GM Infinite — Request for Booking amount Refund - Flat Booking No. A 3147 in -GM Infinite

Dear GM Group,

I hope this message finds you well. On 26th October 2023, my wife, Aditi Agarwal, and I booked Flat No. A 3147 in your "The 100 Percent Life (GM Infinite)" project in Bangalore, for which we paid a token amount of Rs. 50, 000.

Regrettably, we find ourselves in a situation where we are unable to proceed with this project and, therefore, wish to request a cancellation of our booking. I promptly informed your Sales Representative, Mr. Yasar (+91-[protected]), on 27th October 2023 about our decision and asked for a refund of our booking amount. Unfortunately, Mr. Yasar informed us that your company does not have a refund policy for cancellations.

It is essential to note that, as of this date, we have not entered into any formal Sale/Purchase agreement with your company. According to the RERA (Real Estate Regulatory Authority) act, the following regulations apply:

1. If the agreement is registered, the builder has the right to deduct the booking amount from the paid amount.
2. If the agreement is not registered, buyers are entitled to a full refund, even if there is a clause in the agreement stating otherwise.
Considering that we requested cancellation on the very next day after booking, and as there is no agreement in place, we believe that we are entitled to a full refund of the booking amount.

We kindly request you to review our case and confirm our eligibility for the full refund. Failure to do so will leave us with no choice but to seek legal recourse by involving our advocate and lodging a complaint against your company with the Consumer Court and the Registrar of Cooperative Societies.
