We do hereby bring to public notice that survey no:141/1a where m/s. Kumari builders & developers had constructed an apartment by name kumari amaranthine in doddakannahalli - kaadubeesanahalli road is under dispute and the same has been in court by case wide number o. S.5718/2018 before hon’ble additional city civil and session judge at bangalore. We have submitted our prayer before the court that m/s. Kumari builders & developers encroached our land and built the apartment in our land, we will fight this in the court of law and we have full faith that justice will be served.

With good intention and to protect the hard earned money of the innocent purchasers who will be trapped in this project and running to court to get justice thereafter, as everyone knows the duration it takes in the court to resolve. Everyone who have purchased flats in this project please do recheck your documents, we have posted the flow of titles of this property, check the mother deeds and also take a print out of the same and consult your lawyers, we are astonishing; how did m/s. Kumari builders & developers managed to get legal clearance from banks? And other legal councils for this project? We also request the persons who want to buy think 100 times before you decide, we have given all the details of the titles like registered document number, registered dates etc., you can validate yourself by obtaining those documents.

The flow of titles:

This survey number 141/1a is my grandfather late sri. Kadirappa’s property, he purchased property wide registered document no: 4929/1968-69, dated[protected], in subregistered office, koramangala from one mr. Narasimha gupta, and mr. Narasimha gupta brought this property from late mr. Vabaiah and his family wide registered document no: 871/1968-69 dated[protected], subregistered office, koramangala, after purchasing the property my grandfather has not forwarded to get the revenue entries over the said property in favor of him, later he passed away, i preferred the written representation before the tahashildar, k. R. Puram, bengaluru east taluk that to mutate the mutation & rtc in my name over the said property, the tahashildar has initiated the rrt (Dis) proceedings on the all other title holders of the survey no: 141/1a of doddakannalli village vide rrt (Dis) cr no;14/2011-12. That after entire adjudication of rrt proceedings, the tahashildar has passed the order in my favour on[protected]. The tahashildar has given the reason on the order that he confirmed that my possession over the said property and the tahashildar has confirmed the title over the schedule property with the support of title deeds and spot inspection of revenue inspector. But, the tahashildar has ordered that to mutate the revenue entry over the land measuring i acar 20 guntas out of said property extent i. E., 1acer 30 guntas. To rectify this mistake we have failed the revenue appeal before the authority of assistant commissioner, bangaluru north sub-division, bengaluru vide r. A. (Be) no:218/2016-17 which is same pending for adjudication. Since the property was purchased in the year 1968 till today the revenue entries in sy no: 141/1a like mutation and rtc over the said property are in our name.

In between one mrs munithayamma purchased some land in sy no;143 and 140, this properties details are:

Mr thimmaiah has sold an extent of 1 acer 34 guntas referring sy no; 141, but aforesaid mr. Thimmaiah himself has purchased an extent of 24 guntas only in survey no:143, wide registered document no:629/1970-71, dated[protected] registered in sub-registered office, bangalore south taluk, without any base title deeds rectification deed in respect of survey number of 143 and land measurement, the mr. Thimmaiah has executed the aforesaid registered sale deed no: 12155/1988-89 dated[protected], over illogical measurement of 1acer 32 guntas in survey no; 141, in her favour even though he has purchased in sy no: 143 and the extent is 24 guntas. When he had purchased 24 guntas in survey no: 143, how can he sell 1acer 34 guntas in survey no: 141??

Another person by name mr. Krishnappa and his son gopalappa has executed the register sale deed no: 3347 /1977-78 dated[protected] in favour of mr. Nadupappa for the extent of 14 guntas in sy no; 140, the same mr. Nadupappa’s son mr. Ramaiah and her wife smt. Narasamma has executed the registered sale deed no:3364/1989-90 dated 12-06-89 for land measuring 13 guntas to mrs. Munithayamma by mentioning the survey no as 141 even though they have purchased in sy no:143. How can they sell in survey number 141, when they have purchased in survey number 143???

Mrs. Munithayama by fabricating and forging the documents she referred in all the documents that she has purchased in sy no:141 and new number is 141/1a, but she had purchased in sy no: 140 and 143, what she refers it is obsoletely false, commissioner survey settlement and land records (Or) assistant director land record - (Adlr) is the only authority to resurvey the land and make necessary changes in survey numbers, by their orders only this changes can take place in any documents, who is mrs. Munithayama to decide which number she has to put in her sale deed? There is no such order from any authority as on today but still without any base and wrong flow of title mrs munitayamma has obtained the total land measuring 2 acres 5 guntas in survey no:141, new no:141/1a of doddakannalli village. Even though she has purchased only 37 guntas totally in different survey number that are 140 & 143, from where did this additional 1acer 8 guntas come from where are the titles for this???. She had not purchased a single gunta in sy any; 141 or new 141/1a. From 1968 to 2011 as we have not forwarded to get the revenue entries over the said property in our favour, mrs munithayama have taken undue advantage and fabricated the documents by making entries in her favour which is illegal because she had not purchased any property in survey no:141 or 141/1a. She doesn’t have any order from concern authorities that survey number 140 and 143 have been changed to survey number 141 or 141/1a as of today.

In the strength of the mrs. Munitayamma has executed the joint development agreement dated[protected] in favour of m/s engineers associates private limited over the land measuring 1 acer 2 guntas out of her illogical flow of title measurement of 2 acer 5 guntas. There afterward on[protected] the aforesaid mrs. Munitayamma and her family have executed the four different sale deeds over the remaining land measuring 1 acre 5 gunts in survey no:141/1a in favor of sri. Narayanarathan patel, sri mansukh m patel, sri karshna bhai patel & sri arjan m patel vide registered sale deeds, thereafter mr. Narasimhulu, proprietor of m/s. Kumari builders & developers, has purchased the land measuring 1 acer 5 guntas from sri. Narayanarathan patel, sri mansukh m patel, sri krishna bhai patel & sri arjan m patel vide registered sale deed document no:inr-1-00982/2015-16 cd no:inrd 142, book-1 in the office of the additional/joint sub-registrar, indiranagar, bengaluru.

That, the above recitals regarding m/s. Kumari builders & developers flow of title is completely barred by law, and he is taking undue advantage of the pending adjudication of revenue documents in my name in the said property. Mr. Narasimhulu constructing and selling the apartments to the innocent people to cheat the public. We have failed a case wide o. S.5718/2018 dated[protected] before hon’ble additional city civil and session judge at bangalore.

As m/s. Kumari builders & developers constructing and selling the apartments to the innocent people to cheat the public, we are agriculturist and i don’t have any support from the local area. To bring to the notice of the public i have installed a board beside the property saying this property is under dispute and wrote our case number so that the innocent general public will be aware that this property is under dispute. The boards have been removed by m/s. Kumari builders & developers to cheat the general public to make sure that there is no such dispute in the property.

There is no other option left for us to save the innocent public from this builder, so we are complaining here to make aware to the innocent public.

One question. There was a case filled by you even last year which you never appeared before court and that case was disposed by the Honble court and then you filled fresh case. Any reason for not appearing in court ?? Also, What is the reason that you could not get stay orders on construction even after 2 years of construction commencement. Will appreciate your response. Just want to understand more.

This question seems to be posted by some person who is aware of the property problem since beginning and he must be a lawyer!

My answer is yes we filled the case in the year 2017 and it was disposed/dismissed by the court bcoz of council or the complainant was not present to the case continues for 3 dates, that was the only reason for the dismissal of the case your can check online on city civil court web side by filling the case detail, once the court case was failed series of things happened, the complainant Mr.Govindaiah was hit by a un known vehicle very badly while he was passing on the road near his house, he was in the hospital for very long time, we still suspect is this builder behind this hit and run case? this happened only after failing the case! we were busy in hospital and our council’s junior was managed by the builder, he did not attending the court continuously for 3 constructive dates and we did not get any relief from the court, we were in the gut felling that council is taking care of the case we will get the relief, it was too late when it came to our knowledge and by that time it was dismissed are else by this time the entire project would be stand still, but even today it is not too late, We have filled Original Suit in the court in the new case we will get relief from the court at the earliest.

It is not that, only if we get the stay we get the relief from the court, we have full faith in the law of this land and we get the proper relief from the court of law at the earliest. Only few things may change today we are fighting case only with the builder but in later stages we may fight with all the flat owners in this project, today we are going to court once in a month or so, but in later stages we may go many times to the court in a month, it does not make any difference.
