JustDial.com — Missold Contract by Just dial Executive (Vipul Oza-Ahmedabad)

Dear Sir/Madam,

I am introducing myself as the proprietor of Go Digital Go social. I have been cheated by a well known advertising company, just dial through its representative ( Vipul Oza -Ahmedabad)

One of their Tele caller named ( Himani Makwana ) was continuously following up for registration of my firm on Just dial platform and I was keep saying that I do social media marketing myself and we generate our own leads so we do not need this service at the moment however as she was doing good follow up for the sales so in good faith I agreed to meet their executive to opt in for the service as I was told it is just 2500/ per month.( don’t remember exact amount but it was approx. this amount )
In the month of July their executive ( Vipul Oza ) came to my office and suggested me for the registration so I told them I will try for one month and see if it is good then I will continue so he said we take two month advance payment so agreed to that and given cheque of Rs.7080 ( he suggested me to go for the entire state plan so opt in for their higher plan ) and I clearly mentioned this advance is towards this two month service and that after two month, I will cancel and stop using this service so he said okay sir I am there to do that for you, you do not worry for that so I just trusted him.
He never mentioned that the money taken is against one year contract and I multiple time I have verified with him that I do not have to pay for first two month as I have paid Rs7080 so he agreed to that. I never signed any form where it is mentioned it is one year contract and I was never told before taking cheque that it is one year contract.

After Registration I never got any confirmation from their side for the contract as they keep sending promotional text every day how to use JD app and create catalogue.
After 3-4 days I got call from their side to confirm that I enter for one year contract and I was shocked to hear that as I told him never agreed to that as I given money for two month service so ask him to cancel service immediately. ( Just to mentioned we did not use service at all by the time I got this call and money was debited )

After that I call Their sales executive ( Vipul Oza ) and told him that he never mentioned about contract so he was asking for the what is issue in the service and I was asking I am not concern for the service I was keep asking for the contract part and why he did not share any information for the contract and why there is no document signed for the contract so he mentioned that you signed ECS form. ( Yes I signed because he said that if you want to continue after two month for that it is needed to set up ) so that it seems very much fair to me and I signed.
Himself or tele caller never shared any information for the one year contract part to me before Taking cheque or got call from contract the verification team from their side
So I raised complain for the contract cancellation through their online complain platform so I got call on my personal number ([protected] ) on[protected] one Lady caller ( I forgot to ask name ) and I explained all the situation so she said she will process cancellation and as I mentioned that it is okay that you charge for one month even I have not used their service and refund for the one month as there is no point of having argument and further discussion. So she said I have raised to concern team and they will process the same.
On[protected] I got call again from lady caller ( she identified herself as Kiran Parekh) and wanted to discuss about the situation so I mentioned that I already got confirmation from them yesterday so she said there is no such cancellation request raised.
So I also explain entire situation to her and then I also took their Executive ( vipul oza ) on conference call to confirm that and I clearly ask for the provide details where he mentioned for the contract so he keep saying that you signed ECS form. (Which does not mentioned that it is towards any contract ) he also agreed on call that he did said that he will process cancellation if I want to while taking that cheque after using two month service as I paid for two month.
While discussion I came to know from Kiran Parikh that one Emi was already debited from my account on 16/07/2022 of Rs.3540 ( which was totally news to me as I was just though that two month money paid) So came to know that the amount I paid Rs.7080 is advance which get used for last two month of the contract ( This information was never shared by anyone till date ) . Surprise to know that so I ask for cancellation of the service which I have not use at all. So they informed me that bill for the next month is already raised and money will be taken for next month as well. ( so basically I have did not used their service for and they have sold these service saying two months money is received which will be used for the first two month and now one month money is already taken and they are bluntly saying that they will also charge me next month so it is surprising that they did not provide any service and they are mentioning that it is their process and they will charge for the next month as well )
On conference call,
Their executive ( vipul Oza ) was so blunt on conference call that he asked me to provide the proof of recording that he did not mentioned contract while he was in my office so I just want to remind him that here wrong doing was done from his side and I am here who is losing money and if I knew this kind of things can happen then of course I would have done recording for him. but to satisfy him I want to mentioned that my business partner was in same office as well as my other 5 staff member ( sales team ) and they can verify that what was discussion happen. The reason I mentioned all this here as they were shocked to know that big company like just dial employee selling like this and we being small business always follow Ethics and look for the service aspect first and then payment.
Counter to his proof question I only asked one thing Please provide me any proof where I signed for contract or had discussion on call for one year contract and I agreed to ….No Answer for that at all. They said they will check recording and let me know no update from them yet.
Just want to mentioned, I found one text on my number where is mentioned to complete KYC for activation of the contract by uploading proof which I never uploaded so question is how without that confirmation or proof being uploaded this contract been activated.
This contract is totally missold to me and i simply wanted to cancel that and refund the money as company can take money only if there is any service been provided to customer. Here No service provided at all.

I have sent them 3 reminder on email for issue and every time I got auto reply from them that their team will coordinate with me in 24-48 hours but it is been more than 10 days and I did not hear from them.
Just small reminder for Just dial company, It is not about money but it is about the doing things right way, Customer make company big not fraud Employee who just for their own benefit or target sell by gaining trust and providing all the wrong information and commitment to customer.

So please look into this and help me find resolution for this.

There is no response from the Just dial even sent many email reminder and register complaining here, On the contrary they have again taken money from the account which they have promised that ECS is been cancelled and i have text confirmation as well for the same and still taking money so it seems that they do not care about whether they have provided any service to consumer, they just seems to trap consumer in their own fabricated and complicated contract which is sold by their staff in totally wrong way ( which i have found common practice followed by all of their staff across India as there so many complain register like this ) .

So definitely need explaination for this and i am also going to register legel complain for this as it seems that they just do not care at all and keep doing this kind of practice which has to be stopped.

Please look into this and try to provide any resolution for the same from the fraud company Just dial.com
