HTC — Not returning my mobile phone back

HTC tech support is the worst tech support service available for any mobile services...I have my cell phone with these guys for the last 2 months..and they JUST WONT RETURN it. Its like...stealing your phone in a decent way..!! the tech support wont give any details..they wont transfer the calls to the supervisors...the service center will NEVER pick calls or call back..I need help to get my cell phone back. Please help me out here. Also, please tell me if there are any legal actions that I can take to make them pay for my loss of money and time in trying to get my cell phone back...
