[Resolved]  Ebay.in — Selling product without accessories and with a wrong listings from the seller

I had purchased a cell phone samsung galaxy on nxt 32gb online through ebay on the 13/04/2017 using my credit card. Since i had an intuition that something was not right, i called back ebay customer service and spoke to their customer service representative that the listing had the heading 32 gb whereas the detail listing had 16gb and also had the listing for a completely different cell phone that was for motorolla. The customer service representative checked and admitted the listing was wrong and decided to place my call on hold and speak to the seller listed as istore.14 (Based in tamil nadu). So i requested the customer service representative to enquire the seller if he was providing the product with the complete accessories such as the sim ejector pin and the headphone and requested the representative to request the seller to cancel the order in case the seller was not providing the the complete accessories mentioned. So the representative spoke to the seller placing my call on hold and after few minutes the customer service representative got back to me and informed that the complete accessories was not being provided and the seller admitted there was a mistake with the listing and would immediately correct the listing and asked me to refresh the page, which i did and found that the listing was updated and also mentioned that the headphone was not being included which initially did not. So i confirmed to cancel the order and refund me the amount i have paid again since the customer service representative did not discuss about cancelling the order with the seller. The customer service representative tried getting in touch with the seller again but since the seller was not responding, he provided me with the seller's cell phone number and assured me since the product was not shipped yet, it is possible to cancel the order. So i hung up and called the seller's number several times but the seller did not respond even once. Since i was concerned, i called and spoke to several ebay customer service representatives and all of them assured me that they will get in touch with the seller and request for cancellation and since the product was not shipped, they would help me out. After two day the representative called me and informed that the seller was not responding and the product was still not shipped and they assured me they would help me out. On the 5th day the parcel was received by one of my family members in my absence.in the evening the customer service representative followed up with me and informed me not to receive the product since the product was shipped and the seller did not respond and i explained that the shipment was already received. So then the representative sent me a link to raise a claim for the refund mentioning the reason and the mode of payment i would like to receive the refund. After 5 days i received a call from ebay claims department and they mentioned they were reviewing the issue and someone would get in touch with me within 48 hours. I received a call after 3 days stating that the listing was clearly mentioned about the accessories and that the seller would not provide me the complete accessories and cannot process a refund. So, i argued that i have explained the situation time and again about what happened on the 13/04/2017 to several ebay representatives and i am not getting any justice related to my request and being played a blame game. I even requested the representatives to pull out the call records for the conversation i had with the representatives on 13/04/2017 to get a clear picture of the issue since they have a facility of recording calls for quality and training purposes, even after my detailed explanation. Instead i got a reply from one of the representatives saying i should have checked the details before ordering and was trying to point out that it was my mistake. So, i informed that i had checked the listing and i was the one to point out the incorrect listing and that the listing did not mention about the accessories being not included. But still the representative apologized and kept on stating that they will not be able to refund the money. I requested to speak to the supervisor and the representative placed my call on hold and got back to me only to say that the supervisor was busy and would request a callback from the supervisor as soon as possible, which i had never received even after the 5th day of my complaint. So i have decided to raise a complaint and as a customer i request you to please take up the matter so that in future no other customer would suffer from online fraud dealings and also would make ebay a more responsible and consumer oriented company and practice ethical business that does not penalize the buyers or the sellers.
