Now i told them to restart the franchi
see but now they are saying my franchisee became null & void they are neglecting to refund my amount. Today i send them requesting mail to restart the Franchisee but they are saying as per the agreement we have given the money to vendors now the vendors are not returning back thats why they cant able to give back my money but at the time of agreement of the franchisee they didnot mention any thing that they will take give the money to thirdparty vendors .
Now they are neglecting to refund the amount .please find the below attached mail which i have received from them.

As per the agreement signed with us dated 19th day of December, 2015, it was been informed and mentioned that the amount will be non-refundable. Details of the same as below.

THIS AGREEMENT (“Agreement”) including all Exhibits and Statement of Work attached hereto and incorporated herein is made on the 19th day of December, 2015 at Mumbai, India between MORPHEUS HUMAN CONSULTING Pvt. Ltd., a company incorporated under the Indian Companies Act 1956, with its registered office at 108, Sagar Palazio, Sakinaka Junction, Andheri – Kurla Road, Andheri (east), Mumbai, Maharashtra, India 400072 (hereinafter referred to as “Morpheus” or the “Franchisor”) and Shayaque Hussain & Vaishak Shetty (hereinafter referred to as the “Franchisee”)

#F: Franchisee's Fees

Franchise would pay the Franchisor INR 1, 00, 000/- + Service Tax (Rupees One Lakh plus service tax) as a franchise fee for 5 years, which is non-refundable in order to be entitled to open a Morpheus Human Consulting Pvt. Ltd. franchise. There are no refunds on this initial fee. We reserve the right to alter this fee, if a potential franchisee commits to opening more than one franchise store.

Further, Balance payment of Rs 50000 was pending from your end for which we had given you 01 month credit period to settle the balance payment. Details as below.

Payment Details:

1st Installment: Rs 57500 dated 19/12/2015

2nd Installment: Rs 57000 due as on dated 18/01/2016

From the above scenario, practically if see you are payable to Morpheus Rs 50000 as we had purchased all the resources for the commercial set up for you and access had been provided for the same even though full payment was not settled. We had to pay balance amount from our pocket on your behalf considering you will make the balance payment within 01 month grace period provided. We don’t get any refund from our vendors once the services are purchased. We had made couple of calls, gave you reminders on whatsapp, mail etc. but did not find any positive response. Considering this, legal team terminated your agreement as per the terms agreed by both the parties.
