Ebay.in — conterfiet items are allowed by ebay, employees claim it's legitimate as long as it is mentioned in the description

I tried to buy a ML-L3 remote from ebay and received a fake counterfeit. I have attached the Item listing and ebay response and the support call I have with ebay. Ebay claims that as the item description specifies item is made in china so, it's ok to sell on ebay. I spoke two supervisors and both of them are answering that as the seller has mentioned that it is not original and made in china in the description it is ok to sell on ebay.
