SUBJECT: SEEPAGE FROM THE DEFECTIVE SEWER LINE/SEPTIC TANK AND GROSS NEGLIGENCE OF THE CONCERNED AUTHORITIES IN NOT ATTENDING TO THE REPEATED COMPLAINTS LEADING TO IRREPARABLE LOSS AND INJURY TO THE PROPERTY BESIDES LIKELY TO CAUSE GRAVE RISK TO LIFE AND PROPERTY i.e. GANGA APARTMENTS, OPPOSITE HARYANA ROADWAYS WORKSHOP, SHEETLA MATA ROAD, GURUGRAM
Dear Sir,
This is in further reference to the earlier repeated visits and oral complaints and subsequent written complaints bearing Numbers[protected] and[protected] dated 02.01.2017 &[protected] dated 08.01.2018 made by the Complainants i.e. Randhir Singh Kamboj, President of Ganga Apartments Residents welfare Association (M) [protected], Mr. SS Yadav (Advocate) (M) [protected] and also R/O Ganga Apartments, Opposite Haryana Roadways Workshop, Sheetla Mata Road, Gurugram and Tilak Raj Arora Owner in possession of the basement of the above referred Ganga Apartments and R/O 1603, Sector 4, Gurugram (M) [protected]. That as there was no response from your end, the complainants were compelled to issue a legal notice dated 02.01.2017 through their counsel Mr. Arun Gaur.
In this connection, we are pained to inform you as under:

1. That there has neither been any response to the said complaints and also the legal notice referred above. The basement of the building Ganga apartments is continuously being filled with the continued seepage from the defective sewer line passing at the back of Ganga apartments and the applicant Tilak Raj Arora has been spending huge amount of money to deploy manpower, equipment, transport and machinery to regularly drain out the filth pouring in from the said defective sewer line/septic tank required to be maintained by the municipal corporation.
2. It is reiterated that despite repeated complaints and regular follow up over telephone and also through personal visits, by the complainants and also the other residents of Ganga Apartments (including this on line complaint of date), about the continued seepage of effluent filth and waste water from the defective septic tank/sewer line located adjoining the rear side of the above referred building i.e. Ganga Apartments and which is being used to drain out the waste and excretion of the inhabitants of the Prem Nagar colony, Opposite Ajit Cinema, Gurugram. But the concerned officials have little concern to set right the evil hazard and are rather more interested in making easy money every time they are called to attend the problem of seepage resulting in collection of the filth and regular stinking seepage from the sewer line throughout the year. That we are forced to pay a sum of over Rs.2, 000/- unnecessarily for no fault of ours, every time a complaint is made in the matter to the concerned officials of your department. In this manner we have incurred more than Rs.1, 50, 000/- for saving ourselves from the mess and hell being so created to blackmail and extort money from the innocent residents. Further, your representatives including the concerned JEs have been avoiding to take the onus and the concerned JE responsible for Sewer related grievances asks to contact the one responsible for rainwater drainage and vice versa.

2. You will kindly appreciate that the same is not only causing public nuisance as the stink emanating from the said seepage of waste and effluents is beyond tolerance and has made the life of the inhabitants miserable but is also hazardous to life and property including rampant mosquito breeding, weakening the base of the building and due to which the entire building may cave in to cause irreparable loss of life and property.

3. That having been left with no other option, we are again approaching your good self directly with the hope that you will be kind enough to appreciate the problem and the inherent risks involved and to save us from being made to incur further losses on account of repeated cleaning and draining/pumping out the filth, waste and hazardous effluents from time to time). Further, the residents have also already suffered loss to the tune of over several lacs due to weakening of the base and structure of the entire building due to the above lack luster approach of the department/corporation.

4. That in view of the emergent threat to life and property, it is requested to take immediate steps to get the septic tank and sewer line repaired/replaced and to take further steps including every day regular pumping out of the waste/effluents to be drained out till such time a permanent solution is not reached. Please note that in the event of failure to provide the desired remedy immediately, we shall be bound to take legal recourse which shall be solely at your own risk, costs and consequences.
