Lenovo — phone touch pad not working ok

From day 1st i am facing touch pad problem i submitted my mobaile to seller three times with bill but stil problem not resolved now i want replacement but he is telling me that he is not able to give me the same i think he passed some days hopefully to avoid replacement. Please help me.
