Mahindra And Mahindra — claim for providing a brand new vehicle mahindra xuv 500 manufacturing defect

Dear sir,

On 29.03.2018, i purchased a new vehicle mahindra xuv 500 from sant autozone pvt ltd, kangra and the same was subsequently registered at jammu @ jk02cb 9961.
On 31.05.2018, the first free service washing was done at sant autozone at kangra at 1010 kms. As it was a routine washing only, no srutiny of other parts was done by the service provider.
On 28.07.2018, i went to astro india, mahindra authorized service station at bari brahamna jammu for a second service at 6023 kms where the mechanics detected engine oil leakage. Accordingly they suggested repair of timimg part of the engine. Vehicle was kept at the service centre and was delivered to me on 30.07.2018.in this regard i advise that i am on the senior management of sbi and had to ask for the leave inspite of my important official engagements. The vehicle was delivered with the word that it is ok in all respects.
On a day possibly between 03.09.2018 to 16.09.2018, i went to astro india service station at akhnoor road which is in close viscinity of my jammu residence to have a recheck, where i was told that it is still leaking under engine area and said a bolt was slightly loose and perhaps leakage was due to that very reason, they tightened it and said it is ok. I continued using my vehicle in a normal routine way.
On 27.10.2018 at meter reading of 10465, when my third free service was due and i took the vehicle to astro service centre at akhnoor road jammu where before washing i requested them to check the leakage of the engine and to my surprise the engine leakage was still there. They advised me to take the vehicle to their bari brahmana, jammu service centre for repair. Talked to the gm of astro india mr jaiswal who advised to get the vehicle to bari brahmana service centre on sunday 28.10.2018
On 28.10.2018, the mechanic opened the timing component of the engine and reassembled the same. The vehicle was delivered the same day with the advise that the leakage could be checked after running the vehicle for 400 to 50 kms approx., which i did as advised.
On 02.11.2018 at meter reading of 10915 kms, i took the vehicle to astro india akhnoor road workshop for a recheck and to my great surprise and shock, i was told that the defect existed. The engine oil was still leaking. The mechanics advised to take the vehicle to their bari brahmana workshop.
On 03.11.2018, took the vehicle to bari brahmana workshop and on scrutiny of the vehicle, they detected leakage now in the chamber part of the engine. Again to my surprise and astonishment. Newertheless they started its repair. As usual it took hours for repair and finally they rechecked the vehicle, it was again leaking. At this they suggested to change the chamber part of the engine by a new one. They searched for its spare part in jammu, but was not available. They procured the same from pathankot perhaps and suggested me that the vehicle shall be repaired now the next date on 04.11.2018 at their akhnoor road workshop and selected a new team for its repair.
On 04.11.2018, the vehicle was repaired and a new chamber component of the engine was installed. After the repair work was over. The mechanics rechecked the vehicle for engine oil leakage. Sir, to my extreme astonishment, the fault still existed and remained in irreparable state showing the incompetence of your workforce.
On 05.11.2018, the vehicle was again taken to astro india, bari brahamna workshop, where they informed me that they are taking up the matter directly with the company plant officials and accordingly requested me to keep the vehicle there for two days i. E 05.11.2018 to 06.11.2018.
On 06.11.2018 after my enquiring telephonically about the status of the vehicle, i was told that they failed to resolve the issue and some officials from their maharashtra plant shall be visiting to resolve the issue shortly. On this i asked that this should be advised to me by email on which they showed their inability to do so. Even my feedback on “ with you hamesha” app was not responded, by the concerned officials of mahindra.
Keeping in view the aforesaid facts i feel that the vehicle sold to me had a pre-delivery defect and i feel that no proper pdi has been done on this vehicle by sant autozone, kangra, h. P. Wherefrom i purchased this vehicle and this vehicle has a defect abinitio. I have been put to a huge inconvenience by mahindra & mahindra and its associates viz. Sant autozone, kangra, hp and astro india, jammu jk. Accordingly i claim a brand new vehicle in place of this defective vehicle else i shall go against the mahindra & mahindra company in court and publicly also

A FEW TELE CALLS RECEIVED, BUT NO CONCRETE DECISION HAS BEEN COMMUNICATED TO ME SO FAR. I HAVE BEEN TOLD THAT IT HAS BEEN DECIDED THAT A NEW ENGINE ASSEMBLY IS BEING INSTALLED IN PLACE OF OLD ONE.

THE COMPANY IS NOT SAYING ANYTHING ABOUT THE INCONVENIENCE CAUSED TO ME.
