HTC — Service centre not returning my mobile

I used to own an HTC desire eye handset, which suddenly crashed while working and the touch screen didn't seem to work then. I submitted my phone at the nearby service centre (actually a collection centre because Varanasi(U.P.) doesn't have a HTC service centre), they told me that it will take maximum upto 15 days for my phone to repair and return, then they extended it to 20 days, and then to 29 days. I talked the collection centre guy and he said, "Sorry sir, We can't help you in this regards." and suggested me to call HTC customer care no.[protected]. By now I already had a one hour long conversation with those clever fellows, the only thing they were able to do was waste my time and extend the date everytime I call. I am so fed up right now because the phone costed me 40k and the honorable HTC guys really doesn't seem to give a damn. I even suggested them to provide me a new handset but they refused. I just want to know will I ever get back my phone in this birth or not?
