My Hub Travel — Refund of Rs. 41000/- not received

1. That I decided to travel Kerala during the winter of 2017-18. I filled my bio-data and Hellow travel responded and they forwarded me addresses of four travel agencies. These were: My hub travels, Gov Tours, Awesome Voyagers and Oravel Stays Private Ltd. My Hub travel was the first agency to contact me on telephone. On 19.01.2018, I was informed that you have to contact Mr. Anil Kumar Sagar Ph. No. [protected] City Noida, Uttar Pradesh. Before any contact from my side one of its agent other than Anil Kumar, Mr. Amit (Contact No.[protected], [protected]) contacted me for the first time in the month of January. Thereafter, he almost contacted me on an alternate day and I was persuaded by him and asked the package as well as the itinerary. Initially we were two couple (4 adults) and the package was intimated by him of Rs. 36400/- only (excluding air fare). After few days one of the members refused to accompany due to certain engagements and I asked Mr. Amit to revise my package accordingly. Thereafter on 03.02.2018 Mr. Gagan (Contact No. [protected], [protected], [protected]) Travel Consultant forwarded me the package details for the tour and this package was of Rs. 28499/- for three adults, but in this package only one standard room was mentioned whereas my requirement was of two standard rooms. Then again I forwarded my requirement of two standard rooms to them.
2. That on 05.02.2018, a revised package was sent by the company and it amounted to Rs. 35499/- with a rebate of Rs. 2000/- shall also be given to you. I agreed to the proposal and the agent also offered to arrange air tickets to avoid any inconvenience. I finally agreed and an amount of Rs. 35000/- extra was asked towards air tickets and accordingly I transferred Rs. 71000/- (35000/- towards Air Tickets and Rs. 36000/- towards package including GST as informed by him.) Funds were transferred to account No.[protected] of Indusind Bank Noida (Rs. 51000/-on 05.02.2018 and 20000/- on 06.02.2018
3. Thereafter I was eagerly waiting for my tickets as well as Hotel and Vehicle Vouchers. But to my surprise I got a call and the company asked Rs. 25000/- more amount i.e 10000/- towards ticket expenses and 15000/- towards tour package on telephone. Then it was obvious that doubts were created in my mind and discussed the matter with the agent. The company showed their reluctance to conduct the tour with this amount. I believe that the air tickets depend on day to day basis. I immediately contacted an agent here in Shimla to intimate me Airfare of the same date and on same plane. It was around 35000/- on that day too. Thereafter, I immediately requested that the amount of Rs. 35000/-(Air Fare) may please be refunded immediately as I will manage tickets at my own level. The company was reluctant to refund the amount. I was informed that you will have to lose 10% amount due to refund. Even after reduction of 10% it was cheaper for me as the company was asking Rs. 10000/- towards air tickets. Then again one more condition that the amount will be refunded within 7-21 days which was not accepted by me at that time as the money was needed immediately to get the air tickets. I finally informed the agent to refund my whole amount of Rs. 71000/- if you are unable to conduct my tour package with this amount as agreed earlier by you. I was informed that 15% amount will be deducted and then due to these developments I told the agent to have my talks with some senior person in the company. He managed my talk with Mr. Ankit Aggarwal (Phone No.[protected] and I explained him the whole story. He agreed to refund my whole amount without any deduction within a period of 7-21 days as per the company rules and also accepted that the package was wrongly intimated to you. Then I remained in continuous touch with him via e-mails and on phone. He also intimated that Breakfast, Lunch and Dinner cannot be provided in any package as also is not feasible. I initially made the query about it but the agent replied that we will manage everything. Now the things were almost settled and I was told to wait for 7-21 days and the amount of refund shall reflect in your account.
4. For refund I continuously contacted on mail and telephonically to the team MY HUB TRAVEL on 28.02.2018, 06.03.2018, 13.03.2018, 19.03.2018, 26.03.2018, 30.03.18, 02.04.2018 and 05.04.2018 and thereafter on several times. On 30.03.2018, I had been told that the refund shall reflect in your account by 31.03.2018, but on 30.03.2018 again the promise was broken and I have been told the amount will reflect in your account after 02.04.2018. On 02.04.2018 Rs. 5000/- instead of Rs. 71000/- was transferred to my account which was not understood.
5. That I remained in continuous contact with the company and they refunded an additional amount of Rs. 5000/- on 16.04.2018, Rs. 10, 000/- on 01.05.2018, Rs. 5000/- on 07.05.2018 and Rs. 5000/- on 22.05.2018. I was also assured that the remaining amount shall be refunded by 01.06.2018. I contacted the company on 01.06.2018 but they showed their inability to refund any amount due to certain losses in the company and again assued me to refund the remaining amount by 10.06.2018. Being Sunday on 10.06.2018 I tried to contact them from the date 11.06.2018 but the company is not responding and all the contacts have been switched off.
6. That it is a clear case of breach of trust and I have been deceived by this company. The company has returned only Rs 30000/- instead of Rs. 71000/- and the amount for refund remains Rs. 41, 000/-. Hence the action as deemed fit may please be initiated against the company.
