Report on irregularities in respect of petrol pump outlet awarded by indian oil corporation ltd (Iocl) in 1967 at p. O. Balipara, distt sonitpur assam to m/s goel trading company (Gtc).
Iocl guwahati let out petrol/diesel pump agency to mr goel trading company (Gtc) in balipara, rangapara road, distt sonitpur assam in 1967. At the time of letting out the agency, my father mr chatursen jain signed as a partner of goel trading company. On lodging an rti iocl informed me that they have no partnership deed of m/s goel trading company. Mr chatursen jain expired in 1986 death certificate provided to iocl guwahati). Also provided to iocl was evidence by way of passport which showed me as son of mr chatursen jain. Since the death of my father mr chatursen jain, a person by the name of mr ravinder kumar jain (Posing to be son of mr chatursen jain and one of the partners of m/s goel trading company is signing the papers and a person called bimal jain (An independent businessman in nearby town tezpur), is collecting the supplies and selling through the above petrol pump. As far as iocl is concerned both are unknown parties to them as they have no record on either of them since the agency was let out in 1967. I am a partner of m/s goel trading co (See partnership deed already supplied to iocl) since 1963 together with mr ravinder jain and my father mr chatursen jain, however denied any benefit from sales from this petrol pump, as iocl guwahati accepts signatures of mr r k jain to release petrol/diesel supplies to mr bimal jain and i come nowhere in the picture. Petrol pump has been leased out by mr r k jain who has been living in delhi for the last 25 years to bimal jain who lives in tezpur assam and pays monthly rent to r k jain. Since mr r k jain signs the document he keeps all the rent to himself. Recently mr ravinder jain fraudulently sold the petrol pump land which belonged to my father mr chatursen jain to mr bimal jain.
Therefore, clearly neither this petrol pump is being operated by goel trading company nor it stands on its own land. This is in breach of iocl rules and regulations governing running of petrol pump outlets. Mr pegoo, dy general manager, retail sales ([protected]@indianoil, in) based in east point towers, bamuni maidan guwahati 781021 was made aware of this on several occasions in the past. However, it soon became apparent that he is "hands in glove" with mr bimal jain and therefore making this illegal business possible. When i approached mr pegoo on 4th december 2017 in his office personally, i was told by him that being an nri i cannot hold partnership in a iocl franchise namely goel trading company's partnership. I am infact overseas citizen of india (Oci) card holder (Copies of oci supplied to iocl already), which different to being an nri. According to advice i have received from counsel general of india (Cgi) in sydney, australia he confirmed in writing to me that oci card holders are entitled to do business in india. A copy of this email with a request to contact cgi directly, if necessary, was conveyed to mr pegoo.in summary, not only is this petrol pump being runs against iocl rules due to corrupt conduct of mr pegoo, but he also denies my right to be a partner in goel trading company.
On my reporting of this matter to prime minister’s office as a case of rampant and open corruption iocl suspended the supplies to gtc vide their letter dated 30.03.2016 ref: rec/gdo/ro/15-16/gt/2 issued by mr d. Datta, chief divisional retail sales manager.
Mr r k jain then went to tezpur court and managed to get an order for temporary restoration of supplies. Mr r k jain also sought an order from tezpur court to accept a partnership deed with him and his younger brother narender jain as partners of gtc, which was never registered. This is matter is pending with the court. I as a partner of goel trading company at the time of award of dealership by iocl in 1967, i filed an application in tezpur court for impleadment as a party in this case, as a son of mr chatursen jain (Proof of passport provided to iocl) as well as a partner of goel trading company (A copy of partnership deed provided to iocl). Tezpur court accepted my impleadment. However, mr r k jain has challenged this in guwahati high court and obtained a stay order very recently.
My complaint with iocl is:
1. Due to corrupt conduct of mr pegoo, iocl did not appeal against temporary relief to r k jain who had been fraudulently taking supplies and is encouraging mr bimal jain and mr r k jain in their illegal affairs.
2. Mr pegoo maintains that since i am an oci card holder i am not entitled to do business in india, which is quite contrary to ministry of external affairs guidelines/rules and regulations governing oci card holders. This is when all along he had been taking me as an nri and heard the word oci first time from me.
3. He basically wants me to just “get lost”. My discussions with him made that clear. Clearly, he risks losing his regular flow of income from bimal jain through his illegal affairs.
4. Mr pegoo has been supplying petrol to gtc’s petrol pump based on r k jain’s signatures without knowing who he actually is. Supplies were actually stopped by mr d. Dutta though mr pegoo claims credit for it to escape corruption charges.
As a partner of gtc i am more than happy to comply with requirements laid out in iocl’s letter dated 30.03.2016 ref: rec/gdo/ro/15-16/gt/2 issued by mr d. Datta, chief divisional retail sales manager for the recommencement of gtc’s petrol pump to operate it in a fully legal way complaint with iocl’s requirements.
My request to you therefore is
1. To investigate the fraudulent manner in which mr pegoo of iocl, guwahati has been allowing gtc’s petrol pump to operate for decades through his corrupt conduct and take necessary action against him.
2. Restore my right as a partner in gtc who never relinquished his partnership in gtc since 1963.
3. Take pro-active measures and either stop supplies to gtc with immediate effect or atleast lodge an appeal in guwahati high court to obtain a stay order on tezpur court’s decision to ask iocl to continue supplies to gtc temporarily, until they comply with requirements laid out in iocl’s letter dated 30.03.2016 ref: rec/gdo/ro/15-16/gt/2.
I can assure you that this action will speak highly of iocl as a just, fair and transparent organisation to be proud of.
A complain to pmo’s office has been again lodged by me on 11/12/2017 and has been registered vide registration number pmopg/e/2017/0626321.
