Ebay.in — Faulty mobile phone (iphone 5)

We'd ordered a new iphone 5 from ebay and the product was faulty. The phone battery drains out in 2 hours. The product came sealed pack but it never looked like a new phone. For last 20 days we've been writing to ebay for return|refund but there is no reply. So many mails, calls and tweets but no reply. Every time we get some default message but there is no one to listen to us.
