[Resolved] Kaya Skin Clinic — denial of, treatment misleading advertisements and guarantees and unethical behaviour of treating doctor | |||||
I signed up for the acne 360 package with kaya skin clinic at alwarpet, chennai. I initially signed up for four sessions prior to which i was advised by the consulting doctor at kaya that i would see a reduction in the acne as well as acne scars. After my first two sessions at kaya, my acne aggravated and i could see new scars and black spots developing. I instantly escalated the matter to a senior doctor, who then advised me to consume certain oral medicines and only opt for the yellow peel. As advised i consumed the medicines and opted for the yellow peel. However there was still no reducing in the aggravated pimples caused by the treatment availed at kaya. On the 5th of april 2018, as advised by the senior doctor, i fixed up an appointment for a yellow peel treatment and explained the doctor why i only required the yellow peel and nothing else. I explained in clear terms that the other peels did cause for an aggravation of the problem and hence it was advisable for me to use the peels. The consulting doctor, then berated me and suggested that i had manipulated his words. I quote him "you are manipulating my words as if i had promised that the entire acne problem will be solved by four sessions". I then explained to him that as a doctor belonging to an institution, who had advised me to take this session, his behaviour was completely unacceptable to me and was beyond any sense of decency and medical ethics. I further explained to him as to how no reasonable person would have chosen this expensive session, unless otherwise promised certain visible and satisfactory results. I told him that i had only opted for this session because i would see visible results and quite to the contrary, i saw my problem aggravating. Refusing to engage in further discussion with this badly behaved and unethical consultant, i told him that i would meet the senior doctor regarding my concerns and that i would just want the yellow peel procedure to be performed today. To my utter shock, the doctor refused to perform my treatment and created a scene. I then told him that i wanted a written letter saying that he had refused to perform my treatment, for which he again exited the room and rudely refused to give me a written refusal. In connection with the above matter am filing this current complaint for medical negligence, under section 2 (C) (Iii) of the consumer protection act, for deficiency of service and for undertaking unfair trade practices within the meaning of section 2 (R) (1) (Ii) for promising that the service was of a particular quality when it clearly lacked the same. For the above grievances, i demand the rustication of the said doctor by kaya and a full refund of the fee paid as well as the continuation of an alternative treatment to reverse the damage that has been caused by the doctor. Further, for the mental agony as well as physical and irreparable damage suffered, a compensation of an amount of rs. 50, 00, 000/- Was this information helpful? | |||||
