1. That despite of several time repeated complaints and request made by the Residents to MCD Civil Line Zone, Assit Commissioner, Inspectors but none from the Department has taken any strict actions against old person and his son.
2. The concern authorities visited once or twice and warned him but the actual position of that shop is worst from past now and MCD Department accepted that the old man is creating Encroachment, we have that recorded conversation.
3. That we the undersigned are residing at C-4 Block, Flat No. 9 to 14, Keshav Puram, from past many years and we are facing many problems due to the nuisance being created by an old man and his son in front of our housing locality.
4. That the old man and his son are running a small shop in here of sale and repair of pressure cookers and gas stoves for the past ten years in front of the housing locality.
5. That the same shop has been allotted to them by M.C.D. for a temporary tehbazari shop (measuring area 6ft x 4ft) and a slip has been issued to themfor the same.
6. That Despite of the given fact the shop was allotted to them only for carrying on his business activities nothing else, he and his son has somehow managed to make the same as his own home.
7. That it is to say that they are living here all day and night and littering all around and creating nuisance all over the locality.
8. That starting from the household chores from bathing, urinating, washing his clothes and utensils etc. he and his son doeseverything openly in front of their small shop.
9. That not only this his annoyance has gone upto this extent that it has become difficult for the females of the locality to come outside and stand in their respective balconies, because of the fact the old man is always seen without clothes and in objectionable position.
10. That old man also smokes hookah all day & night in front of his shop which also pollutes the environment, and they have kept waste wooden boxes, cooler, stones, cycle, plang etc.in all surrounding area of his shop, further more in such conditions wherein dengue, malaria & chickengunia are on high rise. That he and his son always pollutes the environment by throwing dirty and polluted water in allover the surrounding area of their shop, due to which many mosquitos have grown in the locality there are small children’s are living in here and there is also a chance that these small children’s and adults may catch dangerous diseases like dengue, malaria & chicken gunia due to the biting of the mosquitos.
11. That it is also to say that he is selling tobacco, cigarette, pan masala in that small shop for which he was not authorized nor any license he is having for the same and the shop was allotted to him for carrying on a business activity. He is selling tobacco, cigarette, and pan masala to small children below the age of 18 years which is illegal in the eyes of law.
12. That he and his son has also occupied this shop through illegal sources; though he was not authorized he has taken it through illegal sources.
13. That area which was allotted to him and his son by M.C.D. was (6 ft x 4 ft) but he has occupied much more than that, he has almostoccupied (20 ft x 10ft) and whenever any resident objects him regarding the illegally occupied space then he always threats them that he will commit suicide and blame the same to that person and his family members for his death.
14. That it is also pertinent to mention that since he and his son has illegally occupied space more than that which is also creating a problem for the locality residents, since they are unable to park their respective vehicles like cars, bikes etc. Not only had this he also tried to damage the vehicles of the residents by putting scratches on it.
15. That they are continuously creating noise pollution (inaudible sound) by repairing the cookers and gas stoves etc. due to which resident of the locality cannot survive. They always quarrels with all customers come to their shop.
16. That it has been in recent incident of 03.09.2016, an old man argued unnecessarily with one of the resident Sh. Dev. R/o- C-4/12 A and he has also abused him and P.C.R was called, all the more he has challenged him you can’t do anything to me keep on trying it. He has also said that “no authority either M.C.D. or the Police Department can do anything against him because he has good political connections”.
