Dear SIR,

SIR, With all due respect, I would like to bring your attention to concern I am facing ISSUE with HDFC bank WHICH IS A CASE OF MENTAL HARASSMENT AND BANKING FRAUD.

SIR, WITH ALL DUE RESPECT PLEASE READ THIS COMPLETE MAIL AND COMPLAINT, TO UNDERSTAND THE ISSUE I AM FACING WITH THE BANK.

WOULD LIKE TO BRING YOUR ATTENTION TO THE FOLLOWING POINTS FIRST:-

I:- WHY HDFC BANK HAS DEPOSITED THE AMOUNT OF 2, 69.525 WITHOUT MY CONFIRMATION. IF THEY HAD TALKED TO ME FIRST BEFORE DEPOSITING THE AMOUNT I WOULD HAVE STOPPED THEM AS MY TOTAL FINANCED AMOUNT IS 465, 000.00.

II:- WHY MY FRESH PERSONAL LOAN WAS CONVERTED INTO BT PLUS PERSONAL LOAN EVEN AFTER SAYING THEM MAY TIMES THAT I NEED A FRSH LOAN. AND POST ASKING THEY SAID YOU HAVE GIVEN US THE LOAN SCHEDULER OF ICICI BANK. SIR, I AM A NON-BANKER, HOW SHOULD I KNOW THAT WHICH DOCUMENTS WILL BE USED FOR WHAT PURPOSE. THEY ASKED WHETHER I HAD/HAVE ANY PREVIOUS LOAN. AND I SAID, I HAD A PREVIOUS LOAN ACCOUNT WITH ICICI BANK WHICH IS CLOSED NOW. THEY ASKED ME TO SEND THE REQUIRED DOCUMENTS AND I SENT IT.

THIS IS A CASE BANKING FRAUD DONE TO ME BY HDFC BANK.

ALSO, IT WAS MISTAKE DONE BY HDFC BANK EMPLOYEE NOT ME.

III:- WHY I AM GETTING DIFFERENT SOLUTION FROM EVERYONE. IS GRIEVANCE REDRESSAL IS NOT PART OF HDFC BANK OR NODAL OFFICE AND COMPLAINT DEPARTMENT.

IV:- AS INFORMED TO ME BY MR. VINEET THAT THEY HAVE TO CHECK MY ELIGIBILITY CRITERIA FOR MY REMAINING AMOUT TO BE RELEASED. I WOULD LIKE KNOW TO WHY THEY HAVEN’T CHECK IT BEFORE CONFIRMING MY LOAN PROPOSAL.

V:- HDFC BANK IS SAYING NOW I SHOULD DEPOSIT THE DISBURSED AMOUNT AND GET THIS LOAN CANCELLED. I WOULD LIKE TO KNOW FROM EACH MEMBER THIS BANK THAT IF I WOULD HAVE THIS MUCH OF AMOUNT OF MONEY WITH ME WHY SHOULD I APPLY FOR LOAN EVEN.

VI:- IF BANK HAD INFORMED ME BFORE CONFIRMATION OF MY LOAN THAT I AM NOT ELIGIBLE FOR FINANCED AMOUNT OF 465, 000.00. I WOULD HAVE TOLD THEM NOT TO PROCESS THE LOAN AS I REQUIRE THE AMOUNT WHICH I HAVE APPLIED FOR.

VII:- SIR, I HAVE BEEN FOLLOWING WITH HDFC BANK WITH MORE THAT 3 MONTHS. AND THEY ARE STILL PLAYING WITH MY ISSUE AS THEY HAVE GOT A TOY TO PLAY WITH, SINCE EVERYONE IS HAVING A DIFFERENT SOLUTION FOR THIS ISSUE.

STEP BY STEP EVENT HAPPENED TO ME:-

1. I had applied for a fresh PERSONAL LOAN, with HDFC bank on 17th MARCH 2018. I got a call from Mr Anshul mobile number([protected]) for detailed documentation. As discussed with anshul I had submitted the requisite documents to him for processing of personal loan.

2. I got a reference number 55818004 stating completion of documents and acceptance of documents.

3. IN DISCUSSION WITH ANSHUL I AHD ALREADY COMMUNICATED THAT I NEED A FRESH PERSONAL LOAN NOT A BALANCE TRANSFER. PLUS PERSONAL LOAN.

4. BUT In the Processing of My LOAN, they Made it as a BALANCE TRANSFER (BT) for the Processing of the LOAN. And I have communicated Many times that I need a fresh LOAN not a balance transfer since there is no LOAN Account Left in the Previous Bank for BALANCE TRANSFER.

5. On 29th March 2018, received a transfer of 2, 69.525 whereas My total financed amount is 465, 000.00 and disbursed amount is 461, 525.00 as per Mail received in reference with HBL=[protected] complaint reference number. With Out My concern The Amount of 2, 69.525 has been deposited in my account.

“I WOULD LIKE TO KNOW IN THIS THAT WITHOUT MY CONFIRMATION WHY BANK HAS DEPOSITED THE MONEY IN MY ACCOUNT. HOW THEY CAN DO THIS.”

6 I was in Regular Follow up with Jagriti ([protected]) and anshul ([protected]). As per communicated By Anshul Many times on Friday of every week that I will receive my amount on Monday. Post 2 Weeks I started Following UP with jagriti and also the Way of communication of jagriti with customer is not good. I also asked for a face to face discussion to any jagriti or with ay HDFC employee to resolve this issue But she deined to even meet with me. She is trying to close the loan by asking me to make the payment rather than solving the issue.

7. Also, I visited HDFC bank branch located on SECTOR-63 in NOIDA, to get this issue checked. But they even denied to look after this issue. As communicated by the Branch that LOAN was not processed with the Branch they will not entertain it.

8. Since I was not getting any reponse from any one from HDFC bank, I logged a complaint online in the HDFC portal and received a complaint number “'HBL=[protected]” on 17th APRIL 2018. And received no response in with this complaint.

9. Even after logging a complaint in reference with “'HBL=[protected]”, I did not receive any response, I logged a complaint with Grievance Redressal in HDFC portal got a complaint number “HBL=[protected]” on 23rd April 2018.

10. On 4th May 2018, HDFC bank deducted an amount of Rs. 10, 201.00/- which is total EMI for the amount which was sanctioned in the beginning I.e 461, 525.00 not for 2, 69.525.

11. After a long follow up with, on 7th May 2018 I got final solution in reference with complaint number “HBL=[protected]”. In which they have stated the following solution:-

“Your Personal Loan was disbursed only after the loan agreement cum schedule and repayment instructions for the EMIs were duly executed by you. By executing these documents, you are deemed to have read, understood and accepted the terms, condition, loan amount, rate of interest and charges payable to the Bank.

1. The amount financed to you is Rs. 465, 000.00 and you have executed all the prescribed documents accordingly. The loan has also been booked on our accounting system for this amount.Our loan was disbursed on 28/03/2018.

2. Part of the funds were to be utilized for takeover of the following existing loans. You have executed letters of authorization in favor of the Bank:

3. Cheque /DD Number xxx80 dated 31/03/18 sent through BLUE DART Courier Airway Bill Number [protected] on 31/03/18 to your mailing address on record. The cheque/DD was delivered to you on 31/03/18.
4. The balance of the loan, amounting to Rs. 269525.00 was credited on 28/03/2018.
5. The detailed break-up of charges deducted from the loan amount is as follows:
Amount Financed : Rs. 465, 000.00
Less:
MC/DD issued for take over of ICICI BANK LTD : Rs.192000.00
Processing Fees : Rs.2, 359.00
Franking Charges : Rs.100.00
Premium for Insurance Policy : Rs.0/-
Gap Interest : Rs. 1, 016.0.
Total Adjustments : Rs.3475
Net Amount Disbursed : Rs. 461, 525.00

With reference to your request, you have confirmed that Personal Loan (availed from 28/03/2018) has been foreclosed by you through your own fund/ resources and thereby you wish to cancel the MC/DD of Rs. 192000.00 (issued in favor of ICICI BANK LTD LAN LPGHZ[protected] DEWANSHU SHEKHAR) and credit the said proceeds to your salary account. As explained by our official, you are requested to produce the closure letter (from ICICI BANK LTD) and submit the same at our Retail Loan Service Center, to enable us to accede on your request for cancellation of MC/DD Rs.192000.00 and credit of the said proceed to your account. Otherwise, we will unable to release the amount of Rs. 192000.00 to the designated bank account.”

12. I accepted it as I already paid the EMI for the whole amount. ALSO IT CLEARLY STATES THAT THE MC/DD WHICH HAS BEEN ISSUE IN FAVOR OF ICICI BANK WILL BE CANCELLED AND THE AMOUNT WILL BE DEPOSITED IN MY ACCOUNT.

13 .So I contacted Mr Vineet on the given phone number for release of the Amount. And I got surprised by the way he talked and he refused to release the amount stating that it can not be done. I called Mr. Vineet about 7 time in which he received only 3 times. And out of those 3 time only one time he spoke to me nicely. In the first two times he behaved like that I am some sort of criminal who is speaking to him. After first two time he stopped picking my calls.

13 So, logged a call NODAL OFFICE as per Escalation Matrix provided by HDFC Bank to get the fund released. Nodal office has provided me complaint number I.e[protected]. Now, they came up with different solution for this issue.

1. That I should PAY the whole Amount and get this LOAN cancelled. I WOULD LIKE TO KNOW FROM EACH MEMBER THIS BANK THAT IF I WOULD HAVE THIS MUCH OF AMOUNT WITH ME WHY SHOULD I APPLY FOR LOAN EVEN.

2. Second solution they Provided me, that get my loan rescheduled and reduced to 2, 69.525 with tenure deduction. In this scenario I have the pay the same amount of EMI as decided earlier.

“ I WOULD LIKE TO ASK HDFC BANK IF I WANTED A 2, 69.525 LOAN, I WOULD HAVE APPLIED FOR 2, 69.525 NOT 465, 000.00.


IT LOOKS LIKE BANK IS TRYING TO SHOVE THIS SOLUTION THROUGH MY THROAT AND WANT ME COMPLY WITH IT.

AND I THINK THIS IS A CASE OF MENTAL HARASSMENT DONE BY HADFC BANK AND ITS EMPLOYEE TO ME.

SIR, WITH ALL DUE RESPECT, KINDLY LOOK INTO THIS ISSUE. THE ONLY THING I CAN DO IS TO REQUEST YOU ALL DO THE NEEFUL.
