Respected madam,
I, had worked in lic of india in divisional office of jodhpur itself as under :

24.3.1989 to 2.5.1989 totalling 80 days 161 days

Now, after the directions of hon’ble the apex court in the historic case (supra) in cont. pet. no. 459/2015 & 21/2016 and in slp (c) no. 6950/2009 & batch. i am required to be absorbed by the lic of india after granting all promotions, pay revisions, admissible allowances to regular already working employees and other related service benefits fro the date of my joining in 1988. hon’ble justice shri v. gopala gowda and hon’ble justice shri c. nagappan while pronouncing the judgement in civil appeal nos. 6950, 6951, 6952, 6953, 6954 and 6956 of 2009, specifically directed to issue absorption letters and implement the order within a period of eight weeks but the corporation has not yet issued any absorption letter even after passing of one and a half year of the date of judgment i. e. 18.03.2015.
As per the verdict of the judgment of the hon’ble apex court, all such concerned members/workmen including the applicant herein, are eligible who have worked for such number of days on the respective post to be absorbed in the corporation right now without any delay with all benefits.
The corporation is well aware that civil contempt petition (s) bearing no. 459/2015 in civil appeal (c) no. 6950/2009 and a batch, were filed for the non-compliance of the impugned judgment of the hon’ble supreme court dated 18.03.2015 against sh. s. k. roy, the then chairman of the corporation and the said contempt petitions have been allowed by hon’ble apex court on 09.08.2016. thus, while allowing the said contempt petition hon’ble apex court gave eight weeks time to comply with the order dated 18.03.2015 with liberty to file a fresh contempt petition by the aggrieved.
As per the judgment of the apex court, the corporation is required to immediately send absorption letter absorbing me on a post on which i would have reached after getting all timely due promotions according to my qualifications that are b.com, m.com, llb, dcll, needless to say on being called i will submit documents for verification.
In view of the provisions and the statute of the lic of india, as per the promotion guidelines, i am required to be given all timely promotion (s) being a post graduate, giving weight-age over the incumbents who are simply graduates and accordingly fix my seniority. further, i am eligible for all financial benefits as per orders dated 18.03.2015 and 09.08.2016. the corporation while issuing absorption letters is required to mention the post on which i would be absorbed after promotions deeming that i am in continuous service in lic for last 28 years right from 22.08.1988 i. e. the date of entry in lic jodhpur divisional office, jodhpur.in other words, the benefits an incumbent would have get treating that the workmen have been working in the corporation continuously holding them entitle to all promotional, financial and other benefits and such other benefits which are being granted to regular employees, are also to be calculated and paid while absorbing and issuing letter of absorption mentioning the total emolument to be paid.
In view of above backdrop i humbly request you to absorb me immediately from 22.08.1988 i. e. the date of our first engagement in the lic of india with all benefits (promotions, seniority and financial benefits including the pension) and issue necessary orders without any delay as i have suffered a lot in this regard. on closure of consideration period granted by the hon’ble supreme court in the contempt petition (supra), i shall, needless to say, approach the hon’ble apex court for the willful inaction on the part of lic at the cost of the corporation and thereby we would pray to hon’ble court to restore the slps original order pertaining to grant of 100% arrears of pay/allowances in that situation, to all such employees including the applicant herein, for the non-compliance of the highest court’s order of the nation.
