their job and due to authority of hers everybody became spectator of event and she called police and filed a case against me, as the manager was a women she began to have a strong verdict and manipulated the event and put her statement as final verdict and accused me with wrong charges and finally inspector took me away and asked me to apologise, i did but she was out of her mind .I hate her and would like that she should be thrown out of her job and her career is ruined and put in jail for lifetime and left with no authority but sent to trauma centre.

                        I have submitted to this complaint to all my frnds and asked them to put on every networking site so that this out of place manager is left no where.

                        Really bad experience would like you to be sensible and to teach a lesson to such persons who make hue and cry out of small things .

                        Please tell me the right authority whom to address in this matter and action is taken against such people.I am also planning to reach consumer grievience cell to teach her etiquettes of dealing with customer and to use right words.even though she is women i dont care as i cannot tolerate such attitudes and behaviour.
                        I have never seen this kind of anti-customer manager.Please take serious action against her.ask her to behave.She told me never to repeat such mistake and herself is a evil in eyes of all the staff and owners and staff in stores who also fall in troble becoz of her having power.ask her not to be a hitler but to be a human.

                          Cheating

                          DLF is a big cheater in real estate. DLF Garden city venture in chennai has been launched in Dec' 2006 and the Advance booking amount has been collected from the people booked in Jan' 2007, but till date the progress at site is almost zero.

                          Further, till date, DLF has not got the floor plan approvals, and people who are willing to with draw from the project are being told that the entire booking amount will be forfieted,...

                          they are big cheters and crooks.
                          they will mismanage your money.and will eat your money...they will treat you as there servants.
                          they do not value for there investors.
                          After more than a year of allotment, DLF informed me that DLF doesn't has necessary approvals i.e. Environment clearance is not in place. When I asked them to refund my money they are saying I will have to pay 5 lacs as penalty.
                          It's not my fault that DLF couldn't arrange for Env clearance even after 1 year. I have lost faith in DLF and want my money back with interest as I don't feel that my money is in safe hands.

                            This is to bring to your notice the very rude and irritating behavior by the DLF guards in front of the Infinity Tower, Gurgaon.

                            The wrath of these guards seems to be directed especially to lesser mortals like us who have to commute by rickshaws to office.

                            These guards seem to be taking their duties to seriously in that they create a ruckus whenever a passenger takes an interval time of 2-3 mintues to get down from the rickshaw and hand over the fare to the rickshaw-waala.

                            While their effort of not allowing rickshaws to block the entrance is commendable, their behavior is not.

                            For us office -goers, it is not a matter of pleasure or enjoyment to be part of a traffic jam either as a cause or effect. But to be treated rudely is something I have not asked for.

                            Wish the DLF guards could be as strict with all the cars parked on the road instead of trying to oppress those weaker than themselves.

                              DLF through their brokers made us apply for an apartment in Belaire. The form was not filled-in and was taken saying that DLF would call us and discuss the options with a cheque for 20 Lakhs.
                              The building was suppose to be of 20 floors. The land is on Freehold basis to be equally divided among the allottees.

                              Thereafter they alloted us 2nd floor with "Preferential" charges. When we disagreed they told us that we will loose all the booking money, if we do not sign the agreement within 30 days.

                              We started to pay the money than they informed us that they are working on getting additional floors on top. This implies that they will make more money & our share of land will go down. DLF should either reduce the price of apartment for allottees like us who booked when the project was declared to be of 20 floors.

                              Now we are stuck with this. We can neither keep the apartment nor can we exit as we will loose our 20 lakhs + Brokers commision (3-1/2 lakhs) which DLF paid to broker without asking us

                              Even we are facing similar situation w.r.t DLF Garden City Chennai Project. DLF is armtwisting buyers to part with money when approvals are not in place.
                              DLF is a bunch of crooks. They have recently being hauled up for fudging their taxes.
                              DLF has been cheating its customers in one way or the other in Gurgaon. All their projects introduced during the last five years have been delayed and the builders have been avoiding to adhere to the penalty class under the pretext that the delayed penality is payable to the original allottees. They are master in the art of twisting the arms of the allottees. When faced with difficult situations they have managed to get back licence fee of more than Rs.200 crores - that is a clear pointer of their restoring to all illicit favours.
                              DLF has robbed their Customers over the years to fill their coffers. They have been cheating, arm twisting their customers. Are their any associations for DLF Belaire, who have filed a Legal case against them?
                              having been at receiving end from DLF we have taken them to court on completely one sided agreements with such clauses that will not stand legal scrutiny. this shoudl be a class action suit.
                              Hearing that DLF is reducing the price of still "unsold" Belaire apartment by 30%. This immediately locks in a significant loss for original allottees. DLF appears to be protecting itself by selling more apartments at a lower price. The party that remains unprotected are the original allottees. What would be fair is for DLF to offer concessions to original allottess as well, so that everybody is treated fairly.

                              Seems like the original allottees need to unite and challenge DLF. Unity has strength.

                              I thinks its very important we all form a group and collectively fight against DLF. Similar collective actions have shown positive result in other projects in Gurgaon. There are 2 clear issues:

                              1. Initially the project was announced only for 18 floors which they unilaterally increased to 27 floors. It will have a huge strain on the common facilities.

                              2. Delay of approx 2-3 years in completion.

                              DLF should offer rebate / discount to original allottees.
                              I am also a DLF Belaire owner and very upset with the treatment that we have got.                               DLF is definately a bunch of crooks. They have been known to cheat their customers as that's how they have become rich.
                              The director general (DG) in charge of investigations at the Competition Commission of India (CCI) has found that real estate company DLF Ltd abused its dominant position, building two Gurgaon projects without the requisite approvals or seeking clearance from the Haryana government for changes that were made to the original plans.

                              DLF, the country’s largest developer, declined to comment on the issue because the matter was sub-judice. “CCI has asked us to give our comments/objections to this report, ” the company’s spokesperson said in an emailed response.

                              The report only amounts to the findings of the investigation and is not an indictment.

                              CCI is expected to deliver a final ruling, based on the inquiry, after giving an opportunity to all parties involved to present their case.

                              Mint has reviewed a copy of the DG’s report on its investigations into two developments in Gurgaon—DLF Belaire and DLF Park Place. The case was filed by apartment buyers protesting against delays in delivery and changes in plans.

                              The company framed the agreement clauses in such a manner that homebuyers were not able to understand the allotted carpet area and the necessary changes thereafter, said M.L. Lahoty, counsel for the petitioners.

                              The company didn’t inform the buyers about changes in the number of floors, he said, confirming that DLF had been asked to reply to the report’s findings.

                              Counsel for the petitioners has also filed applications asking about the date of completion for the two projects. CCI will hear the case on 6 January.

                              DLF Belaire buyers moved CCI in May, saying the company had indulged in “anti-consumer and anti-competitive” practices. The petition before CCI, filed by Belaire Owners Association against DLF; Department of Town and Country Planning, Haryana; and Haryana Urban Development Authority (HUDA), states that DLF has failed to deliver the residential project on time.

                              Both the projects are expected to have 2, 200 flats priced between Rs.1.5 crore and Rs.3 crore, likely to be delivered next year against the original deadline of 2009-end.
                              We knew something was fishy in this project from the very begining, when we were forced/coerced to sign the agreement. Now we see the real fun. Deepak Kapoor, Valsala, K.P Singh and his cronies must all be sent to jail under section 420.
                              The investigation wing of the Competition Commission of India (CCI) has suggested forming model real estate regulations to safeguard customers from discriminatory treatment.

                              It has cited examples of building regulations from at least eight developed nations to point out how the absence of proper regulations are helping the real estate industry to frame clauses that are against consumer interest.

                              The observations of the director general (investigations) are part of his internal report to CCI on complaints raised by some customers of real estate major DLF. The customers had alleged that the company had “abused” its “dominant position” by putting “discriminatory and abusive clauses” in the apartment agreements provided to the allottees of the Belaire and Park Place projects in Gurgaon, Haryana.

                              The DG report points out several instances where construction was started by real estate players before they received actual approvals from government bodies like town planning departments.

                              The report takes note of the real estate building procedure of countries such as Belgium, Denmark, England, France, Germany, the Netherlands, Norway and Sweden to highlight the common conditions that are in place as consumer safeguards.

                              It says that in most of these countries, the title of the land has to be clear and fully paid up before any property is allowed to be placed in the market for sale. Similarly, approvals of building plans and valuation of the financial status of the builder are prerequisites.

                              Even when the builder announces a project, the real estate firm will have to specify the rates for sale of covered area. No super areas or hidden cost will be allowed later.

                              The DG report also notes that most European laws permit a customer to book the apartment with a payment of 10 per cent as the booking amount. All payments and receipts towards the project are deposited in escrow accounts exclusively attributed to the project and these funds cannot be shifted around. Similarly, the final settlement takes place only after the property is delivered and the consumer is given a three-month “live-in” period to draw up a list of faults and defects to be cleared by the developer.

                              The reports recommend CCI to engage the Ministry of Housing and Urban Poverty Alleviation, Ministry o[censored]rban Development and all state governments to come out with model real estate laws that stipulates similar conditions for the benefit of the consumer.

                              The DG’s investigation report is an internal document and the final decision is taken by CCI after its assesses the report.

                              DLF Ruining India
                              People should know how DLF is ruining India by continuing to take advantage of subservient masses of India. Indian masses are nurtured and indoctrinated over thousand of years to remain apathetic and obedient to the mighty Lords. DLF exactly know this very well and have exploited this very trait of Indians to become one of the most richest person on this earth.
                              In the year 2006 DLF had launched a 19 floor apartment at a prime location in Gurgaon called The Belaire. I also booked a 4 bedroom flat and paid the earnest money on the 5th of september 2006. Subsequently I received a payment schedule from them on the 30th September 2006 where I was expected to pay them the entire money by 5th of December 2008. The very next letter was a demand notice on the 16th Oct. 2006 for the next installment due. There was no mention of any Agreement, no mention of any building sanctioned or something but a demand notice for more money. I live next door to this planned building and I was very well aware that there was no movement at all on the construction site than why on earth DLF was seeking more money from me. The only relationship I had with this DLF was for the purchase of this apartment in this building, why on earth would they require more money from me when they have not even started to excavate the site area. I did not budge, but not for long. They again served with a notice on the 7th Nov. 2006 as a reminder of their dues. Imagine my condition where I am living next door to this site and not like some NRI or from Delhi, could see the development at the ground on daily basis. Right outside my balcony. It did not stop here and I received another threatening reminder from them on the 22nd Nov. 2006 to cough up the money or face cancellation that could result in the forfeiture of my entire money that I had paid to them. Despite the fact that there was no agreement signed, despite the fact that there was no ground movement, despite the fact there was nothing tangible that I could see with respect to this building yet, I relented and paid them the due money.
                              You can not imagine what was in store for me. The black shadow of DLF engulfing me and the peace of my life. They threatened me with notices and obnoxious replies over the and than came this letter on the 26th of December 2006 where they were patting on their chest for their victory over hapless customers like me and claiming to have performed the Bhoomi Pujan on the 21st December 2006 on that land. They have been threatening me of dire consequences, threatening me to confiscate my earnest money, threatening me of sending demand notice of another arrears due to the other expenses that DLF had to pay on my behalf like brokerage etc.. and after all this they have acknowledged that "Yes, we know that we had not even started the work at the site but what the heck, what can you do about it". You all would be shocked to know that today we have come to know ( after using RTI act and extracting information from the DTPC) that it was only on the 2nd January 2007 that DLF had formally submitted the building plan sanction paper with the authorities for the due scrutiny and approval of the project. It was only on the 18th April they had received the approvals from the authorities for the construction of 19 floor apartment called The Belaire. This only only proves the extent our nation has accepted the corruption as the way of life where one of the most richest man on this earth plays around with the law of our land without any respect or fear in the broad day light.
                              The story goes on from here and to the worst where I ended up with a cancellation letter in my hand and a cheque worth less by Rs. 46 lacs. Today it has reached to a stage where I have left my job of a MNC and have joined full time an Association to fight my case against DLF and bring them down forever. I would not go down come what may, even if I would be assassinated by DLF goons. And for The Belaire, it is a 29 Floor building today standing naked on the crossroad of Phase 5, Gurgaon hounded by 350 original allottees of the year 2006 for compensation worth more that Rs. 500 crores.
                              DLF is known to be close to the Congress Party, hence we know there will be no action against them as long as Congress is in the Centre and Haryana. DLF must have greased Congress nice and well.

                              DLF has allegedly gifted 2 Super Luxury Apartments to the son-in-law of the most powerful family of India. That must be probed as well.

                              NEW DELHI—India's competition regulator has fined property developer DLF Ltd. 6.3 billion rupees ($139 million) for abusing its dominant market position, after the owners of an apartment block the company is building complained about the addition of extra floors and project delays.

                              The Competition Commission of India's verdict Friday came after an owners' association said the company, which is the country's largest property developer by sales, had imposed arbitrary, unfair and unreasonable conditions on them.

                              The Belaire Owner's Association, representing the buyers of apartments in a DLF project in Gurgaon, on the outskirts of New Delhi, alleged the developer had planned to build 19 floors in 36 months, but instead had built 29 floors, which disadvantaged existing buyers and led to delays.

                              The penalty equates to 7% of the company's average revenue in its last three financial years.

                              DLF Group Executive Director Rajeev Talwar told Dow Jones Newswires: "We are studying the order. We will consult our legal experts on the options ahead. We believe that we have a very strong case."

                              In its complaint, the association said: "The fall-out of the delay is that the hundreds of apartment allottees have to bear huge financial losses, as while on one hand, their hard-earned money is blocked, on the other hand, they have to wait indefinitely for occupation of their respective apartments."

                              The commission ruled DLF had carried out abusive practices "with the object o[censored]ndue economic gains and business profits."

                              It asked DLF to desist from formulating and imposing unfair conditions in its agreements with buyers in Gurgaon and to modify the unfair conditions within three months.

                              The stand of DLF customers stand vindicated. The crooks are exposed and the law will take its own course. Their Legal team cannot buy Judiciary now when Anna is fighting for Lokpal. If anyone is seen as being bought over by DLF or their cronies, we will expose them.

                              For this property I paid Rs 88 L cash in 2008 as down payment and there after I followed several times for the delayed worries.. DLF never gave this option to us to take your money .. otherwise I could have invested somewhere else and got good returns..

                              I have another project with DLF in sec 80 Gurgaon, where I asked for the refund last month as I found you people are fraud .there were even ESCALATION clauses. I was told by DLF as per the contract terms I will lose the booking amount if I cancel the booking .I was not even asking the interest .. So why this much generous now on this deal ..

                              Now coming back to one more question – You are asking me to pay Rs 61000 as delayed interest on this property letter enclosed since I made the down payment 17 days late where as you want I don’t take delayed penalty from you as per the contract .. Don’t you feel this is fraud .. My problems will be dealt with contact and you will take interest and your problems too I have to take care .. you played Golf with my money and don’t wish to pay for this ..

                              PL note I paid down payment to DLF considering your reputation I did know the cheating in your policy otherwise with the same money I would have booked 10 flats at construction linked with other Builders and moved out after 2 years .. I would have doubled my money ..

                              PL note this is the only DLF property which has escalated from Rs 6700 booking amount to Rs 16000 market price now and I am making profit .. and you are offering me the cancellation ..

                              I have other DLF property in DLF sec 74 A, there too you have delayed .. why don’t you pay my money there with interest as per the booking as there is hardly any escalation ..

                                  I applied for 1760 sq ft flat and paid advance money of 5 lacs along with the application form. I was alloted a flat of 2125 sq ft without my consent or my the broker's consent. when the company was contacted in this context, it was imposed on me that he should purchase the alloted flat or else the advance money would be forfieted. now this shows the formidability of the company. let us move to the ministry o[censored]rban development and ask them under the right to information act that which law of the country allows this.

                                  It is not correct on part of an reputed organisation to penalise an indivisual customer. An indivisual can no fight against an organisation. Let us join together for common cause and fight with DLF
                                  I also had applied for the 3 bedroom (1750sqft) apt, however, was allotted the bigger (2125 sqft) apt. I had also filed an official request for a change in the allotted apt but as you can all tell with the 'great' customer service of DLF was given a letter back as a reply that I would have to keep the 2125 sqft apt. Let alone the bigger apt not being in my budget, I then recieved a letter after a month with the 'actual' price which now forcefully included "2 parking slots" & "20% preferential location" charges!!!

                                  My family & I have bought various properties (including DLF properties) over the last 15 yrs, however, I have never been so disappointed with a purchase. I decided to book the new town heights due to the calibre DLF holds as a builder, however, I didn't expect to be extremely let down.

                                  I will be joining the group mentioned above, however, pls post any new developments. Also I came to hear that DLF has floated the option of surrendering your apt for DLF New Town Heights due to all the distressed customers.
                                  I chose the downpayment option and have already paid 95% of price(Rs. 45 lacs) towards purchase of express green manesar but seems like it is never going to be built. DLF has my all money. They have emailed that they are considering some discounnt option. But I am not sure if they are really going to do. Very disappointed. Can anybody suggest if I can get my money back or is it advisable to do that.

                                  I also have same problem. They imposed PLC to me in New Town Height forcefully as they are law maker of the country. When i meet with Customer care - G.M., he behaved with me as i am duffer a( alothough i am also G.M. of multinational company.

                                  Despite my several reminder, they refused to offer me flat without PLC and told that this is out of stock. Surprisingly seen that allcheckdeals.com is advertising for availability of non PLC flats now on behalf of DLF. How i can come out of PLC amount as i am at 17th floor and not able to pay un-necessary money.

                                  On the similar lines, company DLF has missold me the flat by telling me it is 2nd from the top floor however in 2012 Jan when they laid the final slab it came out as the Top Floor. Customer Service team and sales team is playing a ping pong and finally they decided to accuse the customer only by saying I am lying to them. Customer Service GM says it is the case of misselling as the orignally there were supposed to be 22 floors which were reduced to 21 and should have been informed about it at the time of sale. Sales GM said I am lying as I may have changed my mind during the course of action. Luckily I have the sales form in which their sales manager has hand written that building has 22 floors, now they are not coming back after getting the proofs.                                     DLF Started Selling New Town Heights Gurgaon through agents across the country instead of advertizing it on their website . They called in Pre Launch. They did sell it through agents starting february. When the money was taken by wire transfer by them, they advertized this sale in the Web site by March middle and Increase the price by 20% with Some thing Called Preferential Location charges. This was universally applied to all the Big appartments.

                                    Later the Agents in Collusion with DLF assigned appartment numbers to all the gullible persons who has paid up money in the prelaunch and imposed this 20% fee on them. Either you take the appartment or we will keep your earnest deposit.

                                    A clear case of blackmail, deceit and extortion. Coming of top of it, A rude and arrogant person lying thorough his teeth sits as Customer Care GM. He forgets conveniently that DLF did not even advertize this sale till the middle of March. It did not accept direct communication through individuals through the middle of march and then claimed the agents are cheaters, not them.

                                    Result: All the customers who are trapped are feeling cheated and let down by this appartement Sale by DLF. They cant withdraw their money since allotments have been done in collusion with agents and Customers have no way out.

                                    I have paid Rs.5 lacs as booking fee through an agent on 14th february 2008. I am a U.K based NRI. Neither the Agent or the DLF respond to my email, phone calls etc. The fund was transferred frommy SBI (NRI) branch to DLF account.
                                    This is exactly what I faced. For me, ICICI bank was the agent through which my dad (who mediated for the property as I am currently abroad) got conned by DLF.
                                    The agent conveniently asked my dad not to fill up the form and even said that before allocation DLF will call you and discuss personally your preference. But they allocated a flat without even asking for preference and charged usurious PLC charges and on top allotted a flat which I had not applied for! I had applied for a 3 bedroom apartment and instead I was allotted a 4 bedroom apartment with high PLC charges (amount to additional 375 per sq. ft) taking the price of the house from budgeted 45 lacs to 65 lacs (way beyond my budget for an additional bedroom!) without even intimating me about the change/charges. In the brochure they didnt even inform how many flats of various types are being built, didnt mention the PLC charges and I am sure this is just a start..there would be a lot of hidden charges for all the people who got conned by DLF. When confronted the guy in DLF conveniently placed the blame on the agent and refused to allocate the desired 3 bedroom apartment and also refused to even return the booking amount conveniently showing the clause on the paper which says that DLF will forfeit the amount.
                                    I think the govt and a suitable regulator is urgently required to put an end to such shady and unfair practises (such as using PLC as means of increasing the price and claiming base rates) by builders through which they charge exorbitant amount and loot the public. I hope someone takes notice and formally take action against DLF through courts.
                                    I fully agree.dlf is a cheater.being an old name I trusted them. Now since they are listed comp. SEBI should act on them there is no regulator in India.
                                    I am also a victim here.DLF slapped a PLC of Rs 500/sqft .I am also abroad and feeling helpless.
                                    DLF seems to be very un-professional in handling the booking of New Town Heights. I am also been slapped a PLC of 500 Rs i.e 22.23%. In all the ongoing and completed projects in Gurgaon the PLC was never been such high and at max be about 100-150 Rs (Lower Floor + Garden/Pool Facing). I trusted the DLF but now feel cheated. I think we should all get together and lodge a complaint in customer cell.

                                    I feel thats the only way out and let this builders know that they should not take people for granted.
                                    What is the remedy available ? Can we go to consumer court ?

This kind of PLC is very high for a society which is outside the main City of Gurgaon or Delhi and will not be fully self-reliant atleast for another 5 years. Let us take this up on priorty as the installment payment date is fast approaching. Probably we all (or most o[censored]s who can be present for the meeting) should plan to go to DLF and talk to their Senior Management about this.

                                    WE fully agree with the views expressed above, but what do I feel that all the brokers/ dealers are not in connivance with DLF, but they are helpless to some extent. I am reproducing the letter written by my broker to the DLF, which is self explanatory. Any person who wants to join me in legal case against DLF, may please communicate at the earliest.



                                    Dear Madam,

                                    we are in receipt of your letter dated 22.05.08, addressed to Mr.[protected]and copy endorsed to us, regarding Apartment No.[protected] in Sector-91, "New Town Heights, DLF Gurgaon" and are shocked and astonished after going through the contents of your letter.

                                    The said letter is a poor effort, on the part of DLF, to put our firm in bad light and denigrate and vilify in the eyes of our esteemed clients/ investors.

                                    At first, we want to make it clear that all our clients had applied in your aforesaid scheme for the flats, measuring 1760 . Sq. Feet only, as no restriction was placed by the DLF for any specific size. Since, before upgrading the flat of Mr.[protected], neither our firm, nor Mr.[protected] was consulted; the grievance of Mr.[protected] is genuine and legitimate.

                                    It appears that M/s DLF is dying for disposing their flats measuring 2125 and 2505 Sq. Feet, which might be not getting takers in the market and employing all types of tricks for this goal.

                                    On the other hand, all efforts are being made to dissuade applicants of 1760 Sq. Feet flats, which are in high demand compared to bigger ones, by forcing them to opt for bigger flats, which they might not be in a position to afford.

                                    At first, applications of our many clients for the flats of 1760 Sq. Feet only were rejected, citing the short supply; then some of them have been upgraded to 2125 Sq. Feet, without taking their/ our consent.

                                    Even, application of, one of our esteemed clients, Mr.[protected], was rejected citing the reason that his cheque has been dishonored. But, the fact is that his account in question was continuously having balance of Rs. 7, 00, 000/-. Now, Mr.[protected]---, armed with his bank statement and certificate from his bank that no 'stop payment' instructions were issued to the bank, is threatening to take legal action against our firm as well as DLF, against illegal rejection of his application.

                                    Even, flats with PLC were allotted without consulting our clients/ us. Although, it is a practice in Real Estates sector to invite the option for specific PLC and allot the unit accordingly.

                                    These types of nefarious practices, for which real estates sector is already getting bad name, is at least not expected from M/s DLF, which has already become a global brand in this sector.

                                    In view of above, you are requested to kindly,

                                    1. allot Mr.[protected], a flat of the size of 1760 Sq. Feet, as applied by him;

                                    2. If the same is not possible, immediately refund his earnest money i.e. Rs. 5, 00, 000/-, as holding the same may invite interest liability on the part of DLF;

                                    3. Confirm the allotment of Mr.[protected]-------.

                                    At last, we want to emphasize that ours is a Real Estates Firm of repute and we have earned goodwill of our clients, after much time and effort. Hence, we are feeling hurt and offended due to your aforesaid letter and look ahead for some rectifying step on the part of M/s DLF.

                                    M/s DLF should also realise that these type of practices coupled with efforts to vilify and malign your own agents are not going to pay in the long run.

                                    DLF alloted me a 1760 sq ft flat in sec 86 through agent. So far agent is bahaving nicely with me. I did not opt for PLC so no PLC charged to me. Now when the second installment is already due, so would like to know are you guys not planning to pay ?

                                    Basically I would like to know that, now whatever we got alloted or the money we have invested :
                                    - Is it worth continuing this deal ? If no then why?
                                    - Backout is possible at this stage?
                                    - If we plan to continue the deal, what currently the stage of development ?
                                    - Are you guys planning to file a case to get your investment back due to not liking the DLF service or because of more PLC charged?
                                    DLF did the same with me. The broker from DLF took a Blank form from us for an apartment in DLF Belaire in the so called Pre-Launch. Then they allotted us an apartment on 2nd Floor with Preferential charges. I won't pay 2 Crores for an apartment just above Parking. They are now keeping all the top floors to themselves to be sold at premium price.

                                    The form apparatly had a clause that if we do not sign the agreement, they will gulp our money which was 20 Lakhs??

                                    There is no progress of construction . The whole thing is likely to be delayed by at least 1 year if not more. Whenever you call DLF office on construction, they tell 'it is going to start from this month'
                                    There is no pre-construction activity also . There is no road etc . The villagers are also not aware of any such project. DLF halted contruction of projects which are well under construction due to recent financial meltdown situation . I thnk this New Town Project seems to be non-starter.

                                    Hi,

                                    I just got my agreement back and guess what. DLF has further changed the date on which it was signed from their end and the new date is 01-Nov-08. So very conveniently DLF has further extened the delivery timeline by almost a year i.e. booking made in February and agreement signed on November. Without even informing me what was the need to change the agreement signed on date from August to November. Shame on DLF. It boasts of no 1 developer in India and then does this cheap acts and rip off its customers.
                                    I have received a letter from DLF stating that they will consider three year period for possession from the date of booking instead of the date of agreement. This means that they will give possession by Feb 2011 .

                                    On prime facie it looks positive development.
                                    I haven't received any such letter (treat booking date as agreement signed date) till now but know someone who has. Wondering what's behind it. I am sure DLF wouldn't take this step as a first-choice this would have been rather the 'last-choice'. I could think of following reasons.
                                    1. Someone legally challenged them for the delays in getting the agreement signed and then further changing the date on the signed agreement.
                                    2. DLF thinks that customers might not pay future EMIs as there's litlle or now progress on the construction so far and want to lure us by making such promises.

                                    Whatever it is they better mean it . Can we get thogether and ask them to show us the detailed plan, which leads to possession in February 2011. We should not be gullible enough to take them on face value. They have some biggest crooks on their payrolls. I am not sure if an online club already exists for us by I can take the lead in creatin one and then take things wforward. We will have to do our best to make sure we don't loose our hard-earned money.
                                    DLF has sent me the signed greement copy back. There is a delibrate delay by DLF in starting the project and they are using our funds in other incomplete projects. Digging at site is nothing but eye wash & just a step to fleece more money out o[censored]s. Guess, we need to form a joint forum and approach the builder.

                                    I also booked a flat in sector 91, 4 bed & already paid them 23Lacs. I am planning to file a case against them and already in talks with some lawyers to understand if it is possible to get back my money. I see many people above are talking about taking a legal action but not sure if anyone has already done it.

                                    Where has DLF faulted on their commitment.
                                    DLF has agreed to give possession with in 3 years from the date of booking. The payement terms were very clear in advance. The work has started on the site.

                                    I accept whatever they did was unethical but i hate to admit it was not illegal.

                                    If you do not see any appreciation, it is because of the recession...Suppose one would have got some premium today.. he would have taken all the credit for a smart investment..

                                    I received a letter from DLF that my apts in Sector 86 has been changed from PLC to Non PLC location which means that I will receive some back unit.
                                    I called their office asking for the details that it is not acceptable and can not change the delivery date just like that.

                                    Mr. Vikram, my case is not related to recession, but to the condition agreed during the booking. I have paid a 400 PLC for swimming pool and club facing as shown in catalogue during accepting the offer in April-May 2008. The floor and the plc was the sole reason of accepting the offer, later on in October 2008 discovered in buyer's agreement that the layout is changed and my apartment is not facing to pool and club and I asked DLF either to full fill the booking condition or cancel the booking as per booking clause and yet I haven’t signed the agreement.. but they smartly denied.                                     Today, I have visited Sec-86 and there is no construction activity at all. Sec-86 is 4km from Heritage Resorts (which is on NH-8).
                                    Sector 90 is 14km from Hero Honda Chowk.
                                    Yesterday my family visited sec 91 site. Construction is not started at all... One guard told that DLF don't even own that piece of land and there is a dispute going on. DLF promised that construction will start in January, which is about to end.
                                    Hello Future neighbours. Let me make some points clear. Although I cant give any official guarantee, but i m very much confident that those who have signed the contract with DLF wont b duped.
                                    1. DLF admits that there is a delay in starting of project. They will start with sec. 90, then 91 and then 86. There were problems in aquiring the land and documentation process. In 90, the project is already started and its not a whitewash. In 91 it will start in feb, and in 86 by mar end.
                                    2. The real allotees have already received the contract and they had submitted to dlf. DLF is in process of registring that contract and they expect to give the customer copy in feb.
                                    3. DLF is maintianing correspondence with customers and sent letters indicating that the project has not strted yet, but they commit to complete it in the specific time. Even this condition is marked very clearly with in the contract.
                                    4. Its my personal opinion, in comparision with other builders and projects going in gurgaon, DLF is doing better. I wont name other builders, but others are even worse. Friends, lets have faith in our builder and wait.

                                    When i read the text of other people, i realized that other people also felt equally conned. I bought DLF on the premise that the per square foot rate is quite low, but charging such a huge PLC is unhear of. And that also, without mentioning it anywhere on the form. All of a sudden with a PLC of 500, the cost of the house ballooned and it looked like an unprofitable investment.
                                    All through i felt that DLF being a foremost buidler will be ethical. But it now seems that being bigger makes DLF a bigger thief.

                                    I sincerely believe that we should form a committee and take up the case strongly with DLF.

                                    So far I dont feel I am being duped. The concern i have is different from other people - not about INTENT of DLF but state of DLF's monetary health and ability to dleiver. Big Question - Are most people paying up installments on time? I have paid around 50% of the value. I am hesitant to create trouble or delay/hold further payments as I am contractually bound to pay interest otherwise. The worst I see is about a year of delay in possession. So i dont mind continuing to pay the whole amount. So the million dollar question - Do others think like me (not counting those who have been duped but the majority of others who have no other reason for worry except cash crunch and delay risk)?
                                    It is indeed surprising that even after a year of Booking DLF is sitting on almost INR 250 Crores it has accumulated from around 1000 flats booked in Sec 90.

                                    DLF has the audacity to demand more interest free money it desperately needs to funds its operation from gullible people like us and few o[censored]s just because of the false reputation of the company are choosing to question our own instincts. This is a fact that the company is struggling to maintain the cash flows and it is using our money as advances rather then putting into the project it was paid for.

                                    I think before the situation really get out of hand and we are sent the cancellation letters, we need to seriously approach the company and make it accountable rather then letting it send us threatening letters. The delay in remitting the recent instalments from few o[censored]s has been only because the intentions of the company in honouring its commitment seems questionable off late. We all must make DLF pull up its socks now.
                                    I think the main issue that we should be worried about is whether DLF would complete the project within the timeframe that they have committed to us and with all the infrastructure development that they have promised. I think, the first and foremost step we need to take is to ensure we have a common forum and voice to be able to talk to DLF about our concerns from time to time. I am a late entrant to the group and so not sure if such a group already exists. They might be lax in responding to individual queries but to a representative of a group, they will definitely be more responsive.

                                    Also, I think we should all force DLF to make the payments construction linked. As of now, we are paying based on the payment schedule irrespective of the construction progress which is not fair and infact not allowed by law. The banks should be lending money only to the extent of construction completed. However, because of the builder-bank nexus, they are able to influence the banks to lend money to people to pay DLF and in the bargain both the banks and DLF are benefitting at our expense.

                                    I think, this is a very reasonable and winnable cause that we should all fight for. That would be a big relief for us atleast from the interest costs. Please do let me know if all of you are game to taking this cause up with DLF. I also heard from reliable sources that DLF has agreed to such demands in the past to change the payment plan to construction linked.

                                    Lets take up this cause
                                    Since there are more then 1000 flats, some have booked them genuinely for personal use, some for investment and some for re-sale, making forums or groups, choosing representative is not an easy task and very difficult to work out. Better we all should b together, and try with different approaches but with one goal. If someone gets a breakthrough, rest follow it. We all should concentrate on:
                                    1. Is the project still on.
                                    2. Whats the current prediction of finishing of the project.
                                    3. Since all over, the prices are slashed till 20%, are we going to get the benefit of it.

                                    If we get some convincing answers from DLF, we should continue from the project, otherwise we should think of Plan B. Soon, after complition of one year, we will b free to sell our bookings. If by the time, DLF is not able to give any genuine response, we should withdraw from the project.

                                    I booked a 3Bed Room + S Room apartment in the aforesaid project on 16-Feb-08. I visited the site on 07/02/09 and even after a year there is little progress on the construction site. Only some excavation has been done so far at Sector-90 site, which is far behind what could have been done till now. No work has started at Sector-91 and 86 sites.

                                    This does not augur well for my confidence in your ability to deliver the project on the promised date of Feb-2011. I am disappointed that while I am honouring my commitment of releasing the payments to DLF on time, DLF is not living to its promise of giving me the possession of my aforesaid apartment by Feb-2011. While you have sent a letter to me re-assuring that I will be getting the possession in Feb-2001, this assurance needs to be corroborated by the ground reality else it has no meaning for me and fails short of your intended purpose of boosting my confidence in your delivery capability.

                                    As a customer, who has given my hard-earned money to DLF for this proposed project, I have the right to know certain aspects of the project.

                                    Please enlighten me by providing answers to the following questions.

                                    1. Why work is happening at a tardy pace despite the fact that I am paying you the money in time?
                                    2. Where and how the funds collected for this project are being used?
                                    Looking at the project status so far, it does not look like that the funds collected against this project are actually used for this project. Where is that money being spent?
                                    3. Where is the plan leading to possession in Feb-2011?
                                    In reference to your letter stating booking date i.e. Feb-2008 will be treated as agreement signing date and for calculation of penalty etc. I want to see your current working plan that leads to possession in Feb-2011?
                                    4. Why not switch to construction-linked plan?
                                    Mere assurance that the possession will be given on time is not enough. If DLF has confidence in its delivery ability and wants o honour its commitment then the balance payment should be changed to construction linked plan. You have all the intentions to complete the project on time so should not make any difference to you anyway.
                                    5. How about passing the advantage of lower input costs to your customers? Some other developers have already done this.

                                    The world is going through a financial turmoil and your customers also exist in the same world. Not getting the possession by Feb-2011 will mean that I will have to pay EMIs for an extended period, adding more financial burden on me. What measures can I expect from you as a customer so that -
                                    a) I retain my confidence in DLF as a reliable brand
                                    b) I am convinced that the project will actually be delivered on time
                                    c) I continue to believe that the pricing (despite change in market conditions since booking date) is still competitive.

                                    I appreciate it is a difficult financial time for everyone. The current financial turmoil is also an opportunity for DLF to build a stronger brand. It is high time to live your values of ethical and professional service and retain confidence of thousands of customers like me.

                                    1. Work is as per schedule. They are waiting for Enviorment Clearence. We are at present on # 126-128, but hope to get it soon.
                                    2. Funds are in safe hands with us and will b used only for this project.
                                    3. WE confirm that the date of booking will b treated as date of agreement, and this has been conveyed to you in written and clearly.
                                    4. This project is not Construction linked and DLF is not going for such type of projects anymore.
                                    5. We calculated the price considering all Ifs and Buts. We wouldnt have raised the prices, if the scenario was vice-versa.

                                    Actually my point is we should have some faith in DLF and give them some more time. By getting nervous, moving to court or any such things wont effect anyone and wont resolve the situation. Just b patience and think calmly. Anyways by writing any letter, they will respond equally in a letter. Its just a piece of paper to make us calm and feel safe. Lets dont get demoralise, try to understand the situation and have faith in DLF.
                                    I know from my experience with DLF that it plants its own people in various residents/customer forums and they try to create confusion and keep working against the group. Looks like we have got one in this group as well.

                                    Anyway, welcome Mr Goel, you don't want us to get demoraslised until we pay the entire cost to DLF. We should get demoralised once we have paid the full money and are in wait-mode for n no of years. The entire DLF Phase 5 has developed in last 6 years and I have a fair idea of how much time it takes to complete a project of this scale. Please also enlighthen us by telling the names of projects they have delivered in two years time? Do you think we are fools to believe in a letter sent by DLF?

                                    DLF has already agreed to change payment plans of their commercial projects (time bound -> construction linked). Please also read the DLF Chennai story on moneycontrol. There will soon be a story for Gurgaon as well. Some o[censored]s who interact through other means will soon be filing a legal suit so tell you bosses to be prepared for some sweet time ahead.                                     DLF answers can easily be countered by following answers:

                                    01. Work is not at all as per schedule. Even the excavation work is not complete. We had recieved a letter few months back that we shall be invited for Bhoomipujan before they start the work, which to my knowledge has not been done.

                                    02. The Environmental Clearance(EC) application was filed in Aug08. DLF needs to explain if it was serious in starting the project, why did it filed the application so late. Moreover starting the project itself is not linked to getting the EC, the other commercial projects DLF is doing and are almost about to be complete dont have EC yet !

                                    03. We believed so far that the funds are in safe hands and thats why we have been paying, but off late there has been no progress at the site and there seems to be no firm plan as well. Each month we are told that the construction shall start next month, which shows that DLF has no firm plan to get this project going. We need to be satisfied in regard to the usage of fund for the purpose by actually seeing it happening.

                                    04. The DLF has got the leeway just becuase it is not construction linked and we want to safeguard our interests by converting into one.

                                    05. DLF has this specific clause in the agreement, through which they can raise the price in the event their cost go higher at a later stage, so why shouldn`t we also get a similar benefit. Especially when the asking rate for the ready to move in flat in main Gurgaon now is at around Rs. 3000/- psf. How does DLF justify Rs.3000/- psf it has charged from us at far off place.

                                    The point is not to complicate the matters by taking the matter to the court but representing ourselves & getting a fair deal. DLF in any case has done injustice by charging uniform PLC !

Spend rs50000 for each and hire VERY GOOD lawyer (no free lunch). Sue the DLF company. Take the court notice to media and publish in the internet. then YOU GET JUSTICE for hard earned money.

                                    I visited the site myself yesterday and noted that no work is happening at the site... Machines are there but all at standstill... other thing is when I was trying to find out the site, people there say that its not gurgaon and they dont know where is Sector 90 and call it Hatyapur or some other village...

                                    Unfortunately I didnt read these articles here before going there otherwise I would have enquired more on why the work is not happening etc... Actually me and some of my other friends have booked these apartments taking the DP plan and the reason for the same was because the other option was time linked and it was only DLF's repo bcoz of which we all went with the DP... Now reading all these articles here it appears that we need to raise some voice otherwise nothing is gonna happen... Its getting really scary boss I m telling you...

                                    I have come up with a list of questions/measures that we will be raising with DLF on 21st. Please read through and give your suggestions, if I have missed anything. I know DLF insiders access this site and they will also get a preview of it but we should not be bothered by that. I will seek an appointement today for 21st and will post the timings etc on this site so feel free to join us.

                                    1.Current payment status is that customer has paid 50% of the total cost of the project to DLF. What is the current construction status in terms of %age completed of DLF New Town Heights?
                                    2.Construction update – There is no progress made for the project in the last year, we are extremely worried about whether or not we will be getting the project in time. DLF has repeatedly assured us verbally and via letters that everything is as per the ‘plan’ so there should not be any hiccups in sharing the plan with customers. We want DLF to implement the following so that we, as a stakeholder, can track the progress of the project.
                                    a.Project Plan - DLF provides a month-by-month project plan between today and the possession date, which will clearly state what we will be able to see if we visit the construction site in that month/year.
                                    b.Plan should have a targeted ‘%age complete’, in terms of overall project delivery for that month
                                    c.DLF sends us monthly update on target vs. actual ‘%age complete’ of the project.
                                    d.Since we have already paid 50% of the cost, we will not be releasing any further payment until we see actual ‘%age complete’ as 50% on the plan.
                                    e.DLF has not been able to utilize the funds already paid by the customer; so DLF gives us early payment rebate @13% for the payments already received other than the booking amount.
                                    f.DLF discloses to the customers what all government approvals are required for the project and their current status. What impact these approvals will have on the construction i.e. are they show-stoppers or can construction can happen in parallel
                                    g.DLF will not ask for further payments till the time all the show-stoppers items are resolved.
                                    h.DLF has got great infrastructure in place to serve its customers. No customer has ever missed to receive payment reminders so far. The same infrastructure can be used to send the above requested updates to the customer on monthly basis.
                                    i.Penalty clause for late payment charges by DLF should be increased to match with late payment charges levied to its customers. Since DLF is 100% sure that the project will be delivered in time, this should not make any difference to them.
                                    3.Input cost has come down since we made the booking, lower steel and cement prices; DLF passes the benefit to the customers on this account as well as the reality market sentiment. Like Bangalore, Hyderabad and Chennai projects, NTH Gurgaon prices should be reduced by 25% from retrospective effect so that both new and existing buyers can benefit.

                                    There is a clause put in by DLF that we are prohibited to sell the flat within one year from the date of agreement. We must get this deleted as it effects the Liquidity of the subject asset for all o[censored]s. More so when the property is just in papers as of today.
                                    Guys lets really shake the management by delaying the payment. If 41-42% paymnet could not kickstart the construction how come this next set of 7% going to impede their construction plans(if they are serious on that.)

                                    Global economy is weak and the entire world is asking for restructuring of payment due (probably DLF is doing the same with some banker right now), then why not should we ask for the same.

                                    some components need to be deffered to the stage of possession.

                                    Also construction link plan conversion would be a very apt proposition. We cann't keep commiting our money into something where the management is not even sensitive to its consumer needs.

                                    DLF itself estimated the construction time line to be 3 years originally. Howcome now they can claim to finish the construction in 2 years flat now. Either they were fooling us than or they are doing it now. Add to it I would have apprehension to the quality of construction they are going to do if they are to really deliver(laughable), even if delayed.

                                    Guys there is some serious money involved. I guess we need to culminate this forum into some effective tool for our own rights. Logical conclusion of the same would be that we approach theu collectively to pass on the right kind of message.
                                    Its very distressful to note the Cheating by most of big developers like DLF or Jaypee Greens.

                                    I also have similar experience with Jaypee Greens, Greater Noida project. After receiving 10% of booking amount (Rs 7.5 lakhs or more for each flat) for their startcourt flats, they have completely altered the flat layout, in such a manner that all the advantage of Golf facing apartment (sold at whooping Rs 5000 per sqft+PLC) have been lost. When we took up the matter with them rejecting their offer of allotment, they have been threatening that all the money paid by us, as earnest money shall be forfeited, if allotment is not accepted.

                                    These developers have not only joined hands with brokers to dupe unsuspecting customers by making them to sign very cunningly designed booking forms, which can not stand even single legal trial in court of law, if challenged. As brokers get as high as 10% commission (atleast in Jaypee case), you can not expect them to be on your side. Their so called customer care managers are nothing but cheats, well trained to pass time and discourage the customers. This helps them to use customers hard earned money as long as possible. Most gullible customers are NRIs who are unable to take the matter to the court and follow-up due to long drawn court proceedings.

                                    Its high time that we join hands and file PIL against such cheating developers and teach them lesson.

                                    I have decided to take the fight against such cheaters to the court, no matter how much time or efforts it takes. We must come forward and ensure that no further unsuspecting customers are robbed of their hard earned money by these organized real estate cheater gangs.

                                    d) Price reduction - construction costs are cheaper by 25%

You are taking all this very personally by accusing me like this in public. I asked you to kindly correct your comments about me, since they effect and damage my reputation. But since nothing has been done, I am bound to write this message. Guys, if someone has any personal issues, write to me directly. I have signed my name completly and not Anonymously. I wrote various messages and the last one was based on the facts and relpies which I was getting from DLF. Anyways, I dont want to create any confusion and misunderstanding between us.                                     I was planning to book DLF New Town in Bangalore and as mentioned above I was approached by an agent instead of DLF. Since I read a supreme court judjement in a newspaper that consumers are responsible to see the terms and conditions set by the builder (the case was with reference to DLF only) I wanted to see the type of complaints posted by people with respect to DLF before taking a decision.
                                    The first condition itself says that if any layout plan changes, the appropriate PLC charge would be applied and the Earnest money deposited would be forfeited if the same is cancelled (the primary complaint posted above).
                                    The agent met me yesterday and is forcing me to block the flat immediately and asking me to pay 3 lakhs as Earnest Money and trying to fool by saying that an apartment what I wished would not be available if I delay.
                                    The only difference is that the payment is linked to construction instead of periodical payments.
                                    Thanks a lot for all the comments posted above as I am very clear on how to proceed with them, if they dont change these points then I will not book the flat at all. People can cheat someone sometime but not everybody everytime.
                                    I visited the DLF office on 21st Feb; however didnt find anyone to taking up this discussion with the DLF management. I was instead told by a sales manager there that an internal meeting is going on and all customers would be intimated about the same soon. Does anyone have any news on what happened that day?

                                    Hi Everybody,

                                    I have read in the Economics Times today that DLF has slashed the prices for the Project in Chennai and Bangalore. Is any body having information as the status of the prices for the projects in Gurgaon.
                                    Please update us on what transpired in the meeting and what are the next steps. I have submitted my membership today to join the group at yahoo- am awaiting confirmation from the group leader . An update today will help.

                                      For new issu of refund order I had send you IDEMNITY BOND on Rs 20 non judicial stamp paper in Feb 2008. But yet I dont receive any responce from you. So please send me the status.
