i have booked a flat in victory bldg in nirmal life style kalyan in the year 2009 . registered in 2012, but i have yet to get possession upto date, no one is taking responsibility, is no one answerable? Are they only interested in collecting money, i have had to vacate my govt given flat because of this and now i am on rent since... i am a retired senior citizen who is being harrased for no fault of mine. pls some one advice me for legal action for the same . flat no b 1003

    delay in handing over of flat

    I was planning to file a case against the Builder(Nirmal Lifestyle) and the bank(ICICI Bank, for not doing the due diligence before issuing home loan). I had paid full amount against a flat in Blue diamond and its more than 9 years now nothing seems moving.

    My demand for an alternate flat of same size was not honoured by the builder, so I do not have any other option but to approach court of law for the refund of money along...

      hi ,
      I need completion certificate to submit LIC for loan disbursement. but Builder is not providing same completion certificate for the floor in which I booked my flat. im following up with builder for same for more than 45 days. but all the time im getting only one ans we dont have completion certicate switch to other bank or you have to pay addional charge to builder. please help me. if I go with bank where they have tie up then they wont demand for completion certificate.
      Please help me in getting the same.

        I had booked property in Nirmal Lifestyle Kalyan in June' 2011. Still Builder not done any agreement. now informing about govt new circulation regarding 33% extra towards stamp duty registration. what was that, pl advice. i had already paid 20% of the total property cost i.e. 25 Lacs & 80% is Home Loan. My Home loan is already sanctioned. no one at Nirmal giving clear idea as why still pending for agreement. I'm from middle class family, if nirmal demands additional 33% of the total value, i'm unable to fulfill their demand. so seek advice.

            I have booked my home in June 2010. They have told me that they will be giving pocession by Jan 2012.
            Till now they have not done the registration of my appartment. They dont have any APPROVALS till 15 floors. They have approvals for Just 7 floors.
            They are fooling us. I have sold my home and i stay in Rent. Many are fooled.
            Now they are telling that they will give pocession by JAN 2014. Which is injustice. Since REGISTRATION has not been done. By default banks dont give LOANS. My LOAN SANCTION LETTER IS ALREADY GIVEN TO THE BUILDER. Now they are asking to pay the intrest of the amount.

            People please help me...what should i do. am homeless now.

            NOBODY SHOULD BOOK YOU HOME IN NIRMAL LIFESTYLE CITY KALYAN. they are the bigger frauds.

            I had an extremely bad experience with Nirmal Lifestyle city kalyan.
            During pre booking they promised possession by 2012. But believe me till 2012 they didn't getvthe cc from government above 7 floors. No bank is ready to disburse loan to this property. They forced me to take loan from India Bulls. Finally I decided to withdraw my booking. My ethics do not allow me to deal with fraud people. They have the most pathetic management I had ever seen in muly life. I would prefer investing in properties local builders of some villages but will never invest in Nirmal Lifestyle property. ...

              excel — Delay in process

              I have changed my Postpaid connection to prepaid and completed all the formality on Thursday20/8/09 @ flower bazaar office - Chennai, i was informed that my connection will be active by evening, now it is almot 5 days and still there is no action, i want to be very clear if you cannot perform in particular given time then why do yo commit now i don't have any alternative planned, i am a heart patient and high BP patient treated at Apollo, i want immediate action to be taken, iam a cellone customer since it was launched, please look in t the issue seriously or else i would have to launch a complaint to Consumer Court.

              Dear friend, we are also in such a situation, I had book a flat in spirit, my friends also booked flats in other buildings. Now the think is happening no one is giving taking responsibility that when they going for start construction, how long this will take and when they will go for handover. They had already taken a money of 20% 3 years before (2009) for that flat which is still now not in existence actually in site. Several reasons, several commitment, several bluffing's they had started. They very well knows that the flat values had already increases in 3 years, thus no one is going to cancel the flat. Even if someone is cancelling, they can book in a higher rate. This is a true fact and they were playing with us.
              we also have booked a flat in Excel in June'11 and paid 20% of basic cost. We were told that registration would be done in Dec'11. However, when we asked in Feb'12 about status, answer was, it will take more 5-6 months. kindly, guide what to do in such situation.
              same here, I booked a flat in Excel bulding in Nirmal Kalyan. Yet to start construction there. But i received a letter from Nirmal for payment of applicable service tax . so i visited to mulund office at nirmal, they told me that, all the formalities and approval procedures are completed now for spirit and excel . And good news that they starts their construcion from the month of April. Mr. Pravan singh is the concern person at Nirmal Kalyan site for each & every progress & updates.

              Lets wait upto april, after that we have to take a legal and strong steps against Nirmal life style .

              I too was looking at investing in Nirmal Lifestyle Kalyan and so I went to the Nirmal Office and checked out the project details for myself. They say the project will complete in 2015 and you need to meet a Amit Samgiskar who is the Sales Manager. He was very helpful and took me through all the details very well. Look if you want to invest its best you visit them once. It surely helped me out. Panky I suggest you walk in to the Nirmal office and speak to Amit - He was very kind and will certainly help you too.
              Has anyone got the flat registered for Amazon building ? I have taken flat in that building in 2009 and in 2013 Feb they said to start registration process but again seems to have delayed for reason best known to Nirmal lifestyle. Anyone has diff exp wrt registration please post
              Place where excel building is supposed to be built is occupied by villagers..pls check on google maps...
              I purchased flat 2010 and they mention on agreement Possession date Dec 2014+ 6 month. If you visit site ask question they said possession started on 2017. If we called mulund office they said we will give possession on DEC 2014. All of them misguide us. Please any 1 tell me what we can do if they were not given possession on time. Many of flat holder paying interest only. Manager does not have any answer...

                I am a investor in real estate and have a plan to place some investments in Mulund area with a project of NIRMAL LIFESTYLES LTD, however I have learnt from some of my investor friends that Criminal Case has been registered against NIRMAL LIFESTYLES LTD with the Mulund Police Station and the Directors are expected to be arrested shortly

                I request you to kindly let me know the repercussions of such arrest on property prices of their projects

                i have also booked a flat with them met with the same fate. they argue that it is not forest land, hence
                forest dept clearance is not necessary. they say; they get approval soon, and commecne work in march 11.
                They have not started the construction. It smells fishy . Do not purchase until you can sustain the amount . Most builders are bluffers .
                Have they started construction yet ? I have different responses. They said that they paid penalty and will start construction soon. Did they get approval from MOEF for Blue Diamond building in Mulund which is under private forest land ?
                BEWARE...at the same time the are not CHORS>>>so relax they will give what they have promised but their may be delays...Also they have some legal issues which all the developers have but Nirmal does not do construction untill all approvals are in place...like some others like lodha who have no permissions but still doing their work...

                Hope we are sailing on the same boat my friend..nirmal builder have cheated us their entire project is fake as confirmed by KDMC. If anything happens in favour of them this project will take more 15-20 yrs to complete with all amenities.

                We have to unite and fight against them. We are 7 people now, dont you fear of loosing our money if wil fight...we are the winners they will have to return our money with bank interest @17% of the paid amount.

                  I purchased furniture from the store on July 25, 2010. I was told that since some items were not in stock in the warehouse they would reach me within 10 days. I received several pieces of furniture on August 1 and 3, 2010 and they were assembled and fitted at my home on August 1 and 4 respectively. At this time a cabinet which had been delivered could not be fitted because of non-availability of hardware and I was told that the hardware would be procured and fitting would be done within a few days. The remaining pieces took a month to be delivered and fitted. As of today September 16, 2010 one of the pieces (a dressing table) has still not been delivered and the cabinet has not been assembled. The box containing the parts of the cabinet was opened and left at my place by the fitter such that they were blocking the passage and the pieces of wood are dangerously exposed. We had to move the heavy box ourselves to prevent injury!
                  I am very disappointed with the service at the store and am regretting shopping there. Please avoid all Home Bazaar outlets and their sister store Home Town. The service in @Home, Housefull, The Living Room and Homecentre is so much better.

                  Home Bazaar — Faulty Dining Table Given.

                  Dear Sir,

                  We have purchased one Dinning table from Home Bazaar which is located in Thakur Mall dahisar, it is more than 6 months that we are complaining about the legs of the table. Three of its legs are not fixed properly and its standing on only one leg. It can harm any of my family member at any time... after complaining serveral time there executive came and stick the legs but within few days we started facing the same problem. on 22nd of August there were few Rituals at my place and that Dinning table was about to fall on my son, again there executive came and removed the legs and kept it behind the sofa but dint revert back. Month Ago it was told to me by Mr Vinod that I will get the replacement for the same in 15 days still no one is reverting as well not even informing how much time it will take to resolve the problem.

                  Home Bazaar — Delivery

                  Advance Receipt #[protected] for my order.


                  I had booked a bed, cupboard and a side table on 26th January 2011 from Surat home bazar. I had requested for the delivery at Mulund, Mumbai.

                  I was told that the delivery will be done any day after 5th of february. But, I haven't received anything. When I called the surat store again, I was neaver connected to the 2 attendee (Atul & Jignesh Shanwala) and was told me that its not in stock.

                  The attitude of the the person I spoke was like, I have paid, its on you guys whether u give delivery or not.

                  I also inquired at Mumbai, Mulund store. But they do not have any idea of this order.

                  Please let me know when I will receive the delivery. My contact# in Mumbai is [protected] & [protected].

                  Kindly do the needful to get me the products for which I have paid long back.

                  Home Bazaar — Delivery Issue

                  Hi,

                  I am writing this email after over 3 months of frustration, follow-up, damage.

                  I ordered the modular kitchen on Nov 14, 2010, Advanced Receipt no: [protected] of total amount Rs. 126130. The date given to us for the completion of kitchen was 14 Dec 2010. We had also taken a loan from future money for 84088 for which we were informed the EMI will start after the completion of the Kitchen.

                  But after 3 months we are still waiting for our kitchen to be complete. though the EMI has started without informing us.

                  Till now we have received 3 deliveries of kitchen material and ALL OF THEM WERE WRONG. The carpenter had to cut almost all parts to fit in our kitchen as the parts were of incorrect sizes, shapes and color. After 3 deliveries there is still a long list of material pending, which you can find in the mail below which is dated 31 jan 2011. And we are still waiting for the material to be delivered and the pending work to start.

                  The representative for kitchen work from Home Bazar, Nirmal Lifestyle Mulund, Rupali is on leave now, and the current representative Mayuri has no idea and like her predecessor is not helping us.
                  We escalated the matter to the store manager Pritam and he committed to complete the kitchen work before January 2011 but nothing happened and he has resigned.

                  After further trauma, we contacted the Area Manger William, and he like everyone gave false commitment to us and no action was taken to complete our work.

                  So after paying so much money and trusting the brand Big bazaar, we only have received stress, suffering and an unfinished kitchen.

                  This is the last resort for us, and we have faith that our problems will be sorted out.

                  If this also doesn’t work we will have to think of stopping the payment further and going for consumer rights which is something we don’t want to do. We have a long relation with Home bazaar as all the furniture for our bedroom, the electronic appliances like DVD player etc have been purchased from big bazaar and it was this trust that made us come to big bazaar for our kitchen.

                  But the current work has broken our hearts and trust and we are worried about the guarantee of the kitchen installation. Who will pay heed to the issues, when the installation is so careless?

                  I request to kindly complete the work for which we have paid money in advance.

                  i, am DR VIDYA SHETTY, i have purchased a recliner worth 17,000/ from mulunf lifestyle furniture bazaar, the covering has torn in 4months of purchase i have been complaining for past 7months, everytime the management guy changes and convinces that he will do the needful and nothing is done, ABSOLUTE FRAUD WORK.

                    On 7th Aug 2010 we had been to big bazaar at nirmal life styles, mulund(w). A worst experience we faced. I submitted bag on counter with my cell in it but I didn’t find my mobile after collecting bag from counter. Security guard and the lady on the counter responded rudely as I asked them about the same. After complaining to the manager, that guard returned my cell saying it was some where below the cupboard. Every one including manager has realized what was the incident. Actually that thief (guard-both lady and guy) had theft the cell. Customers submits their belongings to the counter with the trust that their things are safe but we were shocked for a moment that staff of big bazaar can even fraud with customers…shame on this…cheap & worst impression.

                      Dear Sir/Madam,
                      I have booked my flat withalmost 50% money paid with complete stamp duty / registration paid on 16th DEC 2006 but till date the builder has just manged to contruct on 5-6 floors of total 35 floors..... On trying to contact the builder he is not available nor any official letter from the builder has been issued, moreover his employees have been fooling us by making false promises...... such a big banner company with a title "the man who tansformed Mulund" but so low on his words..
                      HELP NEEDED.......

                      Yes they are low on their words. They have taken help of Mr. Hafeez Contractor to build good buildings, But
                      rest of things like managing customers /promises etc are based on their own mental conditions. How can they borrow/Buy that classy mentality? That does not sell annywhere. It only can be had with evolved brain conditions. They are in urgent need to change the way they work and probably can borrow that culture by going to some agency (Like Hafiz contractors!!)
                      Dear friend, we are also in such a situation, I had book a flat in spirit of Kalyan, my friends also booked flats in other buildings. Now the think is happening no one is giving taking responsibility that when they going for start construction, how long this will take and when they will go for handover. They had already taken a money of 20% 3 years before (2009) for that flat which is still now not in existence actually in site. Several reasons, several commitment, several bluffing's they had started. They very well knows that the flat values had already increased by 2 times in 3 years, thus no one is going to cancel the flat. Even if someone is cancelling, they can book in a higher rate. This is a true fact and they were playing with us.
                      Hello Friend, I have also paid 20% in advance and am waiting for posession of the flat at Nirmal Lifestyle City. I certainly do not regret my investment in this beautiful project. Yes it has taken time, given the size of the enormous project and the amount of funds that may be possibly required to complete the same. What I am happy about though is the rate at which is booked and the rate now has a huge margin making all early birds richer. Am looking forward to completion of this project as the amenities being provided are state of the art.
                      Hi All, I am new to this site and want to invest in real estate with any good builder. Have read a lot of good and bad reviews on this page on Nirmal Lifestyle City Kalyan . I have also checked their website Nirmal as the facilities and amenities they are providing are very Unique. Does anyone know who I can contact to get first hand information on this property so I can decide??
                      I had an extremely bad experience with Nirmal Lifestyle city kalyan.
                      During pre booking they promised possession by 2012. But believe me till 2012 they didn't cal me for registration when i calked they used to tel v dont have cc from government above 7 floors. No bank is ready to disburse loan to this property. They forced me to take loan from India Bulls. Finally I decided to withdraw my booking. My ethics do not allow me to deal with fraud people. They have the most pathetic management I had ever seen in my life. I would prefer investing in properties of local builders of some villages butnegativell never invest in Nirmal Lifestyle property. ..I would rate them negative stars. ...

                        I am staying in Nirmal Lifestyle for the last three years. Our is a new building and therefore society is not registered. The complaint is that from the first day of residing in my flat there was seepage from our toilet whenever flushing was done. I complaint it to the builder but they have not done anything till date. Now a proposed society has been formed but still not registered with the concerned authority. They are telling me to get it done as the flat below us is facing seepage problem. Since I have not done any structural changes I requested the builder to get it done. I also request you to guide where to complaint against the builder and get the work done as Iam not at fault. Even the fixing of floor tiles are very loose that they are coming out. The overall quality of the flat is very bad. Some amenities like swimming pool etc has still not provided to us by the builder. So please guide as I want to take action against the builder or whether I can get it done from the society.

                        Man, don't think it is big issue cause faced same at my home too.. as you said it is seepage means very minor leakage may internal or external in flush system.can be rectified at les cost and the view about getng it done from builder/society seems to be difficult nw cause u r using the flat since last 2 years ...U should have brought this issue at the time of possession only.

                        The society / builders views will be always remain same as they think from commercial angle where lots of residents never pay maintenance charges on time..which turns this people to become more & more cost effective...even u pay regularly..the sum o[censored]r all residents may nt doing the same...try to find out with ur coordinators about this..as this may be the one of its reason

                        I am a investor in real estate and have a plan to place some investments in Mulund area with a project of NIRMAL LIFESTYLES LTD, however I have learnt from some of my investor friends that a Criminal Case has been registered against NIRMAL LIFESTYLES LTD in September 2010 with the Mulund Police Station and the Directors are expected to be arrested shortly

                        You are a premiere organisation in real estate and I request you to kindly let me know the repercussions of such arrest on property prices of their projects

                        Instead of running from pillar-to-post, call a plumber and a mason and get the issue fixed yourself. Afterall you are facing the issue. I had similar problem had to break couple of tiles (lucky only couple of them had to be replaced). Found that the elbow joint of one of the pipes had corroded and punctured. You may have a unique problem, which could be diagonised only if you take professional help and spend some money!

                        I feel its a small issue and one must just call the plumber and get the issue sorted. As per my knowledge Mr. Hafeez Contractor is very well renowned and deficitely makes awesome and well built structures. Waiting for the society and/or the builders to handle such a small issue will take a long time due to paperwork and correspondence. Why let a neighbor suffer for a small issue like seepage!

                          Actually one thing which can't understand in this world so best methods of communication are available to bring unity for almost all of housing problem but I feel total failure as builder are taking advantage of divide and rule policy as they know that all people who sufferer will never come togther under one umberla and no body can touch them biggest example was available in election as only 40% vote in mumbai means remaining 60% or ready to suffer and people miss follow Shrimad Baghat GEETA we should bear unjustice here all are supporting unjustice by not making unity. As Geeta is not followed no body so nobody can get peace of mind according to me. I lost my hopes long ago before nirmal life style flat purchasing I had purchased flat as gone case as I need have flat in mumbai but I never ever invested in indian property as I was knowing builders are cheater riight from birth of mumbai as mega city well but internet had brought my hopes back so by following geeta I am doing my karama (work) remaining by trying hard to get back as per geeta remaining (fal) Result I had left on god.
                          This once again one gental man request please get together and put case against govt. in court as they are charging 5% stamp duty so they must interfere in public favour. late govt to take action in favour of public stop such mall practice and take over property and late another contractor to work in finish even seal there asets that is solution to give lesson to all builder for breaking contract written in agreement.

                            MR. SATPAL KUNDAN (flat#12) says “NOTHING DOING WITHOUT ‘MY PERMISSION’.

                            WATER WILL BE SUPPLIED AT HIS WILL IN THE SOCIETY.

                            AVOIDS RECTIFYING THE age-old BUILDING ISSUES.

                            GOVERNS THE BLDG SINCE 15 YEARS AS SECRETARY, UNDISPUTEDLY by self-selection panel .THE SECRETARY DOES NOT INTERACT ON SOCIETY NOTICE-BOARD OR SOCIETY letter-head original copy duly signed.

                            OWNS A MARUTI ESTEEM CAR, ONE FLAT SELF-RESIDING IN BORIVALI (WEST) AND TWO FLATS IN MIRA ROAD, THANE.

                            INSPITE, TRANPARENCY OF MAINTENANCE BILLS OF SOCIETIES OR ANSWERING QUERIES AVOIDED.






                            1. 24 hours water supply must be availed, unless BMC official cut is realized though news media or notice being placed onto the society board.The necessary equipments in the society pump room must undergo its repairs for ease of operations without any discomfort of water supply to members.The will and rigid attitude of managing committee members especially MR.SATPAL & MR.KRISHNAN is NOT JUSTIFIABLE and could be expected to be at par with the unit costing of maintenance bill per month delivered at each home-end . REBATE of petty amount to society members for such water issues to be formulated and re-evaluation of maintenance bill is realised.



                            WATER is delivered at undue timings and at self-ruled dictations without all-together consent of society members.THERE are only 12 flats .


                            2. RTI always denied – right to information is not so well entertained by the managing committee members.The passive members would expect the replies to the subjective issues.









                            3. All equipments are expected to perform thru sinking funds being generated & accumulated, be it the standby pump units. Timely repairs and maintenances are expected to be scheduled / carried out vide society funds to avoid delay of required attention to the equipments leading to scarcity of water for 1 day, 2 day at flat owner’s end owing to irregularity or negligence of operational needs.Forcing the members for want of WATER inspite of NO BMC issues, is dominant characteristic of MR.SATPAL & MR.KRISHNAN.


                            4. Any activity / functions with P.A SYSTEMS or GATHERINGS presided in the paving of society or terrace to be declared on notice board with all members agreed NOC to the event.


                            5. Occupancy of materials (scraps / garden tools etc ) on terrace by select flat owners and fews others kept refrained or out of enability of the same terrace would be treated as GOVERNANCE ACT.


                            6. Room made at terrace door midlanding to be made recognizable by a signboard – viz : society room, if found authentic.







                            7. Sweepers are not controlled by the committee time-table and commitment to maintain cleanliness in the society to be spear headed by the Managing Committee.REBATE of this paltry amount would be claimed if the necessary act is not enforced by managing committee with the sweeper employed.


                            8. Corrective measures within society undone / left-over works within 1 month would be attracting towards submitting of writ plea / request to SECRETARY .UN-ATTENDED PLEA will be pulled up for rebates in direct proportion to monthly maintenance bills through an auditor / arbitrator.


                            9. Comments delivered as casually hard objections with members or sub-members of the family especially the female gender at respective residences must be maturely out-spoken and must stand VALID from the driven clauses of the NBC ( NATIONAL BLDG. CODE ) and as per directives of Maharashtra Housing Societies Act . The comments / retorts can be forwarded through letterhead of the society with under signature from sender / managing committee for acceptance.NO threats to ladies especially by MR.D’SIVA will be borne.









                            10. The directions / byelaws are last but not the least expected to be non-dictatorial and non-anarchy type .The managing committee seems to continue with the posts / designations undisputedly for decade together till date . The 3rd floor members is said to GOVERN the society, as they claim to be “oldest resident” in the bldg.As its outspoken by MR. & MRS. D’SILVA, flat#10 and also MR.SATPAL KUNDAN, flat#12.


                            11. The pump room door and door frames awaits repair before it capsizes / falls out as its worn out.


                            12. The terrace paving would be utilized by all flat owners for petty domestic usages in the same wake as it is boldy being utilized by the old owners. The re-instatement of the place post-usage of the terrace / paving is at the sole responsibility of the user. “Clean as you go” principally to be adopted.


                            13. The society to place a sign board refraining eunuchs / sales people / donation-wallas etc for security reasons. The security guard personnel recruit seems to be REFRAINED by Managing Committee. The safety / security of flat owners’ family member especially lone-housewife or aged and weak elder parents, under such governance to be officially concluded vide bye-laws w.e.f Managing Committee and the prevailing legal codes in the NBC.





                            14. Tree branches entering the flat owners balcony would be curtailed / chopped at the sole responsibility of the flat owner. This could be for keeping out, breeding of fleas / pests from birds / mosquitoes and loss of natural amenity by flat owner vide sunlight .


                            15. The major repairs in any flats to be communicated to Managing Committee for technical assistance assurances thru an experts ( civil / constructions engineers ) view only.



                            16. All expenses WITHIN THE SOCIETY vide proposed civil / construction works of the society must be honoured for execution and nett payable status agreed jointly by all members for being pre-aware of any EMI expected to get attracted in prevailing monthly maintenance bills, post-confirmations with Civil / Construction engineering faculty member ONLY, for valuations of TO-BE-EXPEDITED works


                            17. Tanker potable-water is expected to be made available if water storage is concluded in the under water tank (ugwt) The UGWT is to be ensured to be filled with water BMC enabled or vide tanker supply.

                            18. Visitors car would be parked ? WHERE . A sign board is requested to be placed.



                            19. The maintenance bills are understood to be posted vide hand delivery without signature / initials of the secretary or treasurer since months together.

                            20. The society member would have no rights or prerogative to yell at other respected society member to EVACUATE ONE’S FLAT or LEAVE THIS BUILDING, if water issue is been ALARMED to committee member and expected to be solved, As out-spoken by MR & MRS.KRISHNAN at flat#2 .

                            21. ALL MEMBERS OF SOCIETY MANAGING COMMITTEE WOULD STAY ANSWERABLE TO all / any PASSIVE MEMBERS ABOUT THE functional IN-ADEQUACIES in the premises or building, be it “water” or “water-timings” or “ pump & booster issues” .



                            22. IF WATER PROBLEMS ARE PERSISTING AT THE FORCED WILL OF MR.SATPAL KUNDAN or any, RE-EVALUATION OF SOCIETY MAINTENANCE BILL AMOUNT PER MONTH IS EXPECTED TO BE DERIVED.
