HTC — Phone cracked due to overheating, company denying responsibility even when it is under warranty sighting that it is a physical damage as a reason

This is kranthi. . . My htc desire 816 dual sim mobile was purchased on 06 / 09 / 2014. . .
My mobile was very good in terms of its looks and peformance. . . But had few issues that rarely annoyed me. . . I. E
(1) my earphone used get damaged easily even after taking lot of care while using them. . .
(2) my device used overheat if i used internet on a 3g network. . . Even if it is for half an hour. .
Last week i was browsing for about 3 hour continously. . . My handset got overheated. . . But this time it reached quiet
Dangerous temperatures. . . This heat was dissipated by cracking the touch panel. . . Thereafter my touch screen was
Not senstive anymore. . . And i was unable to access my device.
When i explained this to customer service centre at ameerpet in hyderabad. . . They saw it superficialy and said it is
External damage. . . And it is very rare that you can get your screen cracked due to overheat which are exeption and
Hence you cant claim waranty for its repair. . . Which may cost me around rs 5600 even when my mobile is under
Warranty period till 06 / 09 / 2015.
When i contacted the htc toll free number and informed this to the person there he said the only help
He can do ts to arrage a discount he said the waranty is invalid if the mobile undergoes physical damage. . . But i

Phone again superficially told blindly that its a physical damage. . . When i protested how can say this with out prper
Inspection of mobile. . . He startedv boosting that he is very experienced. . . He is a htc 816 engineer. . . And said a htc
Mobile cant get heated beyond 18degree celsius. . .
The service engineer were of poor quality expertise and technical knowledge that their way inspecting and
Concluding was same as that of a layman. . . Even a ordinary person who knows basic 7th and 8 th class physics can
Easily diffrentiat between a crack that was directed inside out and that which is dirct outside in. . .
At last after a few more calls to the tollfree number my complaint was tranfered to some other person and was told
That you will be contacted soon. . After two day a person from htc called me. . He reiterated the same words. . . After
Explainbing him the whole thing again he asked me post snapshots of my mobile which iam enclosing in this
Mail. . .
Thus i was left with no other option to go to consumer court soon. . . And planing to start bloging over the
Overheating and exploding of htc desire 816 dual. . . And the company denying waranty showing physical damage as
A criteria for invalidating a waranty. . . Even when the explosion happened due to excess overheating inside the
Device. . .
How can htc deny responsibility if the device explodes due to overheating within waranty period ? Showing

I dont know how htc gona justify its stand but i have faith in our legal system hope they will resolve the issue if
